HomeMy WebLinkAbout850492.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING PROBABLE CAUSE HEARING FOR USE BY SPECIAL REVIEW #598 - VESSELS OIL AND GAS COMPANY WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Planning Services has submitted a request to the Board of County Commissioners that the Board consider scheduling a Show Cause Hearing for Vessels Oil and Gas Company to determine whether they are in compliance with Operation Standards 1 , 4 , 9 and 10 of Use by Special Review #598 , and WHEREAS, the Department of Planning Services has presented certain facts which indicate that Vessels Oil and Gas Company is in violation of certain Operation Standards of said Use by Special Review #598 , and WHEREAS, the property on which the violation is said to be occurring is described as Part of the SE's, Section 28 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board, after hearing testimony from the Department of Planning Services, finds that there is sufficient probable cause to schedule a hearing to show cause as to whether or not Use by Special Review #598 , granted to Vessels Oil and Gas Company, should be revoked for failure to comply with Operation Standards 1 , 4 , 9 and 10 , and WHEREAS, the Board shall hear evidence and testimony from all interested parties at said Show Cause Hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not Use by Special Review #598 , granted to Vessels Oil and Gas Company, should be revoked for failure to comply with the above listed Operation Standards. The property is not as stated on the approved plat map, more facilities are located on the property. -9. The property is to be limited to the plat plan and governed by the stated standards. Any material deviation from the plans and or standards would require the approval of an amendment of the permit. No amendments have been made at this time. 10. The property owner/operator is responsible for complying with all of the standards. Noncompliance with the standards may be reason for revocation of the Use by Special Review permit by the Board of County Commissioners. Not all of the standards are in compliance. December 7, 1983 USR-598:83:52 was approved by the Board of County Commissioners. August 1, 1985 The property was inspected. It was determined that Operation Standards #1, 4, 9, and 10 were not in compliance. October 9, 1985 The Board of County Commissioners determined that there was sufficient probable cause to schedule a Show Cause Public Hearing. October 15, 1985 Notice of the Show Cause Hearing was mailed. October 21, 1985 Notice of the Show Cause Public Hearing was received. October 31, 1985 Notice of the Show Cause Public Hearing was published in the Johnstown Breeze. November 6, 1985 A representative of Vessels Oil and Gas submitted a map showing all facilities and proposed facilities for staff review. A letter outlining the improvements is still needed before staff can review the case. November 7, 1985 The property was reinspected. It was determined that -Operation Standards #1, 9, and 10 are still not in -compliance. Cherry Street Suite 1220 Denver, CO 80222 Re: ZCH-16:85: 16 Dear Sirs: Personnel from the Department of Planning Services conducted an on-site inspection of your property on August 1, 1985 to determine whether you were in compliance with the Operation Standards placed on your property at the time USR-589:83:52 was approved. The inspection revealed several violations of Operation Standards 1, 4, 9, and 10. I have enclosed a summary of the items that appear to be in violation of the foregoing Operation Standards. You are hereby requested to comply with the requirements of the Operation Standards within thirty (30) days from the date of this letter. Mr. Seelinger and myself determined that- there are more facilities located on the property than those shown on the plat map. Also, that the guard posts protecting the storage tanks have not been installed. From the inspection it has been determined that Operation Standards #1, 4, 9, and 10 are not in compliance for the following reasons: Operation Standard #1 - The property is not as stated on the plat map; Operation Standard #4 - All liquid storage vessels are not adequately bermed to contain the contents in the event of a spillage; Operation Standard #9 - The operation has not been limited to the plans and no amendments have been made to the Use by Special Review Case File; Operation Standard #10 - The owner and/or operator of the facility has not complied with the stated Operation Standards.
