ANDERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended , did determine at a public meeting held in the Chambers of the Board , that a certain parcel of land, to be divided into two parcels , as shown on the plat known as Recorded Exemption No. 1162 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1162 was submitted by Clarence V. and Elizabeth E. Anderson for property which is described as Lot A of RE-227 , located in part of the S}SW} , Section 14 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded , and WHEREAS, this request is to divide the property into parcels estimated to be approximately 13 acres and 4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be , and hereby is , exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1 . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations . Anderson. The parcel of land on which this request is being made is described as Lot A of Recorded Exemption 227, located in part of the south half of the southwest quarter of Section 14, T6N, R66W of the 6th P.14. , Weld County, Colorado. The property is located approximately 1 .25 miles north of the City of Greeley, north of Highway 392 and east of Weld County Road 23. This request is to divide a 16.73 acre tract of land, which is the total contiguous land holdings of the applicants, into two lots of 13.00 acres and 3.73 acres, more or less. Water service is proposed to be provided from North Weld County Water District. The applicant has proposed a septic system for the sewage disposal system on the proposed new home. The staff has concerns whether the applicant has demonstrated compliance with the Weld County Comprehensive Plan's Urban Growth Boundary Goals and Policies, which state that land-use proposals within the urban growth boundary will be encouraged if they conform to the desires of the municipality. In a referral response dated April 10, a representat-ve of the City of Greeley Planning Department stated that its policies require an overall gross density of not more than one dwelling per 20 acres in this area. The applicant has failed to show in the submitted application materials how this request is consistent with the Weld County Comprehensive Plan and efficient and orderly development. The guidelines used to allow a division of an agricultural lot into two separate parcels are outlined in Agricultural Policy #7 of the Weld County Comprehensive Plan. The intent of this policy is to: A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm improvements. s9t 361 Board of County Commissioners April 19, 1989 Page 2 B. Enable the property owner to sell off agricultural land that is nonproductive for one single family dwelling homesite. C. Enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the farm. It is the opinion of the Department of Planning Services' staff that the recorded exemption process should not be used to make a property more attractive to a purchaser or to expedite a sale. The staff recommends that the Board of County Commissioners consider this request and determine if the standards of Section 9-2 E. RECORD OF PROCEEDINGS PLANNING COMMISSION PAGE 3 SEPTEMBER 10, 1905 The Gree:Ley Planning Commission has continued to review these recorded exemptions. Mr. H111 indicated that the purpose of the City's review is twofold. The first purpose is to keep the Planning Commission up to date as far as the nature of subdivisions and number of subdivisions in the area surrounding the City. The second purpose of the City's review is to provide comment to the County as to how these proposals fit within the City's long range Comprehensive Plan. Under the current procedure, the Greeley Planning Commission provides a more formal and detailed review than the County on recorded exemptions. Mr. Hill noted that both of the objectives may still be met without the City of Greeley Planning Commission's formal review and comment in each and every request. He explained' that the Planning staff is recommending that the following modifications be made in respect to the City of Greeley's review of Weld County Referrals on recorded exemptions: 1. The City Planning staff review each recorded exemption referred to the City to insure compliance with pre-adopted standards. These standards should include: (a) Appropriate right-of-way be dedicated; (b) The overall gross density on any subdivision not exceed one dwelling unit per 20 acres within the area outside of the 2010 Growth Ring, and not exceed one dwelling unit per 10 acres within the 2010 Growth Ring; and (c) The appropriate setbacks under the applicable zone would be maintained with the subdivision. 2. If desired, under staff report for the Planning Commission, staff can provide a regular update on the location and nature of recorded exemptions referred by Weld County. Mr. Hill noted that as part of this policy, it is assumed that if there are any unique circumstances uncovered with the Planning staff's review or if there are any requests that do not appear to staff to be in compliance with the Comprehensive Plan, such cases would automatically be forwarded to the City Planning Commission for their review and comment. General discussion followed. Commissioner Norton made a motion to authorize staff to prepare a resolution for formal adoption by the Planning Commission setting forth a new policy for consideration of Weld County recorded exemptions as outlined. Commissioner Lockhart seconded the motion. Vote was taken and the motion carried unanimously. C) Discussion of Landscape Requirements Steve Hilt indicated that in response to the Planning Commission's discussion on August 27, 1985, with regard to landscaping, the staff has compiled information from various front range cities regarding their landscaping requirements. From this information, staff has compiled several suggestions for both immediate and longer range revisions to the existing requirements. Mr. Hill then reviewed the suggested revisions which include maintenance of landscaping, acceptable landscape materials, revision of the interpretation of what is permitted within required yards, and treatment of community entryways and commercial corridors.
