RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL) TO P.U.D. (PLANNED
UNIT DEVELOPMENT) WITH R-1 (LOW DENSITY RESIDENTIAL) USES FOR
CECIL W. KING
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 16th day of
September, 1987 , at 2 : 00 p.m. for the purpose of hearing the
application of Cecil W. King, 4707 Weld County Road 29 , Fort
Lupton, Colorado 80621 , requesting a Change of Zone from A
(Agricultural) to P.U.D. (Planned Unit Development) with R-1 (Low
Density Residential) uses , for a parcel of land located on the
following described real estate, to-wit:
Part of the SE} SE3 , Section 9 , Township 1
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS , Section 28 . 8 .3 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone , and
WHEREAS, the applicant was represented by Tim Callahan, of
Hawk Consulting, Inc. , and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission, and, having been fully informed, finds that
this request shall be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Cecil W. King for a Change of Zone from A (Agricultural) to P.U.D
(Planned Unit Development) with R-1 (Low Density Residential)
uses, on the above referenced parcel of land be, and hereby is,
granted subject to the following notes being placed on the P.U.D.
District Plat:
1 . Individual well and septic systems shall serve each
individual lot.
2 . The Laramie-Fox Hills Aquifer is approximately 700 to
2 ,000 feet deep. All wells constructed on these lots
shall be drilled to the Laramie-Fox Hills Aquifer and

approved by the Division of Water Resources prior to
issuing a residential building permit.
3 . Minimum lot sizes shall be:
a. Lots 1 and 3 - 8 acres .
b. Lots 2 and 4 - 4 acres.
c . Lote 5 , 6 , 7 , and 8 - 3 acres .
4 . Only one single family residence shall be built on each
lot. All other uses shall be permitted in accordance
with Section 32 . 2 . , the R-1 (Low Density Residential)
District of the Weld County Zoning Ordinance . The
F.U.D. Plan may permit additional livestock per lot in
conjunction with an approved land maintenance plan.
5 . The 20-foot-wide equestrian easement shall run parallel
to and along the entire boundary of the District.
6 . The following information shall be included with the
P.U.D. Plan application:
a. An erosion and sediment control plan approved by
the Platte Valley Soil Conservation District for
each lot.
b. A program for irrigating a part of each lot for a
yard, landscaping, garden, etc.
c. A program for maintaining land on each lot which is
not irrigated. The program shall prevent
overgrazing or other use of the land which could
present a potential dust storm.
d. A program for maintaining the equestrian easement.
7 . Prior to issuing any residential building permit for any
particular lot, the applicant shall demonstrate to the
Department of Planning Services staff that the following
has been accomplished:
a. A well has been drilled to the Larimer-Fox Hills
Aquifer and approved by the Division of Water
Resources.

b. An erosion and sediment control plan, approved by
the Platte Valley Soil Conservation District, is in
place for each lot.
c. A program for irrigating a part of each lot for a
yard, landscaping, garden, etc.
d. A program for maintaining land on each lot which is
not irrigated is in place . The program shall
prevent overgrazing or other use of the land which
could present a potential dust storm.
e . A program for maintaining the equestrian easement
for the entire P.U.D. shall be in place.
8 . The applicant shall submit, and have approved by the
Board of County Commissioners , a dust abatement program
for Weld County Roads 10 and 31 . The plan shall be
submitted as part of the F.U.D. Plan application, and
shall include an off-site road improvements and
maintenance agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
September, A.D. , 1987 .

