RE: APPROVAL OF USE BY SPECIAL REVIEW FOR ALICE PEHR (LARRY
SCOTT) - FARM EQUIPMENT REPAIR SHOP
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 15th day of May, 1985 , at the hour of 2 :00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of Alice Pehr (Larry Scott) , 11222 Highway 52 , Fort
Lupton, Colorado 80621 , for a Use by Special Review for a farm
equipment repair shop on the following described real estate,
to-wit:
Part of the SWa, Section 1 , Township 1 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or
County. The proposal does not appear to have any
adverse impacts on the agricultural interests of
the County or the environment.
b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a
Use by Special Review.

c . No overlay districts affect the site.
d. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a farm equipment repair shop on the
hereinabove described parcel of land be , and hereby is , granted
subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any building or electrical permits be
issued on the subject property until the Use by Special
Review plat has been delivered to the Department of
Planning Services office and the plat has been recorded
in the office of the Weld County Clerk and Recorder.
3 . Prior to recording the Use by Special Review final plat,
the applicant shall demonstrate that the concerns of the
Division of Water Resources in regards to the water
supply have been met.
4 . Prior to recording the plat, the applicant shall submit
to the Department of Planning Services an erosion
control plan that has been approved by the Platte Valley
Soil Conservation District .
5 . The septic system shall be designed to meet the
requirements of the Weld County Individual Sewage
Disposal System Requirements .
6 . The applicant shall submit a revised mylar plat showing
a seventy-five (75) foot road reservation south of the
centerline of State Highway 52 along the southern
boundary of the entire parcel as recommended by the
State Highway Department in its letter dated April 4 ,
1985 .

A public hearing was conducted on May 15, 1985, at 2:00 P.M. , with the
following present:
Commissioner Jacqueline Johnson, Chairman

Commissioner Frank Yamaguchi

The following business was transacted:
I hereby certify that pursuant to a notice dated May 2, 1985, and duly
published April 29, 1985, in the Johnstown Breeze, a public hearing was
conducted to consider the request of Alice Pehr (Larry Scott) for a Use by
Special Review for a farm equipment repair shop. Assistant County
Attorney Lee Morrison made this matter of record. Chairman Johnson noted
that only four Commissioners were present and informed the applicant that
if this hearing should end in a tie vote, the absent Commissioner would
review the record and listen to the tape of this hearing before casting
the deciding vote. Rod Allison, Planning Department representative, read
the favorable recommendation of the Planning Commission, with the ten
proposed Operation Standards, into the record. (Tape Change #84-35) Mr.
Allison also stated that Condition #3 should now read, "Prior to recording
the Use by Special Review Final Plat . . ." Larry Scott came forward to
answer questions of the Board and stated that an application has been
submitted to the Division of Water Resources. Mary Leinweber came forward
to state objections to this proposal. She also requested that the
Operation Standards include a six-foot fence between the area and the
residence to the east. Teresa Scott, daughter of Alice Pehr, also came
forward to speak. After discussion, Commissioner Yamaguchi moved to
approve the Use by Special Review for a farm equipment repair shop, with
the recommended change to Condition #3. Commissioner Kirby seconded the
motion and reviewed the criteria for granting a Use by Special Review.
The motion carried unanimously.

The Planning Commission's recommendation for approval is conditional upon
the following:
1 . The attached Standards for Use by Special. Review be adopted and
placed on the Use by Special Review plat prior to recording.
2. The prescribed Use by Special Review activity shall not occur nor

Commissioners the applicant shall demonstrate that the concerns of

OPERATION STANDARDS

1. The uses permitted shall be a Farm Equipment Repair Facility described
in the application materials on file in the office of the Department of
Planning Services.
2. The use permitted shall be limited to farm equipment repair.
3. No storage other than the scrap iron container(s) and the commercial.
trash container shall be allowed outside the proposed shop building.
4. Trash containers and the scrap iron container(s) shall be screened from
Colorado State Highway 52 and all other adjacent properties.
5. The applicant shall implement and maintain the approved soil erosion
control plan.
6. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
7. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
8. Representatives or members of the Weld County Health Department and
Weld County Department of Planning Services shall he granted access
onto the site at any reasonable time in order to insure the operations
carried out on the site comply with the Operation Standards stated
hereon and all applicable Weld County Regulations.
9. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the Standards as stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
10. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

