VRAIN SANITATION DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to the provisions of Title 32 , Article 1 , Part 2 , C.R.S. , the Board of County Commissioners of Weld County, Colorado, held a public hearing on the Service Plan of the proposed St. Vrain Sanitation District on the 16th day of October, 1985 , and WHEREAS, notice of the hearing was duly published three times in the Johnstown Breeze , on September 19 and 26 , and October 3 , 1985 , as required by law, and notice was forwarded to the petitioners, to the Division of Local Government, and to the governing body of each municipality and special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three miles or the proposed District, and WHEREAS, the hearing was open to the public, a record of the proceedings was made, and all interested parties, as defined in Section 32-1-204 , C.R.S. , were afforded an opportunity to be heard, and WHEREAS, the City of Longmont and County of Boulder appeared and presented objections to the approval of the Service Plan , and no other interested parties appeared or presented objections , and WHEREAS, no requests for exclusion pursuant to Section 32-1-202 (2 . 1) , C.R.S. , have been filed, and WHEREAS , the Board has considered the Service Plan and all other testimony and evidence presented at the hearing, and WHEREAS , at the request of the Board, the petitioners for the proposed District have provided for certain amendments to the original Service Plan, which amendments have been made a part of the Service Plan, and i - - - 8,105o C Urn' B 1091 REC 020... 118 11/14/85 09: 56 Sv. 00 2/003 F 1652 MARY ANN FEUERSTEIN CLERK & RECORDER WELD CO, CO Page 2 RE: SERVICE PLAN - ST. VRAIN SANITATION DISTRICT WHEREAS , it appears that the Service Plan, as amended , (hereinafter the "Service Plan") , should be approved without condition or modification . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado: Section 1 . The Board of County Commissioners of Weld County, Colorado (the "Board") , does hereby determine that all of the requirements of Title 32 , Article 1 , Part 2 , C.R.S, relating to the filing of a Service Plan for the proposed St. Vrain Sanitation District have been fulfilled and that notice of the hearing was given in the time and manner required by law. Section 2 . The Board hereby finds and determines that: (a) There is sufficient existing and projected need for organized service in the area to be serviced by the proposed District. (h) The existing service in the area to be served by the proposed District is inadequate for present and projected needs. (c) The proposed District is capable of providing economic and sufficient service to the area within its proposed boundaries. (d) The area to be included in the proposed District has and will have the financial ability to discharge the proposed indebtedness on a reasonable basis. (e) Adequate service is not and will not be available to the area through the County, other existing municipal or quasi-municipal corporations, including special districts, within a reasonable time on a comparable basis . (f) The facility and service standards of the proposed District are compatible with the facility and service standards of the County and each municipality which is an interested party under Section 32-1-204 (1) , C.R.S. (g) The proposal is in substantial compliance with a master plan adopted pursuant to Section 30-28-108 , C.R.S. VRAIN SANITATION DISTRICT (h) The proposal is in compliance with any duly adopted county, regional , or state long-range water quality management plan for the area. (i) The creation of the proposed District will be in the best interests of the area proposed to be served. Section 3 . The Service Plan of the proposed St. Frain Sanitation District is hereby approved without condition or modification. Section 4 . A certified copy of this Resolution shall be filed in the records of Weld County and submitted to the petitioners for the purpose of filing in the District Court of Weld County. VRAIN SANITATION DISTRICT A public hearing was conducted on October 16, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro—Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated September 16, 1985, and duly published September 19, and October 3, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the Service Plan for the St. Vrain Sanitation District. Lee Morrison, Assistant County Attorney, made this matter of record. He then explained the law regarding the creation of a Sanitation District. He also listed the criteria to be considered by the Board for approval, disapproval, or conditional approval of this Service Plan. Rod Allison, Planning, Department representative, read the recommendation for conditional approval, and the reasons for said recommendation, from the Planning Commission into the record. Mr. Allison read additional comments regarding concerns about this matter which were expressed by the City of Longmont. Mr. Allison said the petitioners have requested that certain conditions set forth by the Planning Commission be modified as follows: Condition #1) ". . .prior to filing a site application for the wastewater treatment facility." With the addition of another sentence to read, "Failure to supply the additional information would constitute a material departure or modification from the submitted Plan." Condition E) "All wastes must be within the limits established by the elected Sanitation District Board and shall be compatible with the treatment system capabilities. A pre-treatment plan for accepting industrial waste shall be submitted as part of the site application." Mr. Morrison said that the language concerning the modifications are to be incorporated into the Service Plan, with the actual study occurring at a later date. Mr. Allison said this would be considered as part of the application Plan with the understanding that if the study is not completed, it will be considered a major change of the Plan. Wall) Grant, Attorney representing St. Vrain Sanitation District, came forward to make his presentation and answer questions of the Board. Gene Andrist, Consultant, gave a presentation concerning