RE: AUTHORIZE SIGNATURE ON LETTER TO COMMISSIONER OF AGRICULTURE
FOR GRASSHOPPER CONTROL IN THE EASTERN WELD PEST CONTROL
DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on or about June 19 , 1985 , the Board of County
Commissioners of Weld County, Colorado, delivered a letter to the
Commissioner of Agriculture stating that the Eastern Weld Pest
Control District was infested with 8 or more grasshoppers per
square yard on 15 ,630 acres and asked that the Commissioner of
Agriculture request to the Governor that funds be made available ,
pursuant to §35-5-116 , CRS , to aid the resident landowners or
resident lessees of such acreage in the spraying of grasshoppers,
and
WHEREAS, there has been a number of resident landowners and
resident lessees who have requested that their lands be made a
part of the spraying program and funding which was requested in
the letter sent to the Commissioner of Agriculture on or about
June 19 , 1985 , and
WHEREAS, the Commissioner of Agriculture has suggested that
the Board of County Commissioners of Weld County, Colorado,
execute a new letter to the Commissioner of Agriculture asking for
said funds and including all of the acreage in the Eastern Weld
Pest Control District to be sprayed, and
WHEREAS, the Commissioner of Agriculture has suggested that
said new letter will delete the previous letter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the previous letter
signed by the Chairman and addressed to the Commissioner of
Agriculture asking for funding for grasshopper spraying in the
Eastern Weld Pest Control District is hereby deleted and the
Chairman is authorized to sign a new letter to the Commissioner of
Agriculture for such funding. Said letter is attached hereto as
"Attachment A, " and is made a part hereof by reference.

We, the County Commissioners of Weld County, Colorado, pursuant to §35-5-120,
CRS, do hereby certify that the Eastern Weld
Pest Control District has been established
for the eradication of grasshoppers, in accordance with the provisions of Title
35, Article 5, of the Colorado Revised Statutes, as amended. Sixty-six and
two-thirds percent (66 2/3%) of the landowners, representing not less than
fifty percent (50%) of the land within the District, voted in favor of the
establishment of the District.
Said District is infested with grasshoppers. The Colorado Department of
Agriculture has determined that the infestation in this area averaged
approximately 8+ grasshoppers per square yard on 18,098 acres
of range land.
The names and addresses of all landowners and lessees who wish to participate
in the grasshopper eradication program in accordance with §35-5-120, CRS,
including the legal descriptions of the lands they occupy are attached hereto
as "Exhibit A."
We do further certify that the landowners listed in "Exhibit A" have agreed to
pay one-third (1/3) of the cost per acre for range acreage as determined by the
Colorado Department of Agriculture as a contribution to pay the cost of
controlling the grasshoppers that are infesting said area.
Enclosed is a check in the amount of $19,257.00 as the Eastern Weld
Pest Control District's proportionate share of the estimated cost of control of
grasshoppers on the lands described in "Exhibit A." We do also hereby petition -
the Commissioner of Agriculture of the State of Colorado to request to the
Governor that funds be made available, pursuant to §35-5-116, CRS, to the
Colorado State Department of Agriculture from the Governor's Agriculture
Emergency Fund to be used as matching funds for monies provided by federal and
private landowners.