The following business was transacted:
I hereby certify that pursuant to a notice dated March 23, 1987, and
duly published April 2, 1987, in the Johnstown Breeze, a public hearing
was conducted to consider the request of Cecil W. King for a Change of
Zone from A (Agricultural) to P.U.D. (Planned Unit Development) with
R-1 (Low Density Residential) uses. Bruce T. Barker, Assistant County
Attorney, made this matter of record, stating that this hearing had
been continued. Rod Allison, Planning Department representative,
reviewed the reasons for the continuation of the hearing. (Let the
record reflect that Lee Morrison, Assistant County Attorney, replaced
Mr. Barker at this time.) Mr. Allison stated that the Division of
Water Resources has stated that a deep well will be available for each
lot for in-house use and limited irrigation and domestic animal use.
He said that some type of land management program will be needed on the
portion of each lot which cannot be irrigated. Tim Callahan, of Hawk
Consultants, Inc. , came forward to represent the applicant.
Considerable discussion was held concerning the notes the Planning
Department recommended be placed on the plat if this request is
approved. (Tape Change #87-96) A short recess was called to allow the
applicant to review these notes and for Mr. Morrison to recommend new
wording for Note #7. After further discussion, it was the consensus of
the Board that the requirement to provide a water station be deleted.
More discussion was held concerning the upgrading of roads bordering
this P.U.D. Mr. Allison read into the record a proposed condition
regarding road dust abatement. No public comment was made concerning
this request. After further discussion, Commissioner Kirby moved to
approve the request of Cecil W. King for a Change of Zone from A
(Agricultural) to P.U.D. (Planned Unit Development) with R-1 (low
density residential) uses, subject to eight notes being placed on the
plat. Commissioner Yamaguchi seconded the motion and it carried
unanimously.

Dear Mr. Bingle:
We have received a revised water supply report by Judith Hamilton for the
above referenced 8-lot subdivision on -40 acres. The information in this
report is similar to that presented in a July 1, 1986 report prepared by
Ms. Hamilton. The only change is a more definite proposal for water use nn
each of the tracts. Ms. Hamilton proposes that the larger parcels, 1 and 3,
be allowed 2.63 acre-feet appropriation and one acre of irrigation and that
the remaining parcels be allowed 0.86 acre-feet appropriation and 10,000
square feet of irrigation. The report would allow for watering of domestic
animals. We do not _object to the above referenced changes. Our July 14, 1987
letter is still applicable except as modified by this letter. The limitations
in the letters should be reflected in plat notes.

Dear Mr. Allison:
We have received your letter of June 16, 1987 concerning the above
referenced project. We previously commented in general terms concerning this
project on January 22, 1987. You now request that we make a detailed review
of this proposal at this time since the Weld County Land Use Regulations do
not include a preliminary plan stage for this type of proposal . We have
attempted to review this proposal even though we do not know the precise lot
sizes of -the proposed eight lots.
Water resources for the project are discussed in a July, 1986 report by
Ms. Judith Hamilton as our earlier letter for the property indicates.
Ms. Hamilton' s report addresses the physical and legal availability of water
in the Denver basin aquifers. A December 29, 1986 letter by Hawk Consulting
states that water for the subdivision will be obtained from individual wells
in the Laramie-Fox Hills aquifer. We assume that the wells are proposed under
the conditions stated in Ms. Hamilton' s letter although this is not confirmed
in the information provided to us.
Ms. Hamilton estimates the top and base of the Laramie-Fox Hills aquifer
-to be -at an approximate depth of -660-975 feet. Our estimate to the top and
base of the aquifer is slightly higher. We stress final well depth
requirements will be finally determined at the time of the well permit
application.
Ms. Hamilton further indicates that approximately 175 feet of saturated
sandstone/siltstone exist at the site. She states that this would allow
approximately 10.4 acre-feet of annual appropriation under the whole
property. She does not indicate whether any existing appropriations of this
water exist which would reduce the quantity of water available or whether a
Water District has claimed this water. It does not appear that Either
situation axists.

Using Ms. Hamilton' s 175-foot saturated thickness estimate, 0.26
acre-feet per acre should be available annually under the subdivision. This
would allow a 1 .04 acre-foot appropriation under a 4-acre lot, the approximate
average lot size if the property is split into equal size lots. Using
Ms. Hamilton' s demand figures, this quantity of water is sufficient for 13,000
square feet of lawn and garden irrigation, use inside one home, and the water-
ing of three or four domestic animals on each lot. (In reference to your
conversation with a member of my staff, we do not have the expertise to
comment concerning the number of non-irrigated acres required to support a
large domestic animal ) .
Our office can issue well permits for individual lots in the Laramie-Fox
Hills aquifer subject to the conditions in the previous paragraph. Grouted
plain casing will be required to the top of the Laramie-Fox Hills aquifer.
Wells should be constructed to the base of the aquifer to help assure a
long-term supply will be available.
The quantity of irrigation allowed will be adjusted based upon lot size
since lot size determines the quantity of water available for appropriation to
a particular lot. We would not recommend the approval of any lots less than
1 .2 acres in size as lots less than this size do not even have sufficient
water available for in-house use.
In conclusion, we would not object to the subdivision if the conditions
in this letter are acceptable to the applicant. Covenants and plat notes
should reflect the information in this letter. Further, potential lot pur-
chasers should be informed of the well depth and other information contained
in this letter.