the population projection and financial feasibility end answered questions of the Board. Vern Nelson, Engineer, came forward to answer questions of the Board regarding financial feasibility. During public testimony, Dennis. Hiatt, Longmont Partnership Corp. , offered comments in favor of the proposed Plan. Ted Coffele, representing the Boulder County Planning Department, expressed concerns about the expansion of the District. Mr. Coffele said that Boulder County requests that a condition be made which would stipulate an amendment to the Service Plan that if the boundaries are modified, public review would be required. Mr. Morrison said the applicant is bound to the projected area which is presented in the Service Plan, but this concern could be incorporated into the Service Plan. Mr. Grant said there is no intent of going into Boulder County, but he would agree to a condition stating, "Any expansion beyond the potential service area drainage basin, described on Exhibit 2, would require approval of the Weld County Commissioners and an, proposed expansion into Boulder County would require approval of the Boulder County Commissioners." The Board agreed to this amendment to Page 2 RE: CERTIFICATION - ST. VRAIN SERVICE PLAN the Service Plan. Marta Bromschwig, Acting Planning Director for the City of Longmont, made comments in favor of the proposed District. John McCarty, read a letter from the Longmont Chamber of Commerce, favoring the proposed District, into the record. Mr. McCarty stated that he, as an individual , is also in favor of this District. At this time, Chairman Johnson restated the amendments to the conditions and the Service Plan. (TAPE CHANGE #85-90) At this time, Chairman Johnson reviewed the amendments to the conditions and the Service Plan. Chairman Johnson asked whether anyone requested exclusion from this District. There was no response from the audience. Commissioner Kirby moved to approve the St. Vrain Sanitation District Service Plan as amended and accepted by the applicant, and accept the Resolution submitted by Bond Counsel. Commissioner Yamaguchi seconded the motion which carried unanimously. This Certification was approved on the 23rd day of October, 1985. NOTICE OF HEARING Docket No. 85-72 PUBLIC NOTICE IS HEREBY GIVEN, that there were filed with the County Clerk and Recorder of Weld County, Colorado, a Service Plan and related documents for the proposed St. Vrain Sanitation District. The Service Plan and related documents are now on file in the office of the Clerk to the Board of County Commissioners, 915 10th Street, Third Floor, Greeley, Colorado, and are available for public inspection between 8:00 A.M. and 5:00 P.M. , Monday through Friday. NOTICE IS FURTHER GIVEN that, by Order of the Board of County Commissioners of Weld County, Colorado, a public hearing on said Service Plan and related documents will be held at the Centennial Building, 915 Tenth Street, Greeley, Colorado, at 2:00 P.M. , on Wednesday, the 16th day of October, 1985. The purpose of the hearing shall be to consider the adequacy of the Service Plan of the proposed St. Vrain Sanitation District and to form a basis for adopting a Resolution approving, conditionally approving, or disapproving the Service Plan. The proposed St. Vrain Sanitation District is located entirely within Weld County, Colorado, and is described in Exhibit "A" attached hereto. Pursuant to Section 32-1-202, C.R.S. , the Service Plan may not be approved if a petition objecting to the Service Plan and signed by the owners of taxable real and personal property, which property equals more than fifty percent of the total valuation for assessment of all taxable real and personal property to be included in the District, is filed with the Board of County Commissioners no later than ten days prior to the hearing, unless such property has been excluded by the Board of County Commissioners under Section 32-1-203 (3.5) , C.R.S. Pursuant to Section 32-1-305(3) , C.R.S. , the owner of real property within the proposed District may file a petition with the District Court in and for Weld County, stating reasons why said property should not be included with the proposed District and requesting that such real property be excluded therefrom. Such petition shall be duly verified and shall describe the property sought to be excluded. The District Court will hear said petition and all objections thereto at the time of the hearing on the petition for organization and shall determine whether, in the best public interest, said property should be excluded or included in the proposed District. C.R.S. for a proposed sanitation district be recommended favorably to the Board of County Commissioners for the following reasons: Based upon the review criteria set forth in Section 4. 32-1-203 (1) , CRS, the Weld County Planning Commission recommends conditional approval of the sanitation service district. It appears that adequate service is not available to the district area through the County or other municipal corporations within a reasonable time and on a comparable basis. The facility and service standards of the proposed special district car be made compatible with the facility and service standards of the County and with the city of Longmont. Conditions addressing facility and service standards are listed below. Conditions listed below appear to make the proposed sanitation district in substantial compliance with the Weld County Comprehensive Plan. The proposal appears to he in compliance with the regional long-range water quality management plan for the area. Tn a letter dated September 20, 1985, the Larimer-Weld Regional Council of Governments' 208 Water Quality Advisory Committee approved the sanitation district concept. The creation of the proposed sanitation district in accordance with the conditions listed below will be in the best interests of the area proposed to be served. 