RESOLUTION RE: APPROVE PLOWING PERMIT NO. 88-1 , WHICH AMENDS PERMIT NO. 83-5 , AND COLLATERAL AND AUTHORIZE CHAIRMAN TO SIGN - PAUL HNIZDIL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 23 , 1988 , the Board found that Paul Hnizdil has substantially deviated from the terms and conditions of Plowing Permit No. 83-5 , specifically that an area of approximately 34 acres not included within said permit was plowed, and WHEREAS, on that date, the Board determined that Mr. Hnizdil was to submit an amended Plowing Permit pursuant to Ordinance No. 108-A, and WHEREAS , Mr. Hnizdil did submit an amended Plowing Permit and on October 31 , 1988 , the Board considered Plowing Permit No. 88-1 , which amends Plowing Permit No. 83-5 , and WHEREAS, pursuant to Ordinance No. 108-A, Mr. Hnizdil has submitted proof of collateral in the form of a Letter of Credit in the total amount of $4 , 410 . 00 , and WHEREAS , Mr. Hnizdil also submitted the required permit fee in the total amount of $244 .70 , and WHEREAS, after finding said documents in order, the Board deems it appropriate to approve Plowing Permit No. 88-1 , which amends Plowing Permit No. 83-5 . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Plowing Permit No. 88-1 , which amends Plowing Permit No. 83-5 be, and hereby is, approved for Paul Hnizdil for those grasslands described in the approved Soil Conservation Plan, a copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED by the Board that the collateral , in the amount of $4 ,410 .00 , be, and hereby is, accepted.