This report covers water supply plan, water requirelMtkalmantoCommgo
water resource evaluation for the Peak View Estates Subdivision,
comprising 39 . 5 acres in the SEµSE ,, Section 9, T1N , R66W, Weld
County, Colorado.
Water Supply Plan
Water supply will be from 8 individual wells in the Laramie-
Fox Hills aquifer, each well serving one lot. Wells will
supply water for in-house use , miscellaneous outside uses ,
and irrigation of not more than 10 ,000 square feet of land for
all lots except 1 and 3 , where 1 acre of irrigated area per
lot will be permitted.
Water Requirements
Estimated water requirements for in-house use are .30 acre-
feet per year per lot, for miscellaneous outside uses .03
acre-feet per year per lot, and for irrigation 2.3 acre-feet
per acre , or . 53 acre-feet per year per lot for 10,000 square
feet of irrigated area and 2.3 acre-feet per year for 1 acre
of irrigated area. This totals 5.26 acre-feet per year for
Parcels 1 _and 3 and 5.16 acre-feet per year for Parcels 2 and
4 through 8 , or 10.42 for the entire subdivision. In actuality,
water use will probably be considerably less because many lot
owners will not wish to irrigate the entire allowed area.
Water Resource Evaluation
The Laramie-Fox Hills aquifer consists of a thick series of
sandstones with some siltstones and interlayered shales . It
is widely used as a water supply in the general area. Maps
prepared by the State Engineer' s Office for SB 5 rules and
regulations show a sandstone/siltstone thickness in the L-FH
aquifer at the site of about 175 feet. While my analysis of
the electric logs for the wells used in that study for this
area (Gabel , SWtNE4 Section 8 and Moser SA-,NEI Section 10)
shows greater saturated thickness , my analysis of the Schmidt
G.U. No. 1 hole in the NE4SW4SW+ of Section 8 indicates a
saturated thickness of 170' . The 175' shown by the State .
Engineer' s Office therefore appears to be reasonable to use
in this area. Using 15% specific yield, water available ann-
ually to the 39. 5 acres is 10.4 acre-feet. This is adequate
to supply the subdivision with the proposed water supply plan.
Wells in the Laramie-Fox Hills aquifer will be approximately
850 feet deep. The top of the aquifer is at a depth of about
650 feet, and wells should be sealed to that depth to prevent
inflow of water from other aquifers. Well yields from indivi-
dual wells will be more than adequate to supply the allowable
water.

The Laramie-Fox Hills is considered by the State Engineer' s
Office to be non-tributary in this area. Non-tributary aqui-
fers are required to supply 2% return to the stream system.
Estimated consumptive use is 10% for in-house use and 85%
for irrigation and miscellaneous outside uses . Therefore
return flows from seepage and infiltration will be more than
sufficient to supply the required replacement water.

LEGAL DESCRIPTION: Part of the SEy SE} of Section 9, T1N, R66W of the
6th P.M. , Weld County, Colorado
LOCATION: North of Weld County Road 10 and west of Weld County
Road 31
APPEARANCE:
Tim Callahan, Hawk Consulting, Incorporated, represented the applicant.
This is a 40 acre parcel of land at the intersection of Weld County Road 10
and 31. Mr. King wants to make a subdivision of eight lots ranging in size
from three and one-half acres to eight acres. There will be no internal
roads because all property will access onto Weld County Roads. They want
this to be a residential subdivision and there appears to be a need for this
type of subdivision. This application was initiated by Roland Froid. He
has since changed employment and he asked Hawk Consulting to compelte the
project. There will not be any open space, but there will be an equestrian
easement around the perimeter of the property. With lots this large it does
not appear there would be a need for common open-space.