1 . The following additional information shall he submitted as part of the St. Vrain Sanitation District Service Plan application prior to filing the application in District Court. The additional information shall be reviewed by the Weld County Department of Planning Services and presented to the Weld County Planning Commission for its review and recommendation to the Board of County Commissioners. The intent of scheduling additional public meetings is to review the adequacy of the additional information before the Planning Commission and Board of Commissioners. The additional information shall include: St. Vrain Sanitation District Service Plan October 1, 1985 Page 2 A. Sufficient transportation data and analysis on Weld County Roads and State Highways in order to identify the potential demands on the State Highway and Weld County Transportation Systems. The data shall describe the total county road network that the district will impact. The present traffic characteristics of County roads within the network: average daily traffic generation rates, the present traffic capacity, road characteristics, and land use. The data shall also describe constraints on development such as the lack of continuous frontage on 1-25, the limited availability of access to State Highway 119 and the expected impact to the interchanges at I-25 and State Highway 119. B. Sufficient information and long-range plans shall be provided to determine any necessary requirements to make the sanitation district's facilities compatible with the city of Longmont's wastewater transmission facility. The sanitation district's facilities shall be consistent with the expansion of future municipal wastewater treatment facilities. C. Representatives of the St. Vrain Sanitation District shall be responsible for preparing and presenting an annual financial and population report to the Weld County Planning Commission and Board of County Commissioners. D. Representatives of the St. Vrain Sanitation District shall appear before the Weld County Planning Commission and Board of County Commissioners to discuss the district impacts on County Roads and police services when the population equivalent growth projection of the district reaches 5,000. The growth equivalent table on page 23, Design Criteria in the application materials shall be used to determine population projections. The intent of these meetings will be to determine whether or not it is appropriate for the sanitation district to expand to a metro district and address the need for additional public services. Representatives of the sanitation district shall proceed with a metro district application according to state law if it is determined jointly by the Board of County Commissioners and the District's Board of Directors that there is a need for such a district. Dated the 2nd day of October, 1985. coma Bobbie Good Secretary ADDITIONAL COMMENTS St. Vrain Sanitation District The policies set forth on pages 91 and 92 of the Weld County Comprehensive Plan for review of sanitation districts were used to evaluate if the proposal was in substantial compliance. Those policies are: 1. Any development that will create an undue burden on existing public facilities and will diminish the capacity of public agencies to maintain the existing level of service shall he discouraged; 2. All new development shall have complete and adequate utilities and public services. Tap fees, service charges, and tax revenues from all new developments shall be sufficiently high to properly protect the existing users from an increased cost due to the added demands upon the system; 3. Proliferation of service districts shall be opposed while consolidation of existing service districts shall be encouraged when it tends to improve the efficiency and economy of the service; 4. Regionalization of services and facilities shall be opposed if it will lead to growth which is not compatible with the desires of the towns involved. Based upon a review cf the application materials and comments from referral entities, the Department of Planning Services has determined that the district will have an impact on the present and future level of public services to the area. With the population estimates already submitted, the planning staff feels that the required increase in public services can be reasonably accounted for if the traffic information requested in condition I (a) is provided. The information will help those responsible for evaluating road conditions and levels of service, identify the potential demands on the transportation systems. Also, the information would be useful to decision making authorities in attempting to establish a fair and acceptable procedure for measuring additional public service impacts and costs when reviewing separate land use applications associated with the district. In a letter dated September 17, 1985, the City of Longmont expressed concerns regarding the compatibility of its waste water treatment facility with the district's facility. Condition 1 (B) in the staff comments addresses this concern. Additional Comments St. Vrain Sanitation District October 1, 1985 Page 2 Also, the City of Longmont has expressed concerns about the area remaining agricultural and that future urban development along I-25 and State Highway 119 may interfere with its plans for the area. In order to insure future annexation, if it is ever practical, the Weld County Department of Planning Services will continue to refer land-use applications within the sanitation district for review and comment to the City. Comments by City of Longmont representatives relating to planning, public safety, streets, utilities, open space, and building construction will be brought to the attention of the Planning Commission and Board of Commissioners for review and consideration. The conditions from State Highway 66 to State Highway 119 along T-25 are beginning to change from agriculturally related industries to more commercial , industrial, and residential type development. In addition to the approximately two hundred acres of existing commercial, industrial , residential, and recreational development in this area, approximately nine hundred acres have been zoned from agriculture to more urban-type uses in the past few years. LaVern Nelson, P.E. , Nelson Engineers, reported the sanitation district is quite flexible in size and can be added onto as the need from