RE: APPROVAL OF RECORDED EXEMPTION NO. 868 - STEPHEN L. AND
DEBORAH A. SAUER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 868 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 868 was
submitted by Stephen L. and Deborah A. Sauer for property which is
located in part of the SEa , Section 26 , Township 5 North, Range 67
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 6 acres and 11 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Dear Commissioners:
This request for a recorded exemption is submitted by Stephen L. and Deborah
A. Sauer. The parcel of land on which this request is being made is
described as part of the SE} of Section 26, T5N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located .5 mile northeast of Milliken on
Weld County Road 52. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
The request is to divide the property into parcels of 6.2 acres and 11
acres, more or less. The property owners, Raymond and Helen Sauer, wish to
retain the smaller parcel in its present use and sell the larger parcel for
a residential homesite to applicants Stephen and Deborah Sauer.
The majority of the property is pasture. Proposed Lot A contains one
residence and farm outbuildings; frontage to Weld County Road 52 is
estimated at four hundred feet.
The applicant is requesting to develop the rear portion of the existing 17
acre lot. The frontage on proposed Lot B to Weld County Road 52 would be
approximately 50 feet; access to the internal lot would be provided by a 50
by 311.5 foot driveway located adjacent to Lot A's western boundary.
The following referral agencies have reviewed the application materials and
have no objection to the request:

The Department of Planning Services staff reviewed the Sauer's proposal on
May 7, 1986, and has concerns for approving a request to create an
"flagpole" lot which has only 50 feet of road frontage. It is the staff's
opinion that the subdivision of land allowing an internal parcel withouth
the proposed configuration of Lot B, as requested by the applicant is not
consistent with efficient and orderly development.
She staff requests the Board of County Commissioners consider this recorded
'exemption application and determine if the standards of Section 9-2 E. (1)
(a) through (m) have been met.

In r-esponse to your request that the Little Thompson Water
District provide domestic water service to a new residence
to be located on Weld County Road 52 in Section 26 , TWN 5N,
Range 67W, the District will commit to serve with the follow-
ing conditions.
1) The District currently has a 14 " main located
on the south side of Weld County Toad 52 with
additional capacity to serve another _residence.
2) I understand that your property does not border
Weld County Road -52 but your driveway will exit
to this road. Before the District can set the
-meter we will need a legal recorded easement,
from the person who owns the property, for the
area where the meter is to be set approximately
10 ' either side of and in front of and in back of
the meter location.