The Planning Commission asked why this request is being presented as a
Planned Unit Development rather than a R-1 subdivision.
Keith Schuett explained that an R-1 subdivision would require public water
and public sewer. Each lot in this proposed subdivision would be serviced
by an individual well and septic system. On January 22, 1987, a letter was
received from the State Engineer, Division of Water Resources, stating a
water supply is available, but that they will need to review this request
further at the time of the final plat.
The Chairman called for discussion from the members of the audience.

Cecil King, property owner, reported he is a part owner of this property,
and they want to divide this property because of their age. This is
irrigated land, but they are on the end of the ditch and their supply of
water is not good. Because of water being sold to area municipalities,
there will probably be no water to irrigate the land this coming year.
Residential housing is not as hard on the County roads as the oil trucks,
and there are many of these using the roads.
The Chairman asked Keith Schuett to read the recommendation of the
Department of Planning Services staff into the record. The staff's
recommendation is for denial.
Tim Callahan stated the County feels this proposal is within the Fort Lupton
Comprehensive Plan area. Fort Lupton says they have no concerns regarding
this request because this is not in their master plan. He is not sure where
the County Engireer is at regarding his recommendation concerning the roads
because he was not specific as to whether they are too small in size or
whether the existing surface is inadequate. They have to wait until the
final plan to know the State's decision concerning water for livestock and
pets, etc. , before they can begin to define the covenants and other
standards for the subdivision.
Keith Schuett reported the entire area is zoned agricultural. While there
are some residences, the area is rural in nature.
MOTION:
Lynn Brown moved Case Number Z-432:87: 1 for Cecil W. King for a change of
zone from A (Agricultural) to P.U.D. , (R-1 low density residential) be
forwarded to the Board of County Commissioners with the Planning
Commission's recommendations for denial based upon the recommendations of
the Department of Planning Services staff and the testimony heard by the
members of the Planning Commission. Also, that all reasons stated during
the discussion be reiterated. Motion seconded by Paulette Weaver.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Lydia Dunbar — yes; Lynn Brown — Yes, she
would like to echo the things Jack Holman as pointed out. This request is
not consistent with the Comprehensive Plan. We are looking at problems with
water capacity, road capacity, and ultimately sewerage or septic capacity.
There is a real problem with expectations. It is fine to say people want to
live in the country, but once they get there they want the roads, the fire,
the police, and the other services and the County is not in a position to

provide these services. LeAnn Reid — yes.;. Louis Rademacher — yes; Paulette
Weaver — Yes. We can understand the concerns of the Kings' in wanting to
subdivide this property, but our responsibility is to the County as a whole
and for what is in the best interests of the County. It is very difficult
for us to say that this proposal is in the best interest of the County as a
whole. Ann Garrison — yes; Jack Holman — Yes, however, his major concern
is the water and the sewer. We have run into problems in this part of the
County in allowing other developments that are agricultural/residential
subdivisions. The greatest problem has been the quality of the water. Some
of the subdivisions in this area are going to have to seek another source of
water beside the well water they are using because of the poor quality of
the water. With our new comprehensive . plan (and he hopes the County has
learned a lesson) , we don't really want to allow' any type of development
without having some kind of public sewage treatment facility. By allowing a
small area, such as this, to get started others in the neighborhood with
like property want to do the same thing, and pretty soon we have sections
and sections of land that has a house on three or four acres. This just
isn't really feasible in the country, mainly because the County cannot
provide the facilities. In established isolated areas, the County gets many
complaints because of road maintenance, law enforcement, etc. The
Comprehensive Plan maintains that any residential development should be
located next to an existing municipality, and this request does not fit into
this category at all. Motion carried unanimously.

