RE: APPROVAL OF AMENDMENT OF USE BY SPECIAL REVIEW TO INCLUDE
HORSE BOARDING - CHRIS AND TERRANCE AMMON AND JOHN S.
MARTINEZ
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 30th day of April, 1986 , at the hour of 2: 00 p.m.
in the Chambers of the Board for the purpose of hearing the
application of Chris and Terrance Ammon and John S. Martinez , 3375
Union Street, Wheatridge, Colorado 80033 , to amend a Use by
Special Review to include horse boarding on the following
described real estate, to-wit:
Part of the NW4, Section 21 , Township 1 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and , having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan. The Comprehensive
Plan encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local
economy or environment.

b. The proposed use is an agricultural activity which
is consistent with the intent of the agricultural
district.
c. The uses permitted will be compatible with the
existing surrounding land uses and with future
development of the surrounding areas as permitted
by the Agricultural Zone District.
d. The Tri-Area Planning Commission has reviewed this
proposal and is recommending conditional approval.
e. No overlay districts affect the site.
f. The Use by Special Review Development Standards
will provide adequate protection of the health,
safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application to
amend a Use by Special Review to include horse boarding on the
hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1 . The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2. No additional building or electrical permits shall be
issued on the property until the Use by Special Review
plat has been delivered to the Department of Planning
Services Office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.
3 . The applicant/operator shall submit a revised mylar plat
to the Department of Planning Services to show all uses
and buildings proposed on the site.
4 . Prior to beginning construction of the livestock show
and sale facility, or issuance of any building or
electrical permits , a final soils engineering report
shall be completed for building foundations and
subsurface drainage as recommended by the applicant' s
engineer. A copy of the report shall be submitted to
the Department of Planning Services.
5 . The applicant shall provide the Department of Planning
Services with a copy of an application for
reclassification of the well permit to commercial use.

Amended USR-648: 86 : 14
1. The Use by Special Review permit is for an amendment to
USR-648 a Use by Special Review permit for a livestock show
and sale facility to include horse boarding as submitted in
the application materials on file in the Department of
Planning Services and subject to the Development Standards
stated herein.
2. Prior to beginning construction of the livestock show and
sale facility, subsurface drainage and building foundations
shall be installed in accordance with a final soils
engineering report.
3 . An engineer-designed sewage disposal system approved by the
Weld County Health Department shall be installed for the
livestock show and sale facility.
4. Prior to beginning construction of the livestock show and
sale facility, the applicant shall submit, and have approved,
and construct an erosion control and surface draininge plan
in accordance to the West Adams Soil Conservation District
recommendation. A copy of the approved plan shall be
submitted to the Department of Planning Services.
5. All parking associated with the Use by Special Review area
shall be on-site in the designated parking areas as shown on
the Use by Special Review plat.
6 . The access from Weld County Road 8 should be a minimum of
twenty-four feet (24' ) wide with a fifteen foot (15' ) corner
radii. A fifteen inch (15") minimum diameter culvert shall
be installed in this access of adequate length to support the
required width.
7. All construction done on the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
8 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24. 5 of the
Weld County Zoning Ordinance.

9 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24. 6 of the
Weld County Zoning Ordinance.
10 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
11 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
12 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Permit by the Board of County
Commissioners .
13. Animal waste shall be removed from the Use by Special Review
site every two weeks.

A public hearing was conducted on April 30, 1986, at 2:00 P.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 9, 1986, and
duly published April 17, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider the request of Chris and Terrance
Ammon and John S. Martinez to amend a Use by Special Review to include
horse boarding. Lee Morrison, Assistant County Attorney, made this
matter of record. Debbie de Besche, Planning Department
representative, read the favorable recommendation of the Planning
Commission into the record. She said that five Conditions and thirteen
Development Standards are recommended for this operation, and noted
that Condition #5 has been met. Josephine Hayes came forward to
represent the applicants. She stated that there are no problems with
the Development Standards as proposed. She also stated that horses
have been boarded at this location for a number of years, even prior to
the approval of the present Use by Special Review. No public testimony
was offered concerning this request. Commissioner Kirby moved to
approve the request to amend the Use by Special Review to include horse
boarding. Commissioner Yamaguchi seconded the motion and it carried
unanimously.
This Certification was approved on the 5th day of May, 1986.

