RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1039 - LILLIAN G. ELLIOTT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1039 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 1039 was submitted by Lillian C. Elliott for property which is located in part of the NW& , Section 20 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels estimated to be approximately 18 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) The applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. 2) A septic permit shall be obtained for the proposed home and its septic system shall meet the requirements of the Weld County Individual Sewage Disposal Regulations . 3) An ISDS evaluation by the Weld County Health Department shall be obtained prior to the issuance of the required septic permit on any existing systems . 871094 Page 2 RE: RECORDED EXEMPTION #1039 - ELLIOTT 4) The following note shall be placed on the Recorded Exemption plat prior to recording the plat: At the request of the Division of Water Resources , the following conditions and/or restrictions shall be complied with: a) The property has not been previously subdivided or exempted since 1972 . The Division of Water Resources considers this a one-time exemption and will not make additional permits available for future splits of either tract. b) The well permit which will be available will be limited to use inside one single-family dwelling only. Outside use for lawn and garden irrigation or livestock is prohibited. c) The applicant should provide proof that an evaporative wastewater system will not be required. d) Prospective lot purchasers should be made aware of the limitations on water use. Elliott. The parcel of land on which this request is being made is described as part of the NW} of Section 20, T2N, R66W of the 6th P.M., Weld County, Colorado. The property is located approximately 1 .5 miles north of Fort Lupton, on Weld County Road 20. The parcel under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into two parcels of 17.5 acres and 2.0 acres, more or less. There is an existing residence and other improvements on the 2 acre parcel. The parcel of land is located in an urban growth boundary area. The Fort Lupton Planning Commission, State Highway Department, and the Weld County Health Department have reviewed the application materials and have no objections to the request. The Division of Water Resources has also reviewed the application and has recommended approval if certain conditions are complied with. The staff has concerns whether adequate water will be available for the potential uses of this property if the Division of Water Resources' conditions of approval are met. The Division of Water Resources' conditions are identified in its letter of July 20, 1987. The staff recommends that the Board of County Commissioners consider this request and determine if the standards of Section 9-2 E. There is no longer a need for me to keep this entire parcel of land. I am a retired lady senior citizen alone and cannot farm the land. I wish to keep approximately two acres where the established residence and other buildings are located. The rest of the land I wish to sell. The proposed two-acre parcel with the existing residence has access to C.R. 20. The larger 171-acre parcel would have access to S.H. 85 by means of an existing 24-foot field access. State Highway 85 has deeded access control, and the only direct access allowed is that which has been specifically designated.