The application materials are not in compliance with the standards and
conditions of Section 28.3.1. 1 of the Weld County Zoning Ordinance.
1. Section 28.3.1. 1.1 requires the applicant to demonstrate that the
proposal is consistent with the Weld County Comprehensive Plan.
The proposal is not consistent with the Weld County Comprehensive
Plan.
The Comprehensive Plan's Urban Growth Policy #1 states
in part that: Land—Use development proposals within an
urban growth boundary area shall be encouraged so long
as they conform to the desires of the municipality as
expressed in its Comprehensive Plan and if the
municipality has agreed to provide services.
A representative of the City of Fort Lupton indicated in
letters dated April 22, 1986, and June 11, 1986 that
this proposal is outside the City of Fort Lupton's
Service Area, and cannot receive city services or
utilities.
2. The Comprehensive Plan's Urban Growth Policy #2, states in part:
"The County may consider approving a proposal for Urban
Development with Urban Growth Boundary Areas if all of the
following criteria are met."
"The County finds, in its review of the Land—Use
Application materials, that the public facility and
service impacts created by the development or proposed
zoned district are compatible with the Comprehensive
Plan transportation, and public facility and service
goals and policies."

- This proposal is not compatible with the Comprehensive
Plan's Transportation Goals and Policies because the
County roads providing access to the property are not
adequate in size to meet the requirements of the
proposed zone district. Weld County Road 10 and Weld
County Road 31 would provide access to the proposed
rural residential planned unit development.
- In a memorandum dated April 15, 1986, and January 22,
1987, the Weld County Engineering Department indicates
that Weld County Roads 10 and 31 will not support the
traffic impacts that will be generated by the proposed
residential Planned Unit Development District. In
addition, there are no plans by the County to improve
Weld County Roads 10 and 31 so that these local county
roads can support and maintain residential uses in the
future.
- Once it has been determined that the road facilities
providing access to the property are inadequate, the
applicant has two options. First, the applicant can
either wait to secure the proposed rezoning until the
road improvements are made by the appropriate unit of
government; or the applicant can express a willingness
to upgrade the road facilities at his own expense in
order to expedite the change of zone approval. To date,
there has been no indication on the part of the
applicant to upgrade the road facilities providing
access to the proposed site.
3. The applicant has failed to demonstrate that the uses which would
be allowed in the proposed Planned Unit Development District shall
be consistent with the performance standards of the Planned Unit
Development District contained in Section 35.3 of the Weld County
Zoning Ordinance.
- The applicants are proposing to create an eight (8) lot
residential Planned Unit Development. The size of the
parcels vary from 3.0 to 8.6 acres. The application
materials indicate that wells are proposed for each lot.
The application materials do not clearly indicate if the
wells are going to be used for "in-house use only" or if
there are plans to irrigate each lot or a portion of
each lot.

Because of the density of the land-uses proposed with
the Planned Unit Development District, the applicants
must provide information describing how the pasture land
of each proposed parcel will be used and maintained.
The concerns are related to designing the uses within
the Planned Unit Development District so that they
demonstrate compatibility according to required
performance standards. Information outlining the
carrying capacity of each lot for a maximum number of
livestock and household pets; the type of erosion and
sediment control measures to be employed on each lot,
and the type and amount of vegetation to be maintained
on each lot are basic to determining the compatibility
of uses within the Planned Unit Development District.

NOTICE OF PUBLIC HEARING
The -Weld County -Planning Commission will conduct a public hearing -on
February 17, 1-987, at 1:30 p.m. to review a request for approval of a Change
of Zone Application from A (Agricultural) to P.U.D. (Planned Unit
Development) R-1 (Low Density Residential) from Cecil W. Ting the parcel of
land is -described as part of the S£} SE} of Section 9, -21N, R6-W of the 6th
P.-M. , Weld County, Colorado, containing 37.2 acres, more or less. The
property is located approximately north of Wald County Road 10 and west of
Weld County Road 31.
The public hearing to be held ty the Weld County Planning Commission for the
consideration of the above referenced request will be conducted in the Weld
County Commissioners' Hearing Room, -First Floor, Weld County Septennial
Lenter, 915 Tenth Street, Greeley, Colorado. Comments or objections -related