site except for inspection twice a week by an engineer.
The Chairman called for discussion from the members of the audience. There
was none.
The Chairman asked that reading of the recommendations, conditions, and
Development Standards as outlined by the Department of Planning Services
staff be dispensed with and that they be filed with the summary as a
permanent record of these proceedings.
MOTION:
Harlan Else moved Case Number USR-73:86:16 for Mountain View Broadcasting
(Woody Sudbrink) for a Use by Special Review permit for four AM radio
transmission towers and a transmitter building based upon the
recommendations, conditions, and Development Standards as outlined by the
Department of Planning Services staff and the testimony heard by the members
of the Planning Commission. Motion seconded by Paulette Weaver.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The chairman asked the secretary to poll the members of the Planning
Commission for their decision. Paulette Weaver - yes; Ann Garrison - yes;

LOCATION: Approximately 2.5 miles southeast of Dacono; north of Weld County
Road 6 and east of Weld County Road 17
APPEARANCE:
Jo Hayes, Realtor and Broker, represented the applicants. She stated this
is a request to amend the original Use by Special Review permit to include
the boarding of horses. The barns were constructed in 1973, and there are
runs, etc. , already in place. The permitted use is for a sale barn and an
arena. She has spoken to the State Engineer, Division of Water Resources,
and there did not seem to be any objections in getting a commercial
designation on the well. However, they have not received written
confirmation yet.

AMENDMENT:
Ann Garrison moved Development Standard #13 be amended to read as follows:
13. Animal waste shall be removed from the Use by Special Review
site every two (2) weeks.
Motion seconded by Don Johnson.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the Planning Commission for their decision. Motion
carried with five voting for the motion and one voting against the motion.
AMENDMENT:
Don Johnson moved Condition #5 be changed to read as follows:
5. Prior to the Board of County Commissioner's hearing the
applicant shall provide the Department of Planning Services
with a copy of an application for reclassification of the
well permit to commercial use.

Gloria Dunn explained that the original permit allows for an arena. The
conditions of the original permit still pertain to this request. The
applicant is amending the Use by Special Review permit to also allow the
boarding of horses on the property.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. No additional building or electrical permits shall be issued on
the property until the Use by Special Review plat has been

Dear Ms. deBesche:
This letter confirms my telephone conversation with you on April
7, 1986 . On the agenda at the regular meeting of the Tri—Area
Planning Commission was application from Chris and Terrance Ammon
and John S. Martinez to amend a Use by Special Review Permit to
include a horse barding operation .
Motion was made to approve application with the stipulation that
Mr. Ammon would not have a horse arena in his operation . This
property was previously owned by Gordon Reed under the name Omni
Ranch and he submitted a application in 1985 requesting permis-
sion to have a arena and the Tri-Area Planning Commission denied
request.

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
- The proposal is consistent with the intent of the Weld
County Comprehensive Plan. The comprehensive Plan
encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local economy or
environment.
- The proposed use is an agricultural activity which is
consistent with the intent of the agricultural district.
- The uses permitted will be compatible with the existing
surrounding land uses and with future development of the
surrounding areas as permitted by the agricultural zone
district.
- The Tri-Area Planning Commission has reviewed this
proposal and is recommending conditional approval. The
Commission's comments are attached.
- No overlay districts affect the site; and
- The Use by Special Review Development Standards will
provide adequate protection of the health, safety and
welfare of the neighborhood and County.

This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. No additional building or electrical permits shall be issued on
the property until the Use by Special Review plat has been
delivered to the Department of Planning Services' office and the
plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. The applicant/operator shall submit a revised mylar plat to the
Department of Planning Services to show all uses and buildings
proposed on the site.
4. Prior to beginning construction of the livestock show and sale
facility, or issuance of any building or electrical permits, a
final soils engineering report shall be completed for building
foundations and subsurface drainage as recommended by the
applicant's engineer. A copy of the report shall be submitted to
the Department of Planning Services.

1. The Use by Special Review permit is for an amendment to USR-648 a Use
by Special Review permit for a livestock show and sale facility to
include horse boarding as submitted in the application materials on
file in the Department of Planning Services and subject to the
Development Standards stated hereon.
2. Prior to beginning construction of the livestock show and sale
facility, subsurface drainage and building foundations shall be
installed in accordance with a final soils engineering report.
3. An engineer designed sewage disposal system approved by the Weld County
Health Department shall be installed for the livestock show and sale
facility.
4. Prior to beginning construction of the livestock show and sale
facility, the applicant shall submit, and have approved, and construct
an erosion control and surface draininge plan in accordance to the West
Adams Soil Conservation District recommendation. A copy of the
approved plan shall be submitted to the Department of Planning
Services.
5. All parking associated with the Use by Special Review area shall be on
site in the designated parking areas as shown on the Use by Special
Review plat.
6. The access from Weld County Road 8 should be a minimum of twenty-four
feet (24') wide with a fifteen foot (15') corner radii. A fifteen inch
(15") minimum diameter culvert shall be installed in this access of
adequate length to support the required width.
7. All Construction done on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
8. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
9. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
10. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to insure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.

11. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the foregoing Standards and all applicable Weld
County Regulations. Any material deviations from the plans or
Standards as shown or stated shall require the approval of an amendment
of the Permit by the Weld County Planning Commission and the Board of
County Commissioners before such changes from the plans or Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
12. The property owner or operator shall be responsible for complying with
all of the foregoing Standards. Noncompliance with any of the
foregoing Standards may be reason for revocation of the Permit by the
Board of County Commissioners.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review of this proposal is listed in Section 24.3 of the
Weld County Zoning Ordinance.
The original USR-648:84:44 was for a livestock show and sale facility
approved by the Weld County Board of County Commissioners on October 10,
1984. The arena has not been built.
The owner in 1984 was Gordon Reed. The new owners and current applicants do
not want to abandon this use, but wish to amend USR-648 to include horse
boarding.
The Tri-Area Planning Commission met on this proposal April 2, 1986, and are
recommending approval.
The Department of Planning Services staff has not received referral
responses from the following:
- State Engineer Division of Water Resources
- West Adams Soil Conservation District.
There have been no objections raised to the Department of Planning Services
regarding this proposal.

The Weld County Planning Commission will conduct a public hearing on April
15, 1986 at 1:30 p.m. to review a request for approval to amend a Use by
Special Review permit to include a horse boarding operation from Chris and

USE BY SPECIAL REVIEW PROCEDURAL GUIDE
The purpose of this packet is to provide information to an applicant about the
Use by Special Review application process.
PROCESSING

*The application shall be referred to any municipality or County governing body
within a three (3) mile radius of the parcel under consideration for a use by
special review permit.
Intent and Applicability
Uses by Special Review are uses which have been determined to be more intense or
to have a potentially greater impact than the Uses Allowed by Right in a
particular zone district. Therefore, Uses by Special Review require additional
consideration to ensure that they are established and operated in a manner that .
is compatible with existing and planned land uses in the neighborhood. " The
additional consideration or regulation of Uses by Special Review is designed to
protect and promote the health, safety, convenience, and general welfare of the
present and future residents of Weld County.
It is necessary for the applicant to meet and address the minimum requirements
outlined in the use by special review procedural guide packet for the following
reasons:
1. The purpose of the application is to give the applicant an opportunity to
demonstrate through written and graphic information how the proposal
complies with the adopted policies of the Weld County Comprehensive Plan and
requirements of the Weld County Zoning Ordinance.
2. A completed application form and supporting materials will enable the
Planning staff to process and develop staff comments within the time frame
established for the use by special review application procedure.
USE BY SPECIAL REVIEW
The applicant shall submit the following:
1. A total of twenty (20) packets of the required use by special review
application materials. (The original plus nineteen (19) copies.)
2. Twelve (12) copies of the use by special review plan map.
3. Use by special review application fee.
4. Use by special review recording plat fee.
The Department of Planning Services shall be responsible for processing all Use
by Special Review applications in the unincorporated areas of Weld County in
accordance with section 24.2. et seq. of the Weld County Zoning Ordinance.

The Department of Planning Services staff shall prepare comments for use by the
Planning Commission addressing all aspects of the application, including;
conformance with the Weld County Comprehensive Plan, master plans of affected
municipalities and counties, comments received from referral agencies and
interested persons.
The Planning Commission shall hold a hearing to consider the application for a
use by special review permit in accordance with section 24.3 et seq. of the Weld
County Zoning Ordinance. The Planning Commission shall provide a recommendation
to the Board of County Commissioners concerning the use by special review permit
request.
The Board of County Commissioners shall hold a public hearing to consider the
application for a use by special review and to take final action thereon in
accordance with section 24.4. et seq. of the Weld County Zoning Ordinance.
It is recommended that the applicant attend all hearings scheduled for
consideration of the use by special review application in order to present the
proposal and answer questions of the involved governing bodies. The applicant is
also encouraged to maintain a working relationship with the Department of
Planning Services staff once an application has been submitted in order to keep
up—to—date with any developments pertaining to the application.
APPLICATION REQUIREMENTS
The application requirements are outlined in section 24.7 et seq. of the Weld
County Zoning Ordinance. The following items shall be submitted with an
application for a use by special review permit:
1. A completed application form (form attached) .
2. A detailed description of the proposed operation and use shall be supplied.
Details for the following items, when applicable, are required.
- Explain proposed use. PRESENT use shall continue - horses are to be
stabled, boarded, and/or pastured.
- Explain need for use. PROPOSED use is needed to generate income.
- Explain the types of existing uses on surrounding properties. SURROUNDING
lands are used for farming,ranching,horse pasturing,and dairy farming.
- The distance of the proposed use to residential structures in each
direction. WITH the exception of the home on subject property, all

