HARVEY WHEREAS, the Board of County Commissioners of Weld County, Color-ado, pursuant to Colorado statute and the Weld County Home Rule Charter, is -vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 19th day of August, 1957 , considered the request of Francis L. and Virginia D. Harvey for a mobile home to be used as a principal _dwelling, and WHEREAS, said mobile home is to be occupied in an A-Agricultural _Zone District on a parcel of land being more particularly described as follows : Part of Section 25 , Township 7 North, Range 63 West of the 6th E.M. , Weld County, Colorado WHEREAS , the Eoard of County Commissioners, having heard the testimony, finds that said request should be _granted subject to the following conditions: 1) The applicant shall apply for a building permit for the mobile home within 18D clays from the date of approval by the -Board of County Commissioners; 2) The applicant shall apply for and obtain an access permit from the State of Colorado Division of Highways for access onto State Highway 392 ; 3) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; and 4) The mobile home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Francis L. and Virginia D. Harvey This request is for one mobile home to be used as a principal dwelling. Legal Description of Parcel: Part of Section 25, T7N, R63W of the 6th P.M., Weld County, Colorado Location: Northwest of Highway 392 and east of Weld County Road 71 . The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County. COMMENTS: The applicants have stated in the application materials that they plan to move a double wide mobile onto this 307 acre parcel and to use it as their principal dwelling. The Weld County Engineering Department has responded that primary access to this parcel should be from Highway 392. Weld -County does maintain Weld County Road 71, but will not increase the current level of maintenance which consists of blading the road approximately twice a year. The applicants chose not to submit a petition signed by at least 70% of the surrounding property owners. Two of the five surrounding property owners are governmental entities. Harvey for a mobile home Zoning Permit, and we have the following comments. Access to the proposed mobile home site is shown on the sketch map as being obtained from Weld County -toad 71 and State Highway 392. We have investigated the feasibility of access being limited to W.C.R. 71 since direct access to S.H. 392 is not permitted if reasonable alternative access is available. Based upon an on-site inspection and discussion with you regarding the status of W.C.R. 71 as a "wheat road", we have determined that direct access to S.H. 392 can be permitted as proposed on the sketch map. This access is to be located approximately z mile east of the W.C.R. 71/S.H. 392 intersection. Dur inspection of the site and discussion with -the applicant has revealed that an access to S.H. 392 at the proposed location was installed last summer by County forces without the property owner obtaining -an -Access Permit. This was apparently done as part of authorized County maintenance on the unpaved portion of S.H. 392. Use of this access for the mobile home will require an Access Permit _from this office. Mr. Dean Yost can be contacted at 350-2113 regarding application for this permit. We must remind the County that construction or re-construction of an access to a State Highway requires a state Access Permit. 871050 Ms. Lannell J.
