RE: APPROVE MEMORANDUM OF AGREEMENT CONCERNING PURCHASE OF WATER
SERVICES BETWEEN WELD COUNTY, COLORADO, AND THE NORTH WELD
COUNTY WATER DISTRICT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of
Agreement between Weld County and the North Weld County Water
District concerning the purchase of water services for the
Severance Grader Shed located in the NWa NE4 of Section 1 ,
Township 6 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, the terms and conditions are as stated in said
Memorandum of Agreement, a copy of which is attached hereto and
incorporated herein by reference , and
WHEREAS, after study and review, the Board deems it advisable
to approve said Memorandum of Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Memorandum of
Agreement between Weld County and the North Weld County Water
District concerning the purchase of water services be, and hereby
is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Memorandum of Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
June, A.D. , 1987.

MEMORANDUM OF AGREEMENT
` THIS AGREEMENT, made and entered into this i7� day of

hereinafter called Second Parties, WITNESZETH:
WHEREAS, First Party is a legally formed water district in
Weld and Larimer Counties, Colorado, and
WHEREAS, Second Parties are desirous of purchasing water taps

NOW, THEREFORE, in consideration of the premises and the
terms of this Agreement, it is mutually agreed as follows:
1 . Second Parties agree to purchase I water tap(s) from

2. Further, in the event Second Parties desire to sell
any of their Big Thompson Project Water or North Poudre Water and

Party the first option to purchase said water, at the then market
price, and to execute all necessary documents in connection there-
with, including documents for the transfer of any such water.
3. Further, Second Parties agree to pay all rates and

4. It is further mutually agreed that this Agreement shall
extend to and be binding upon the heirs, executors, administrators •
and assigns of the parties hereto.
