RE: APPROVAL OF RECORDED EXEMPTION NO. 748 - JAMES E. AND
ELIZABETH HESS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 748 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 748 was
submitted by James E. and Elizabeth Hess for property which is
located in part of the NEe, Section 18 , Township 6 North, Range 63
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 44 acres and 1 acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following conditions: 1) the applicant shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty days from the date of approval by
the Board of County Commissioners, and 2) in accordance with the
April 5 , 1985 , referral received from the Division of Water
Resources, a note shall be placed on the plat which reads, "The
well servicing Lot 'B ' shall be for in-house use only. "

Re: Recorded Exemption #748
Dear Commissioners:
This request for a recorded exemption is submitted by James E. and Elizabeth
Hess. The parcel of land on which this request is being made is described as
part of the NE1, Section 18, T6N, R63W of the 6th P.M. , Weld County,
Colorado. The property is located .5 miles north of Barnesville on Colorado
Highway 392. The parcel of land under consideration is the total contiguous
land holdings of the applicant.
The request is to divide the property into parcels of 44.045 acres and 1.455
acres, more or less. Mr. and Mrs. Hess propose to convey the proposed Lot
"B" to Joseph and Katrinka Grashot for a dwelling site. Lot "A" will be
maintained by the applicants in its present condition.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The applicant has demonstrated in the submitted application
materials that the request complies the submission
requirements of Section 9-2 C. of the Weld County Subdivision
Regulations.

2. The applicant has demonstrated in the submitted application
materials that the standards and conditions of Section 9-2 E.
(1) (a) through (m) of the Weld County Subdivision
Regulations have been met.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be drawn in accordance with
the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty
(60) days from the date of approval by the Board of County
Commissioners.
2. In accordance with the April 5, 1985, referral received from the
Division of Water Resources, a note shall be placed on the plat
which reads, "the well servlc`in$ Lot 'B' shall be for in—house use
only."

COMMENTS:
Access to the property is from Colorado Highway 392. Proposed Lot B
contains a silo and a mobile home. There are eight or more old shed/shack
structures on Lot A as well as a residence, mobile home and travel trailer.
Various farm machinery and equipment, derelict vehicles and debris are also
kept on the site. The remainder of Lot A is pasture, except the area
directly east of Lot B, which is idle land. There are 5 residences within
1/4 mile of the subject site.

Dear Ms. Dunn:
We have reviewed the Hess Exemption request and have the following
comments:
This property has an existing driveway on State Highway 392 which
has been used to obtain access to area identified as proposed Lot B.
We recommend that a single access be used to serve both lots which
would result from this exemption.
If this exemption is approved and a new driveway or relocation of
the existing driveway is required to serve Lot B, an Access Permit
will be required. Application for this permit is made to this
office at the above address.

Dear Ms. Dunn:
We have reviewed the above referenced proposal to separate approximately
45.5 acres into lots of 44.05 and 1.45 acres. The proposed 44.05-acre lot
would be served by an existing well.
We could issue a well permit for the proposed 1.45-acre tract. Since a
well permit would be available, we can recommend approval. The availability
of a well permit and our recommendation for approval is subject to the follow-
ing conditions:
1. The property has not been previously subdivided or exempted since
1972. We consider this as a one-time exemption and will not make
additional permits available for future splits of either tract.
2. The existing well was constructed prior to 1965.
3. The well permit which will be available will be limited to use inside
one single-family dwelling only. Outside use for lawn and garden
irrigation or livestock is prohibited. Plat notes and covenants
should reflect this limitation. The owners may obtain a domestic
well for their daughter and son-in-law if they designate 3'5 acres or
more on which there presently is no other well and on which no addi-
tional wells would be allowed to be constructed in the future. A
plat note should be issued that no additional wells will be available
for the 35-acre or larger parcel designated by the owners.
4. The applicant should provide proof that an evaporative wastewater
system will not be required. We could not issue the well permit if
any evaporative system is required.

5. Prospective lot purchasers should be made aware of the limitations on
water use and other information contained in this letter. We recom-
mend that a copy of this letter be given to lot purchasers and sub-
mitted with the well permit application.

Dear Planning Commission:
In conformance with the Recorded Exemption Procedural Guide, I am
attaching an original and nine copies of a Recorded Exemption Application
for James and Elizabeth Hess. Also enclosed is a completed Certificate
of Conveyances and a copy of the Deed by which my clients took title.
The purpose for the Recorded Exemption is to allow my clients to convey
the smaller 1.455 acre tract to their daughter and son-in-law, Joseph
F. and Katrinka N. Grashot. The 1.455 acre tract is essentially wasteland
(covered with alkali) and not suitable for farming or ranching.
This proposal is consistent with the Weld County Comprehensive Plan
because no farm ground will be taken out of production and the land
is not suitable for any other purpose.
The subject property is now located in an agricultural district.
The intended use of the property; i.e. , as a residence, is consistent
with the Agricultural zoned district and will not conflict with the
surrounding uses.
The use of both of the parcels will be compatible with future development
of the surrounding area as permitted by the existing zone and the
future development as projected by the Comprehensive Plan. Since
my clients are dividing the tract into a 44.045 acre and a 1.455 acre
tract, the parcels are both large enough to maintain the integrity
of the area as primarily agricultural.
The intended use of the smaller tract as a residence will not be incon-
sisent with efficient and orderly development.
The 1.455 acre tract will be served by a new well and the 44.045 acre
tract is now served by an existing well. The severed tracts will
be served by a septic sewer.
The property under consideration for Recorded Exemption is not located
in a flood plain, geologic hazard and/or Weld County Airport Overlay
District.

Range Sixty-three (63) West of the 6th Principal Meridian. Weld County, Colorado, being
more particularly described as follows: Commencing at the Northeast corner of said Section
18 which is marked by an iron pin, said point being the TRUE POINT OF BEGINNING; thence by
true bearings, variation 14'30' East as follows: South 89'31'40" West along the North line
of Section 18, 1050 feet; thence South 08°20" East 2057 feet; thence South 69°08' West,
313 feet; thence South 08'20" East 25 feet; thence North 69'8' East, 1423 feet to the East

Colorado State Highway 392 as bearing South 69°08'00" West with all other bearings con-
tained herein relative thereto; Thence South 69°08'00" East, 491.6 feet, more or less,
along the North right-of-way line of Colorado State Highway 392 to the TRUE POINT OF
BEGINNING; Thence continuing South 69°08'00" East, 229.92 feet along said North right-of-
way line; thence North 16°44'27" West, 318.45 feet; thence North 73°34'08" East, 218.35
feet; Thence South 18°49'53" East, 300.93 feet to the TRUE POINT OF BEGINNING.
