RE: APPROVAL OF RECORDED EXEMPTION NO. 756 - UNION COLONY BANK
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-2S-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 756 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 756 was
submitted by Union Colony Bank for property which is located in
part of the SW4, Section 20 , Township 5 North, Range 64 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall he provided by the applicant and
known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 9 acres and 95 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners.

Re: Recorded Exemption (IRE-756
Dear Commissioners:
This request for a recorded exemption is submitted by Union Colony Bank. The
parcel of land on which this request is being made is described as Pt. SW's
of Section 20, T5N, R64W of the 6th P.M. , Weld County, Colorado. The
property is located approximately 3/4 mile west of Kersey on Weld County
Road 5414. The parcel of land under consideration is the total contiht•ous
land holdings of the applicant.
The request is to divide the property into parcels of 9.2 acres and 94.5
acres, more or less. The applicant wishes to sell both proposed lots. An
adjacent property owner to the south is interested in acquiring the larger
95 acre parcel and will continue to maintain it as irrigated cropland. Tot
A will remain in rural residential use.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1 . The applicant has demonstrated in the submitted application
materials that the request complies with the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.
2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 F.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requiremerts
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within sixty (60) days from the date cf
approval by the Board of County Commissioners.

To Whom it May Concern:
1.) Attached is an Application for Recorded Exemption on property currently
owned by Union Colony Bank of 1701 Twenty Third Avenue, Greeley, Colorado.
Also, enclosed is a check in the amount of $125.00 payable to Department of
Planning Services;
2.) A Certificate of Conveyances will be forthcoming from Chicago Title
Insurance Company;
3.) Enclosed is a copy of a "Title Commitment" and a copy of a Deed on the
subject property.
4.) Subject Application is submitted for the purpose and reason of:
a.) Aiding Seller sell their property and
b.) Aiding the adjacent property owner to acquire irrigated farmland
without buildings. The remaining Lot A as proposed, will then
be marketed as a tract.
5.) This proposal is consistent with the policies of the Weld County
Comprehensive Plan.
6.) The proposal is consistent with the intent of the Zone District in
which subject property is located.
7.) The uses of proposed Lot B will remain irrigated farming, as in previous
years, which is the same land to the north and west of subject property. Land
to the south of subject property is dry pasture land, while property to the
east is subdivision and tracts. Thus proposed Lot A (a rural residential
tract) is consistent and compatible with existing surrounding land uses.
8.) The uses permitted in proposed Lot A and B will be compatible with
future development of the surrounding area as permitted by the existing
agriculture zone and with future development as projected by the compre-
hensive plan of Weld County and the master plan of Kersey, Colorado.

9. ) The proposed split in my opinion, will not be inconsistent with efficient
and orderly development of the immediate surrounding properties.
10. ) Lot A presently has a Central Weld. County Water District tap and en-
closed is a letter from said district, stating their intent to provide
domestic water to Lot B. Septic tank is presently used with the residence
located on Lot A and the USDA - SCS soil survey on proposed Lot B is suitable
also for septic systems.
11.) Subject property is not located in a flood plain, geologic hazard, nor
the Weld County Airport overlay district.
12. ) Please send copies of all correspondence with application to A. Bruce
Johnson, 801 8th Street, Suite 220, Greeley, CO 80631. If you need any
further information, I will try to accomodate your request.
13.) The Sketch Plan Map is attached to the application.
14.) When a Recorded Exemption is approved by the Board of County Commissioners,
a plat as described in your Recorded Exemption Procedural Guide will be sub-
mitted to the Department of Planning Services for recording by the Weld County
Clerk and Recorder.