Dear Mr. Schuett:
We have reviewed the above referenced proposal to rezone 37.2 acres from
agricultural to P.U.D. Proposed aevelopment of the property may include eight
rural residential lots. Water resources for the property are discussed in a
July, 1986 report by Ms. Judith Hamilton. It appears from the information in
this report that a water supply would be -available for a rural residential
subdivision of the type anticipated. However, we cannot comment specifically
on a water supply plan until the preliminary plan stage. Cur review will be
based on the most up-to-date information available and statutes in effect at
that time. We ask that a more specific water 'supply plan be _provided at -the
preliminary plan stage. -

This past year the Tort Lupton Fire Protection District was tested
by IJJ in the City of Tort Lupton, as wall as the Rural area within
our boundaries of the fire district. :pie ware asking Ior decrease
in bur insurance rates. The recomendations from I30 for our Rural
areas was to have adequate water fill stations for our pumper
trucks , From wells located in the County,
If such a water station could be availble -to us we could perhaps
give batter Fire _Protection with a lower insurance rate .

Dear sir,
Please find enclosed all information necessary to the submittal of the Peaks View
Estates, P.U.D. rezoning plat. The owner and operator of this property (Cecil King)
has farmed this ground as well as adjacent ground all of his life. His reasons for
requesting a zone change are as follows:
1. Cecil has seen little or no profit (sometimes a loss) from the various crops
which have been raised on this property in recent years.
2. Because of the ages of the three owners, retirement is of great concern. •
Approval of this application would allow the owners to provide for their future '
welfare.
3. As can be seen on the attached ownership map, there are six properties on the
forty acre parcel west of this property. Other properties in the immediate area have
been divided from larger parcels of land.
In 4ccordance with Section 4.1.10 of the Weld County Zoning Ordinance, we believe this
proposal encourages the most appropriate use of this land and is consistent with the
changing conditions in the area. Currently there are a very limited number of vacant
rural country properties to select from in southern Weld County for those people who
wish to fulfill their dream of a home in the country. They desire a location with
accessibility and visibility. The approval of Peak View Esates, P.U.D. would allow
people accessibility to city amenities, such as Fort Lupton schools, churches, etc.
Water servicing the subject acreages, as indicated in the geologist's report, would be
from wells to the Laramie-Fox aquifer. As per the report, there is adequate water from
this aquifer for the 8 domestic wells. The geologist also indicates in the report that
the permeability of the soil is moderate to rapid and properly constructed septic
systems and leaching fields, as per Weld County Health Department regulations, would
function adequately.

A geologist and ground-water engineering consultant has researched the project and
subject property. You will find a report attached from Judith L. Hamilton, the
consulting geologist and engineer. The report indicates that all soils except one have
good potential for urban development. The lone exception is Loup-Boel, which has
severe limitations for leaching fields due to wetness. This soil lies in the extreme
southwest portion of this property, where the natural runoff collects in an existing
detention pond. A house or septic system built on this lot would by necessity be
constructed above the elevation of this type of soil and pond. The report also
indicates the soils have only slight restrictions for home building sites, and that
satisfactory results can be accomplished by the use of prudent construction
techniques. Proper backfill and water downspout extensions would further limit the
chances of water problems. The potential for settlement is limited as soils are sandy
rather than silty.
Drew Scheltinger of the Weld County Engineering Department has stated by phone that no
upgrading of Weld County Roads #10 & #31 would be required due to the economic
unfeasability of asphalting two miles of road. It is the Engineering Department's
contention that the existing county roads are not compatible to serving eight more
lots. We believe that these roads are maintained efficiently by the County Road
Department and that travel on gravel roads is compatible with rural living.
The City of Fort Lupton has indicated, as per attached letter, that the Peak View
Estates project is not in an area within future growth plans, including servicing of
water and sewer. They also show no objection to the Peak View Estates, P.U.D. project.
The information provided has been compiled by our firm and hopefully no required
information has been overlooked. If further information is required, please let me
know.