be stabled, boarded, and/or pastured at any one time.
- The type and size of any waste, stockpile or storage areas associated
with the proposed use. ALL such facilities have remained the same
since 1967. Wastes shall be kept to a minimum and removed often.
- Type of storm water retention facilities associated with the proposed
use. RETENTION facilities are unchanged since 1967 and no changes
are proposed.
- The time schedule and method of removal and disposal of debris, junk
and other wastes associated with the proposed use. ALL wastes (which will
relate to the care of horses ) will be kept to a minimum and removed

land use - no additional land shall be, removed from crop production.
- A statement explaining how the proposal is consistent with the intent
of the district in which the use is located. PROPOSED use is consistent
with farm land usage, as above stated.
- If applicable, a statement explaining what efforts have been made, in
the location decision for the proposed use, to conserve productive
agricultural land in the agricultural zone district. BARNS were constructed
in 1967 upon non—productive land of alkaline, high PH condition.
- A statement explaining there is adequate provision for the protection
of the health, safety and welfare of the inhabitants of the
neighborhood and the county. ALL provisions remain the same as in 1967.

documenting the methods to be utilized to meet the applicable noise
standards.
- A soil report of the site prepared by the Soil. Conservation Service or
by a soils engineer or scientist. .In those instances when the soil
report indicates the existence of moderate or severe soil limitations
for the uses proposed, the applicant shall detail the methods to be
employed to mitigate the limitations.
- A certified list of the names, addresses and the corresponding parcel
identification number assigned by the Weld County Assessor of the
owners of property (the surface estate) within five hundred (500) feet
of the property subject to the application. The source of such list
shall be records of the Weld County Assessor, or an ownership update
from a title or abstract company or attorney,derived from such records,
or from the records of the Weld County Clerk and Recorder. If the list
is assembled from the records of the Weld County Assessor, the
applicant shall certify that such list
was assembled within thirty (30) days of the application submission
date. (Form attached.) The County Assessor's Office will not complete
this list for you. It is the responsibility of the applicant to gather
this information.
THE COUNTY ASSESSOR'S OFFICE CANNOT COMPLETE SURROUNDING PROPERTY OWNER
LISTS FOR LAND USE APPLICATIONS. THE ASSESSOR'S OFFICE IS AVAILABLE TO
EXPLAIN HOW TO GENERATE THE LIST. HOWEVER, IT IS THE RESPONSIBILITY OF THE
APPLICANT TO GATHER THE INFORMATION.
- A certified list of the names and addresses of mineral owners and
lessees of mineral owners on or under the parcel of land being
considered. The Source of such list shall be assembled from the
records of the Weld County Clerk and Recorder, or from an ownership
update from a title or abstract company or an attorney, derived from
such records. (A certification form is attached.)
4. USE BY SPECIAL REVIEW PERMIT PLAN MAP
A use by special review permit plan map shall he delineated on reproducible
mylar material approved by the Department of Planning Services. The
dimensions of the map shall be thirty-six (36) inches by twenty-four (24)
inches. The Use by Special Review Permit Plan Map shall include
certificates for the property owner's signature, the Planning Commission and
the Board of County Commissioners. The map shall contain a vicinity map and
plot plan which are described below:
- Vicinity Map - a vicinity map shall be drawn on the Use by Special
Review Permit Plan Map.
- The scale of the vicinity map shall be one (1) inch equals six
hundred (600) feet or at another suitable scale if approved by the
Department of Planning Services.
- The vicinity map shall delineate all of the required information
within a one-half (3 ) mile radius of the property proposed for the
Use by Special Review.
- The following information shall be shown on the vicinity map:
- Section, township, and range.
- Scale and north arrow.
- Outline of the perimeter of the parcel proposed for the Use
by Special Review.
- The general classifications and distribution of soils over
the parcel under consideration. Soil classification names
and agricultural capability classifications must be noted in
the legend.
- Locations and names of all roads, irrigation ditches, and
water features.
- Location of all residences within a one-half (z) mile radius,
existing and proposed accesses to the property proposed for
the Use by Special Review, any abutting subdivision outlines
and names, and the boundaries of any adjacent municipality.
- Any other relevant information within a one—half (1) mile distance of
the perimeter property proposed for the Use by Special Review as may be
reasonably required by the county to meet the intent and purpose of the
Weld County Zoning Ordinance.
- Plot Plan — a plot plan of the Use by Special Review area shall be
drawn on the Special Review Permit Plan Map.

