WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of December, 1987 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Tom Sugihara, Jr. , 2800 West 116th Place, Apartment 204 , Westminster, Colorado 80234 , for a Special Review permit for a greyhound kennel , 200 dogs, on the following described real estate, to-wit: Part of the SE} , Section 21 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposed use is consistent with the Weld County Comprehensive Plan' s Urban Growth Boundary Area Goals and Policies . The proposed use is located within the Urban Growth Boundary Area of the Town of Fort Lupton. The Fort Lupton Planning Commission reviewed this request and finds no conflicts with its interests . / 871555 Page 2 RE: USR - SUGIHARA b. The proposed use is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposed use is compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Agricultural Zone District. Three existing dog kennels are located within 1 ,000 feet of the proposed Special Review area. The balance of the surrounding property is dryland pasture , high tension power lines, and oil and gas production. d. No overlay districts affect the site. e. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Special Review permit for a greyhound kennel, 200 dogs , on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording the plat for Case #811 , Special Use permit #431 for the existing dog kennel on the property shall be amended and a recorded exemption shall be approved for the proposed land split. 4 . The Special Review permit is for a greyhound kennel as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The maximum number of dogs shall not exceed 200 . 2 . All animal waste shall be disposed of in such a manner as not to cause a public health nuisance. 3 . All septic systems shall be installed according to the Weld County Individual Sewage Disposal Regulations. 4 . The soil erosion control plan approved by the Platte Valley Soil Conservation District shall be maintained at all times . 5 . The greyhound kennel facility shall comply with the Colorado Racing Commission ' s Rules and Regulations pertaining to greyhound kennels. 6 . Buildings and grounds shall be kept clean, in good repair, and free of trash. All wastes shall be removed from the property on a weekly basis to an approved landfill. 7 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. -8 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 9 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 10 . Personnel from the Colorado Racing Commission, Weld County Health Department, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 11 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown of stated shall require the approval of an amendment of the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 12 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation o₹ the permit by the Board of County Commissioners. Morrison :Planning Department _representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated November 23, 1987, and duly published December 3, 1987, in the Johnstown Breeze, a _public hearing was conducted to consider the request of Tom Sugihara, Jr. for a Special Review permit for a greyhound kennel with a maximum of 200 _dogs. Lee Morrison, Assistant County Attorney, made this matter of x-ecord. Lanell Swanson, Planning Department representative, requested that the favorable recommendation of the Planning Commission be entered into the record of this hearing. Tom Sugihara, Jr. , came forward and stated that he has no problems with the four Conditions and twelve Development Standards contained in said recommendation. No public comment was offered concerning this request. Commissioner Johnson moved to approve this Special Review permit, subject to the Conditions -and Development Standards contained in the Planning Commission's recommendation. The motion was seconded by Commissioner Yamaguchi. Commissioner Kirby asked if the 200 dogs allowed would be the total, regardless of age, and Mr. Sugihara assured the Board that there will not be a total of more than 200 dogs of all ages. The motion carried unanimously. This Certification was approved on the 21st day of December, 1987. Licensee shall acquire consent from the owners of agricultural rights on the Licensor's fee properties and be liable to said owners for damages or loss caused to crops or pasture during the exercise of the rights permitted herein. 2. After initial construction and thereafter, in the event of resettling, Licensee shall restore the surface of the premises by grading and compacting any irregularities left after construction. 3. Licensee shall reimburse Licensor for all costs involved for replacing and resetting any section corners, quarter corners, ownership monuments, rights—of—way markers and reference points, disturbed or destroyed during the construction, operation, maintenance or removal of said facilities. 4. This License is issued subject to any prior licenses, easements or leases granted by the Licensor for improvements of other parties. 5. Licensor reserves the right to license others to install improvements in, on, under and along the premises provided that same shall not interfere unreasonably with facilities herein authorized. 6. Licensee shall notify in writing Licensor's Transmission Lines Manager, P.O. Box 840, Denver, Colorado, 80201 , or by phone at 273,4686, at least four (4) days prior to the beginning of any construction of the facilities in order that a representative may be present during such work. Directions given by such representative relating to the safety of Licensor's structures shall be followed. 7. Licensor intends to use the premises for all purposes connected with electric transmission and distribution lines, and that the rights herein granted to the Licensee for the use of the premises are subject to the rights of Licensor to use the premises for such purposes, which rights Licensor hereby expressly reserves. 8. Licensee shall indemnify and save and hold harmless the Licensor against all claims and liability for damages, loss or expense caused by any injury or death to any person or damage to property if the same shall in any way be connected with or result from the negligent use of the said premises by Licensee or its agents. 9. In the event that Licensee's use of premises should, in the sole judgment of Licensor, interfere with Licensor's use of premises or constitute a hazard to Licensor's structures or the general public, Licensor may require immediate relocation or modification of Licensee's facilities to eliminate such interference or hazard and may suspend Licensee's right to use the premises under this License until such relocation or modification is completed. - y 8 5 5 10. Upon abandonment of the use of the premises by Licensee, or the violation of any of the convenants hereof, the permission and right herein granted shall terminate. Upon termination, Licensee shall remove its facilities from premises. If Licensee should fail to remove Its facilities, Licensor may remove said facilities at the expense of Licensee. 11. It is understood and agreed that Licensee has been fully advised by Licensor that the electric conductors on the electric lines, which are on the premises, or which may be installed in the future, transmit or will transmit electric current up to 230,000 volts or more and that the conductors on the electric lines are not insulated. Licensee shall advise all its employees, agents, contractors and other persons who enter upon the premises of the dangers involved. 12. Licensee shall not assign the License nor any rights hereunder without the prior written consent of Licensor. Any assignment without such consent shall in no way be binding upon Licensor and shall give Licensor the option to terminate this License. Subject to the foregoing restrictions, this License shall inure to the benefit of and be binding upon the successors and assigns of the parties hereto. THE DISTRICT AGREES TO: Assist in carrying out a conservation plan by furnishing to the Land User ( 1 ) infor- mation, (2) technical assistance and supervision , and (3) other assistance as it may have available at the time the work is to be done. THE LAND USER AGREES TO: I . Use the land within the capability of the soils. 2. Develop as rapidly as feasible a conservation plan for the land. 3. Start applying one or more conservation practices in keeping with these objectives and the technical standards of the District. 4. Maintain all structures established in an effective condition, and to con- tinue the use of all other conservation measures put into effect. 5. Use any materials or equipment made available by the District for the pur- pose and in the manner provided for it. IT IS FURTHER AGREED THAT: 1 . This agreement will become effective on the date of the last signature and may be terminated by either party or modified by mutual agreement of parties hereto. 2.