We are in a very fast changing community, particularly the agricultural
community and he is not sure that we are looking at the fact that change is
taking place. Lydia Dunbar - yes; Louis Rademacher - no; Jack Holman - Yes,
he has to agree with Paulette Weaver's statement, plus the fact that the
standards which the Planning Commission uses for a change of zone out of the
six items he comes up with four no's and two others are questionable. His
main concerr is setting a precedence. When he looks back over the things
that have been done over the past five or six years, or even longer ago than
that, openirg an area such as this to this type of zoning once it starts
there is not way it can be controlled. Stephen Hamilton - Yes, he has lived
out in the country on a small acreage and he has seen the proliferation of
what happens to areas when you allow something of this magnitude to come in.
It does help to destroy the country atmosphere. Sharon Linhart — Yes, she
does echo the thoughts of some of her fellow commissioners. It is with
mixed emotions that she votes yes to deny this change of zone. She finds
that there are some changing conditions at this site. She feels that the
applicant has demonstrated that they understand how to run a quality
operation. Her concern is what Jack has mentioned, once we change the zone
we cannot go back, we can't reclaim it as agricultural or anything else at
that point. She has notice that the applicant has come in and redone some
things, but she is not convinced that the Carlson's will remain there and
operate it forever. If she thought they would she would probably feel
differently.
Motion carried with five voting for the motion and two voting against the
motion.
The Chairman called a recess at 3:55 p.m. The meeting was reconvened at
4:05 p.m.

equipment that is brought into him and to work on equipment in the winter
time and to store his tools and equipment in. A lot of his business will
consist of field calls and he will repair the equipment in the fields.
Access from this property will be onto Highway 52 and the Colorado
Department of Highways did not feel an access permit would he needed because
of the low volume of business that would be entering. Nothing will be
stored on the property on the outside except equipment waiting for repair
parts.

request. He felt it should go into a industrial area in Fort Lupton.

felt the shop would detract from the area and should be in an industrial

Michael Mullen reported the intent is to allow Mr. Scott to have an
agribusiness rather than having a change of zone.
The Chairman asked Michael Mullen to read the recommendations, conditions,
and operation standards as outlined by the Department of Planning Services
staff into the record.
The Chairman asked Mr. Scott if he had any objections to the
recommendations, conditions, or operation standards as presented. He stated
does not agree with Operation Standards #2. His primary work will be on
farm equipment, but sometimes the line between construction equipment, farm
equipment, end other vehicles is nondistinguisable. He needs to be able to
work on trailers, autos, welding, etc.

motorcycles, trailers, recreational vehicles, motorhomes, boats and
construction equipment shall be serviced and repaired including body
stock, welding and repairing on the site. This standard shall not
apply to vehicles that are registered to the applicants
3. No storage other than the scrap iron container(s) and the commercial
trash container shall be allowed outside the proposed shop building.
4. All activities associated with the subject Use by Special Review
request shall take place within the proposed building.
5. Trash containers and the scrap iron container(s) shall be screened from
Colorado State Highway 52 and all other adjacent properties.
6. The applicant shall implement and maintain the approved soil erosion
control plan.
7. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
8. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
9. Representatives or members of the Weld County Health Department and
Weld County Department of Planning Services shall be granted access

My reason for applying is to construct a 40 by 50 foot 'Ned€cor
building for the purpose of repairing farm implements, tractors,
trucks and other machinery.
We have a field service unit set up on a two ton truck that would
be used for on the farm service calls, however, there would be some
work which could not be done in the field. It is for these jobs that
I need a shop in which to work on them. Also, to house the service
truck, parts, supplies and machine equipment;
The existing uses on the surrounding properties are mainly agri-
cultural. Uses include growing grain crops, food crops and hay,
boarding, breeding and keeping horses, and raising cattle and hogs.
The distance of the proposed use to residential structures is as
follows:
To the north west, 500 feet.
To the west, 850 feet.
To the southwest, 1400 feet.
To the east, 2600 feet.
To the north, .000 feet,
Maximum number of users and patrons at the shop site is estimated
to be five to fifteen per week. '?alf of the trade will be jobs using
the service truck at the customer' s own location. Most of the rest of
the work will be long term repairs performed at the shop site.
I do not intend to employ any extra help at this time. My hours of
operation wou:_d be from 8 :00 a.m. to 5:00 or 6:00 p.m. , five to six
days per week„ There would possibly be longer hours during the grow-
ing season.
The access route for the proposed use would be an existing graveled
Amoco Oil Company easement road off of Colorado State Hiway 52.
Traffic associated with the proposed use is expected to be farm
tractors, implements, trucks, ranging in size from pickups to large
diesel trucks„ Weights would range from 1000 to 20,000 pounds, Fre-
quency is estimated at 5 to 15 per week.
The type of sewage facilities for the proposed use would be a
500 gallon septic tank and appropriatly sized leach field.
Fire protection measures for the proposed use will be a smoke
alarm, fire extinguishers, keeping weeds under control. This will be
a steel and concrete building with fire proof insulation.
This does not apply as there will be no animals on the proposed
use area.
There will be a scrap iron container supplied by Gahegen iron
and Metal Company for scrap metals. A commercial trash container
will be leases, from a rubbish. removal company. A container for re-
cyclable oil and oil based products will also be obtained. 11.1
used motor oils, solvents, lubricants and related materials will
go into this container. A small inventory of parts and supplies,
such as oil filters, oil, grease, belts, gaskets, hoses, fittings,
bolts, nuts will be maintainec in the shop building.
The scrap iron container supplied by 3ahagen Iron and Metal.
Company will be emptied by them when necessary. The trash container
will be emptied once a week by the rubbish removal company. The
waste oil containers will also be emptied when they become full,
.eclamatior., procedures to be employed upon cessation of the use
by special review activity do not apply because we will not be doing
any damage to the land.
Upon obtaining the Special Use Permit, preparation of the site
and construction of_ the building will begin immediately, weather per-
mitting. Timetable for completion will be approximately 30 to 45 days.
The ;round will be graded to drain away from the sides of
the building into a drain ditch running into an existing waste
water drain culvert, located in the northeast corner of the
parcel.
The water source shall be an non—adjudicated well.