This report covers suitability of the property for development, storm: drainage,
and water requirements and availability for the 39-3 acre property in the SE≤SEa
Section 9, T1N, 7t66W, Weld County, Colorado.
Suitability for development
The Soil Survey of Weld County, Colorado, Southern Part, (US iJept. Agriculture,
Soil Conservation Service, 1-980) indicates that all soils except the Loup-Boel
have good potential for urban development. She Loup-Boel soils have severe limi-
tations for leaching fields due to wetness, but all other soils are reported to
have only slight limitations. Permeability in all soils is moderate (Olney) ,
moderately rapid (Vona) , or rapid (Loup-Boel) , and properly constructed leaching
fields should function adequately. Except for the Louo-Boel soils, which have a
wetness and flooding hazard, the soils have generally only slight restrictions
for residential building site development. -The main restriction is a moderate
one for local streets and roads, due to the low strength of the soils. However
since the roads will serve only two to four lots each, and are not through roads,
there will be very limited traffic and the low strength would not be a limiting
factor.
Soils are described by the SCS as Olneyloamy sand 1-3% slopes in the eastern
third of the property, Vona loam sand 0-3% slopes in the western two-thirds,
Vona loam sand 3-5% slopes in the northwest corner, and Loup-Boel soils near
the southwest corner (see Figure 1).
Hart (Potentially Swelling Soils and Rock in the Front Range Urban Corridor,
Colorado, by Stephen S. Hart, 1974, Colorado Geological Survey Environmental
Geology No. 7) -maps the property as windblown sand or silt, generally with low
swell potential, but with the upper 6-12" locally possibly having moderate swell
potential. Although he statc_s that windblown material may be subject to severe
settlement or hydrocempaction upon caburation, it 3s my opinion that because

these soils are sandy rather than silty, the potential for settlement is limited.
Storm Drainage
-Because of the small number of lots and the small land area which will be covered
or surfaced after development, storm runoff for the property is not expected to be
significantly different after development from present conditions. Extensions of
downspouts should be required to drain water wll away from tuildings. Borrow
ditches should be constructed for all roads built on the property to provide drainage
and storage from storm runoff.
-toads constructed on the property will service at most 4 lots and will probably
be gravel-surfaced,which will aid percolation. Drainage ditches should be provided
along County roads adjacent to the property on the property side, and culverts
should be constructed to transport water in these ditches under roads constructed
on the property. A small detention pond should be constructed near the southwest
corner of the property in the Loup-Boel soil area to provide temporary storage of
•
water from the drainage ditches during times of heavy precipitation. The Loup-
Boel soil is poorly drained and has limitations on building construction due to
wetness, and this is a good location fora detention pond.
Water Requirements
-Annual water requirements are estimated at .3 acre-feet per lot for in-house use
and .05 acre-feet per 1000 square feet for irrigation at an application xate of
2.3 acre-feet per acre. Total water requirement for in-house use for the 8 lots
would be 2.4 acre-feet per year; irrigation water requirement will depend on total
area irrigated.
Wells in the Area
The State Engineer's Office printout of wells shows only one well in the SE;SEa of
Section 9, Permit 486458, located 50' from the south line and 1300' from the east
line of the Section, or near the southwest corner of the property. The well is

42' deep with a water le.e1 of 10' and a yield of 12 gai,ons per minute. There
are a total of 11 recorded wells in the Section, with 4 wells being in the upper
Arapahoe ( 25-42' deep) , 1 well in the Arapahoe 1185' deep) , and 6 wells in the
Laramie-Fox Hills (756-820' deep). All uses are domestic, household, or stock.
There are 7 wells in Section 16, all in the Laramie-Fox Hills, and there are 26
wells in Section 17. Twenty-two of the Section 17 wells are in the upper Arapahoe
( 28-69' deep) , 3 in the Laramie-Fox Hills, and one has no data.
Based on the available data, it appears that there are few, if any, wells in the
lower Arapahoe in this area. Whether this is because there is little water in the
lower Arapahoe, or because it was not utilized, it not known at present. Before
definite plans are made to use the lower Arapahoe for water supply, it is highly
recommended that at least two test wells be drilled into the lower Arapahoe. Since
there is adequate water for the proposed development in the Laramie-Fox Hills
without adversely affecting existing wells, the presence or absence of water in
the lower Arapahoe will not affect the viability of the development, but it would
affect the cost of drilling wells.
Ground water availability
Ground water is available to serve the property from two aquifers: the lower
Arapahoe, which extends to a depth of about 225 to 280 feet, and the Laramie-Fox
Hills, which has a top of about 660' depth in the vicinity, and a base, including
the transition zone, of about 975'.
Lower Arapahoe- The lower Arapahoe is considered not non-tributary in this area
and its use would require an augmentation plan approved by the water court. Four
percent of the water pumped would have to be returned to the stream system. Since
individual leaching fields are proposed, considerably more than this amount will
be returned through seepage.
Based on a 100-year life of the aquifer, and using the 50' sandstone/siltstone
thichness for the lower Arapahoe as shown on the SB 5 maps, a specific yield of
17% would provide 3.36 acre-feet per year for the 39,5 acres. .'IJhis could supply