- The scale of the plot plan shall be one (1) inch equals one-hundred
(100) feet or at another suitable scale if approved by the Department
of Planning Services.
- The plot plan shall outline the boundaries of the parcel being
considered for the Use by Special Review.
- The plot plan shall include the location and identification of all of
the following items which may exist within a two-hundred (200) foot
radius of the perimeter of the property and the use by special review
area located within the perimeter of the property.
- All public rights-of-way of record (including names) .
- All existing and proposed structures.
- All utility easements of rights-or-way for telephone, gas,
electric, water and sewer lines.
- Irrigation ditches (including names) .
- Adjacent property lines and respective owners' names (may be
shown on vicinity map instead) .
- All hydrographic features including streams, rivers, ponds,
and reservoirs (including names) .
- Topography at two (2) foot contour intervals or at intervals
as determined necessary by the Department of Planning
Services.
- Location of areas of moderate or severe soil limitations as
defined by the Soil Conservation Service or by a soil survey
and study prepared by a soils engineer or scientist for the
use and associated structures proposed for the parcel.
- Location and design of storm water management devices or
structures.
- Complete traffic circulation and parking plan showing
locations and sizes.
- Location, amount, size and type of any proposed landscaping,
fencing, walls, berms, or other screening.
- The use by special review plan map shall include certificates for the
property owners' signature, the Planning Commissions' signature, and
the Board of County Commissioners' signature. The required content of
the certificates are shown on page six (6) of this procedural guide.
- Such additional information as may be reasonably required by the
Department of Planning Services, the Planning Commission or the Board
of County Commissioners in order to determine the application meets the
requirements of this Ordinance and the policies of the Weld County
Comprehensive Plan.
5. No Use by Special Review Permit application shall be assigned a case number
or have a hearing date set until :
- Al]. required items have been completed and submitted to the Department
of Planning Services Staff.
The required number of drawings in the proper format have been
submitted.
- The required application and recording fees have been paid.

All Use by Special Review Permit applications to be heard by the Board
of County Commissioners shall be advertised once in the official County
newspaper at least ten (10) days prior to the established hearing date.
This advertising is handled by the Clerk to the Board's Office. The
advertising fee is paid hz the applicant on billing from the official
County newspaper.
6. An applicant for a use by special review permit shall demonstrate compliance
with the design standards outlined in Section 24.5 of the Weld County Zoning
Ordinance and shall shall continue to meet these standards if approved for
development.
7. An applicant for a use by special review permit shall demonstrate
conformance with the operation standards outlined in Section 24.6 of the
Weld County Zoning Ordinance to the extent that the standards affect
location, layout and design of the use by special review prior to
construction and operation. Once operational, the operation of the USES
permitted shall conform to these standards.
8. An applicant shall post a sign on the property under consideration in a
location readily visible from the adjacent roadway(s). The sign must be
posted at least ten (10) days preceding the hearing date and the applicant
shall certify that the sign was posted by the appropriate time. This
responsibility must be met both for the Planning Commission hearing and
again for the Board of County Commissioners' hearing. The signs and
certification forms will be provided by the Department of Planning Services.
It is the applicant's responsibility to obtain the sign from the Department
of Planning Services prior to the required posting time.
In the event of an unfavorable recommendation by the Planning Commission,
the office of the Clerk to the Board shall send a certified letter to all
petitioners who receive an unfavorable recommendation from the Weld County
Planning Commission. The letter shall give the applicant fifteen (15) days
to notify the Clerk to the Board as to whether or not they wish to proceed
with an application hearing before the Board of County Commissioners.
9. The applicant will be billed for the legal advertising costs associated with
the Board of County Commissioners' Notice of Public Hearing.