Shrubs and trees will be planted by the building. Part of the
area will be graveled. Weeds will be cept under control.
since our use of this Lana would be associated with the agriculture
of southern +e la County, in that I would be repairing mainly farm equip-
ment, we feel our use woui0 be consistent with the Weld County Compre-
hensive plan.
The proposed use would be consistent with the intent of the district
because my work would be mainly concerned with agriculture. I would
be repairing farm implements, tractors, various sizes of trucks, macho
inery and building specialty implements according to customerts re-
quests. ? feel this will benefit the agricultural industry of Southern
Weld County.
The small parcel of land that would be used is difficult to irrigate
because of existing corrals and buildings. The soil is number 3, Aquolls
and Azuents, so itlnot very productive farm land. Because of these rea-
sons we feel we are not taxing valuable farm land out of production.
7.ie feel that in the operation of a tractor, machinery and truck re-
pair shop, we will not be causing any health or safety hazards to the
neighbors or the county.
The existing uses on the surrounding properties include growing
grain crops, food crops aria hay, boaraing, breeding and Keeping horses
and raising cattle ana hogs. ,9e feel that in operating an equipment
repair shop uill not interfer pith any of these uses and will in fact,
benefit the peopie in the area by supplying a valuable service to them.

iopment of the surrounding area, because it will not interfer
with future agricultural development and will provide a
positive, valuable service to the surrounding area.
According to the Weld County Planning Department' s flood
plain map for our area, the special use review area is rot
located in a flood plain. Tt also is not' located on a geologic
hazard, or the Weld County Airport overlay district area.
The water source for the proposed use will be an non-
adjudicated well.
We ask that a noise report be waived by the Department of
Planning Services. The distance of the proposed use to re-
sidential structures is as follows;
To the northwest, 500 feet.
To the west, 350 feet.
To the southwest, 1400 feet.
To the east, 2600 feet.
To the north, 1900 feet.
The building will be elevated six inches above the surround-
ing ground level. The ground will be graded to drain away from

Dear Mr. Mayerl:
We have reviewed the application from Alice Pehr for a Use by Special
Review Permit and have the following comments:
1. Projected traffic on State Highway 52 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. The
existing right of way south of the centerline along this property
varies from 60 to 68 feet. Additional width to achieve the projected
width should be provided by reservation or, preferably, dedication as
permitted by local regulations.
2. We support the use of the existing access at the east end of this property
for the proposed repair shop. Since this access serves an oil well, and
the projected additional traffic due to the repair shop is low, no
Access Permit will be required.

Dear Mr,. Mayerl :
Please find enclosed a copy of our as-built map which shows our
pipelines #19-10-075-04-3", #16-10-075-21-4", and #16-10-075-21-4" in
the hi-lighted areas of the Southwest Quarter of Section 1, Township 1
North, Range 67 West, Weld County, Colorado.
We maintain a 50-foot wide right-of-way and will not allow any
building within that easement area. The owner or developer shall have
the right to construct and maintain utility lines , streets, sidewalks,
and driveways which may be installed at approximate right angles to the
pipeline herein authorized, provided, however, that all utilities main-
tain 12 inches clearance from our pipeline. No paved or traveled portion
of any street, sidewalk, driveway, road, parking area, alley or curbing
will be placed substantially parallel to and within ten feet of the pipe-
line.
In the event of a proposed crossing with a road or utility, notif-
ication of 48 hours is to be given to Panhandle so the line may be
properly located to eliminate accidents that can occur from foreign
forces .
We will be more than happy to work with the developer on this
project. If for any reason our line must be moved, it will be at the
expense of the developer or the person or persons asking for this move-
ment.

We have reviewed the application from Alice Pehr for a Use by Special
Review Permit and have the following comments:
1. Projected traffic on State Highway 52 indicates the need for a 150-foot
total right of way, 75 feet each side of the highway centerline. The
existing right of way south of the centerline along this property
varies from 60 to 68 feet. Additional width to achieve the projected
width should be provided by reservation or, preferably, dedication as
permitted by local regulations.
2. We support the use of the existing access at the east end of this property
for the proposed repair shop. Since this access serves an oil well, and
the projected additional traffic due to the repair shop is low, no
Access Permit will be required.

Soils limitations appear to be adequately covered in the application material

grass for e-osion control . Plants may need to be clipped during the grow-
ing season for fire control .