in-house use and irrigation of about 2270 square feet per lot for 8 lots, or in-
house use and irrigation of about 4920 square feet per lot for 6 lots. However,
there is a discrepancy on the SB 5 maps for the Arapahoe aquifer in this area;
the maps show about 75 ' total sandstone /siltstone thickness for the entire Arap-
ahoe, but do not show any upper Arapahoe present on the property. With 75 ' sand-
stone/siltstone thickness, water for in-house use and irrigation of about 7000
square feet per lot for the 8 lots could be supplied.
As noted above, there is little use of the lower Arapahoe in the area. The above
analysis is based on legal availability and the physical availability of water
should be checked before plans are made for its use.
Laramie-Fox Hills aquifer - The SB 5 maps indicate the sandstone/siltstone thick-
ness of the L-FH aquifer at the site to be about 175'. Using 15% specific yield,
approximately 10.4 acre-feet of water would be available to the 39.5 acres. This
would provide in-house use and irrigation of about 18,940 square feet per lot for
each of the 8 lots, or irrigation of about 2 acres per lots if 2 lots are supplied
from the Laramic-Fox Hills.
The SEO summary, which was used in developing the maps for SB 5 rules and regula-
tions lists the Gabel well in the SANE' of Section 8 at elevation of the top of
the L-FH of 4366' (depth 575' ) and of the base 4081' (depth 860 ) , with a saturated
thickness of 165 '. For the Moser log in the SWINEq of Section 10, the list shows
a top elevation of 4336' (depth 450' ) , with a saturated thickness of 180'. In the
Gabel well, the top is approximately where my pick would be; however, I calcuiate
a saturated thickness of 176' . Using the State's pick for the the of the L-FH in
the Moser well, Ica culate a saturated thickness of 219'; however, I would also
include a thick sand beginning at a depth of 710' , which would add another 28'
of sandstone. I also analysed the electric log for the William E. Schmidt G.U. No. 1
1 hole in the NEaSW1SWl of Section 8, picking the top of the L-FH at elevation 4367'
(depth 562' ) and the base at 4149' (depth 780' ). with a saturated thickness of 170' •

The 175' shown on the SB 5 map far this area therefore appears to be reason-
able to use.
The log for well 18620F, in the NW`tiNW1/4 of Section 9, is on Tile at the SEO.
This shows a coal at the top of the L-FH at an elevation of 4330' , with the
top of the 1,-FH at a depth of 636' and the bottom of the hole at 84$' .
Geologic hazards
There are no known geologic hazards on the property.
Mineral resources
Schwochow et al (Atlas of Sand, Gravel and Quarry Aggregate Resources of the
Colorado Front Range Counties, 1974, Colorado Geological Survey Sp. -Publ. 5-B)
shows only a very small area of probable aggregate resources in upland depo-
sits on the northern boundary of the property. In my opinion, this is too
small an area to be economically mined.
Coal is present in the Laramie formation; however, it is at a depth too great
for surface mining. As mentioned above, the log for well 18620F shows coal
at an elevation of 4330' , or a depth of about 650' to 700' . It is possible
that some coal layers exist above this depth. In any case, the coal is un-
likely to be above a depth of 400' . Because of the depth and the thinness of
the beds, it is very unlikely that the coal could be economically mined.