additional commercial, industrial, and residential uses is established. Sufficient information and long-range plans shall be provided to determine any necessary requirements to make the sanitation district's facilities compatible with the city of Longmont's wastewater transmission facility. The sanitation district's facilities shall be consistent with the expansion of future municipal wastewater treatment facilities. The third paragraph of Condition D. was amended to read as follows: Representatives of the sanitation district shall proceed with a metro district application according to state law if it is determined jointly by the Board of County Commissioners and the sanitation district board of directors. Condition E. was added to read as follows: D. The petitioners shall submit as part of the sanitation district application, plans for describing the pretreatment plan for accepting industrial waste. The following additional information shall be submitted as part of the St. Vrain Sanitation District Service Plan application prior to filing the application in District Court. The additional information shall be reviewed by the Weld County Department of Planning Services and presented to the Weld County Planning Commission for its review and recommendation to the Board of County Commissioners. The intent of scheduling additional public meetings is to review the adequacy of the additional information before the Planning Commission and Board of Commissioners. The additional information shall include: A. Sufficient transportation data and analysis on Weld County Roads and State Highways in order to identify the potential demands on the State Highway and Weld County Transportation Systems. The data shall describe the total county road network that the district will impact. The present traffic characteristics of County roads within the network: average daily traffic generation rates, the present traffic capacity, road characteristics, and land use. The data shall also describe constraints on development such as the lack of continuous frontage on I-25, the limited availability of access to State Highway 119 and the expected impact to the interchanges at I-25 and State Highway 119. B. Sufficient data shall be provided to determine any necessary requirements to make the sanitation district's wastewater facility compatible with the city of Longmont's wastewater treatment facility. The intent of these meetings will be to determine whether or not it is appropriate for the sanitation district to expand to a metro district and address the need for additional public services. Representatives of the sanitation district shall proceed with a metro district application according to state law if it is determined that there is a reed for such a district by the Board of County Commissioners. ADDITIONAL COMMENTS St. Vrain Sanitation District The policies set forth on pages 91 and 92 of the Weld County Comprehensive Plan for review of sanitation districts were used to evaluate if the proposal was in substantial compliance. Those policies are: 1. Any development that will create an undue burden on existing public facilities and will diminish the capacity of public agencies to maintain the existing level of service shall be discouraged; 2. All new development shall have complete and adequate utilities and public services. Tap fees, service charges, and tax revenues from all new developments shall be sufficiently high to properly protect the existing users from an increased cost due to the added demands upon the system; 3. Proliferation of service districts shall be opposed while consolidation of existing service districts shall be encouraged when it tends to improve the efficiency and economy of the service; 4. Regionalization of services and facilities shall be opposed if it will lead to growth which is not compatible with the desires of the towns involved. Based upon a review of the application materials and comments from referral entities, the Department of Planning Services has determined that the district will have an impact on the present and future level of public services to the area. With the population estimates already submitted, the planning staff feels that the required increase in public services can be reasonably accounted for if the traffic information requested in condition 1 (a) is provided. The information will help those responsible for evaluating road conditions and levels of service, identify the potential demands on the transportation systems. Also, the information would be useful to decision making authorities in attempting to establish a fair and acceptable procedure for measuring additional public service impacts and costs when reviewing separate land use applications associated with the district. In a letter dated September 17, 1985, the City of Longmont expressed concerns regarding the compatibility of its waste water treatment facility with the district's facility. Condition 1 (B) in the staff comments addresses this concern. Additional Comments St. Vrain Sanitation District Also, the City of Longmont has expressed concerns about the area remaining agricultural and that future urban development along I-25 and State Highway 119 may interfere with its plans for the area. In order to insure future annexation, if it is ever practical, the Weld County Department of Planning Services will continue to refer land-use applications within the sanitation district for review and comment to the City. Comments by City of Longmont representatives relating to planning, public safety, streets, utilities, open space, and building construction will be brought to the attention of the Planning Commission and Hoard of Commissioners for review and consideration. The conditions from State Highway 66 to State Highway 119 along I-25 are beginning to change from agriculturally related industries to more commercial, industrial , and residential type development. In addition to the approximately two hundred acres of existing commercial, industrial, residential, and recreational development in this area, approximately nine hundred acres have been zoned from agriculture to more urban—type uses