RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR A PRINCIPAL DWELLING AND AN ACCESSORY TO THE FARM
DWELLING ON A PARCEL LESS THAN THE MINIMUM LOT SIZE IN THE A
(AGRICULTURAL) ZONE DISTRICT - KENNEY D. AND MARY ANN WRIGHT
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 18th day of October, 1989, at the hour of 10 :00
a.m. in the Chambers of the Board for the purpose of hearing the
application of Kenney D. and Mary Ann Wright, 8019 Weld County
Road 78 , Fort Collins, Colorado 80524 , for a Site Specific
Development Plan and Special Review Permit for a principal
dwelling and an accessory to the farm dwelling on a parcel less
than the minimum lot size in the A (Agricultural) Zone District on
the following described real estate, to-wit:
Part of the SEl , Section 35 , Township 7 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Ken Wright, one of said applicants was present, and
WHEREAS, Section 24.4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows:
a. The proposal is located within the Urban Growth
Boundary Areas of the Towns of Severance and
Windsor and is consistent with the Weld County
Comprehensive Plan's Urban Growth Boundary Goals

and Policies. In a referral response dated
September 8, 1989 , the Town of Windsor' s Planning
Commission indicated no conflict with its
interests, and in a referral response dated
September 13, 1989, the Town Board of Severance
indicated no conflict with its interests .
b. The proposal is consistent with the intent of the
Agricultural Zone District. The property will be
used for two single family dwellings and the
balance of the property will be used for
agricultural production.
c. The uses permitted will be compatible with the
existing surrounding land uses and with the future
development of the surrounding area as permitted by
the Weld County Comprehensive Plan. The average
parcel size in this section is 54 acres, more or
less. Uses in the surrounding area consist of
agricultural production, rural residences, and
dairy operations.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
principal dwelling and an accessory to the farm dwelling on a
parcel less than the minimum lot size in the A (Agricultural) Zone
District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.

1 . The Site Specific Development Plan and Special Review Permit
is for a principal dwelling and an accessory to the farm
dwelling as submitted in the application materials on file in
the Department of Planning Services and subject to the
Development Standards stated herein.
2. Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24, C.R.S. , as amended.
3 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
4 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
5 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
6 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
7 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
8 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated September 27, 1989,
and duly published October 5, 1989, in The New News, a public hearing
was conducted to consider the application of Kenney D. and Mary Ann
Wright for a Site Specific Development Plan and Special Review Permit
for a principal dwelling and an accessory to the farm dwelling on a
parcel less than the minimum lot size in the A (Agricultural) Zone
District. Lee Morrison, Assistant County Attorney, made this matter of
record. Keith Schuett, representing the Planning Department, entered
the favorable recommendation of the Planning Commission into the record
of this hearing. Ken Wright, one of the applicants, came forward to
answer questions of the Board. Mr. Wright said he has no problem with
the Conditions and Development Standards proposed by the Planning
Commission. No public comment was offered concerning this request.
Commissioner Lacy moved to approve the request of Kenney D. and Mary
Ann Wright for a Site Specific Development Plan and Special Review
Permit, subject to the Conditions and Development Standards as
recommended by the Planning Commission. The motion was seconded by
Commissioner Kennedy, and it carried unanimously.
This Certification was approved on the 23rd day of October, 1989.

This office represents Mrs . Viola Carlson who is the owner
of an undivided one-half (1/2) of all the oil , gas and other
minerals that may be produced in and under the property described
as part of the Southeast Quarter (SE 1/4) of Section Thirty-five
( 35) , Township Seven (7) North , Range Sixty-seven ( 67 ) West of
the 6th P .M. , in Weld County , Colorado .
Mrs . Carlson, as the owner of one-half of the oil , gas and
other mineral rights under this property , wishes to protect those
mineral rights and to register her opposition to any expansion or
extension of the number of acres required by any owner of mineral
rights before they can drill an oil or gas well on the premises .

The Chairman asked Rod Allison to read the recommendation of the Department
-of Planning Services staff into the record. The Planning Staff's
recommendation was for denial because adequate access to the mall had not
been demonstrated.
MOTION:
Jerry -Kiefer moved Case Number S-306 for Fifthcoff Company and Grant
_Brother's Partnership for a Site Specific Development Plan and a Planned
Unit Development Plan, First and Seconding Filings, be continued until the
regularly scheduled October 17, 1989, meeting of the Weld County Planning
Commission to allow the applicants time to present an acceptable plan for
access and development of the future frontage road with the State Highway
Department. Motion seconded by Rick Iverson.
-The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.

of County Commissioners with the Planning Commission's recommendation for
approval based upon the recommendation, conditions, and Development
Standards presented by the Department of Planning Services staff and the
testimony heard by the Planning Commission. Motion seconded by Bud Clemons.

County Planning Comad:obion on Tuesday, September 19, 1989, at 1 :30 p.m.
This meeting will take place in the County Commissioners' Hearing Room,
first floor, Weld Ccunty Centennial Center, 915 10th Street, Greeley,
Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Planning Commission members night
have with respect to your application.

Dear Mr. Cunliffe:
This letter is written in accordance with and to respond to Section 24.7 of the
Weld County Zoning Ordinance.
The proposed use is for home sites for hired men. We operate a custom hay
business plus lease two other farms in the area, which add up to an additional
370 acres . There is no housing available for hired men on leased farms. The
proposed land is a non-farmable and non-irrigated hill-side, not usable for
farming.
The existing uses on surrounding properties are agricultural and the approxi-
mate distances to existing residences are shown on the USR plat.
Domestic water will be provided by the North Weld County Water District
(NWCWD) . A letter stating that a tap can be provided is included.
Access to the proposed property is off of Weld County Road No. 74 as shown on
the USR plat.
The proposed sewage facilities will be a septic system. Fire protection will
be provided by the Windsor/Severance Fire Protection District.
No animals or livestock will be concentrated on the property. Trash service
will be assigned to a commercial company.
We would like to have all permits obtained by September 1, 1989.
She proposed property is consistent with the Weld County Comprehensive Plan
(-Agricultural Use in an "A" Zone) . -While the eastern portion of the property
is located in the flood _lain (ref. FIRM map 080266-475C dated September 28,
1982) ; the portion to be used for the residence is not. Property is not
located in a geologic hazard zone; is not located in the Weld County Airport
overlay district area, and complies with Section 50 Overlay Regulations as
outlined by the Weld County Zoning Ordinance.

has been compiled from the Soil Conservation Service Reports (see USR Plan for
overlay) .