in the past few years. The sanitation district appears to be a missing link in the completion of this land use transition. The surrounding area population projections are provided on page 19 of the same section. For comparative purposes, the total population of unincorporated Weld County is approximately 36,000. As explained in the third paragraph on page 14 of the "General Overview Section," all services are available to the area except public sewer. It appears that those responsible for forming the district are depending on the County to accept responsibility to provide principal services such as police protection, road maintenance, and road construction to the more intensive "urban type" uses proposed for development within the district. Given the County's tax limitations as set forth by Section 14-7 of the Home Rule Charter, at what point should the County consider the expected role it is to play in providing public services to the district? (A discussion on Section 14-7 of the Home Rule Charter is included with this summary packet.) Should the County discuss and review public service concerns and requirements as it considers land-use applications within the district from individual property owners one case at a time? If cases are reviewed separately, at what point would the County determine it is necessary to form additional service districts because of impacts to the Sheriff's Department and the road and bridge program? Who would assume the responsibility for the formation of additional service districts? The remaining balance of land is used agriculturally or for sand and gravel mining. Prior to permitting extensive development of the district, should the County require the applicants to provide an assessment of service responsibilities that will occur as a result of development within and around the district? Would a complete evaluation of the proposed development within and around the service district help the County identify public service impacts and delegate responsibility to those creating the additional impacts? Should the applicants attempt to coordinate with other entities such as the Longmont Fire District and the St. Vrain Valley School District to evaluate their service capacities? Should the applicants and the County attempt to coordinate with the concerns of the Division of Highways as explained in its letter dated September 3, 1985? (Letter in summary packet.) Should the applicants and the County attempt to coordinate with the concerns of the city of Longmont as explained in its letter dated September 17, 1985? (Letter in summary packet.) 32-1-203. Action on service plan - criteria. (1) The board of county commissioners of each county which has territory included within the proposed special district, OTHER THAN A PROPOSED SPECIAL DISTRICT WHICH IS CONTAINED ENTIRELY WITHIN THE BOUNDARIES OF A MUNICIPALITY, shall constitute the approving authority under this part 2 and shall review any service plan filed by the petitioners of any proposed special district. (2.5) The board of county commissioners may disapprove the service plan if evidence satisfactory to the board of any of the following, at the discretion of the board, is not presented: (a) Adequate service is not, or will not be, available to the area through the county, other existing municipal or quasi-municipal corporations, including existing special districts, within a reasonable time and on a comparable basis; (b) The facility and service standards of the proposed special district are compatible wi:h the facility and service standards of each county within which Cho proposed special district is to be located and each runicipality y,hich is an interested party under section 32-1.-204 (1); (c) The proposal is in substantial compliance with a master plan adopted pursuant to section 30-28-106, C.R.S. ; (d) The proposal is in compliance with any duly adopted county, regional, or state long-range water quality management plan for the area; (e) The creation of the proposed special district will be in the best interests of the area proposed to be served. (5) In the case of a proposed hospital district, submission to the board of county commissioners by the petitioners of a certified copy of cn approved certificate of public necessity issued by the health facilities review council of the department of health shall constitute compliance with subsections (2) and (2.5) of this section. SECTION 5. 32-1-203 (2), Colorado Revised Statutes, as amended, is REPEALED AND REENACTED, WITH AMENDMENTS, to read: 32-1-203. Action on service plan - criteria. (2) The board of county commissioners shall disapprove the service plan unless evidence satisfactory to the board of each of the following is presented: (a) There is sufficient existing and projected need for organized service in the area to be serviced by the proposed special district; (b) The existing service in the area to be served by the proposed special district is inadequate for present and projected needs; (c) The proposed special district is capable of providing economical and sufficient service to the area within its proposed boundaries; (d) The area to be included in the proposed special district has, or will have the financial ability to discharge the proposed indebtedness on a reasonable basis. TAX LIMITATION AND HOW IT IMPACTS PLANNING CONSIDERATIONS The Weld County citizens voted in favor of home rule county government on September 9, 1975. The consensus was that home rule offered such advantages as greater responsiveness through local control, broader representation and opportunities for increased efficiency and economy of county government. Section 14-7, Limitation on Annual Tax Levy, is one of the most significant local control concepts implemented with the adoption of the Weld County Home Rule Charter. The limitation imposed by Section 14-7 of the Home Rule Charter is as follows: Section 14-7 -- Limitation on Annual Tax Levi (1) Limitation. Except as otherwise provided herein, all ad valorum tax levies for county purposes, when applied to the total valuation for assessment of the County, shall be reduced so as to prohibit the levying of a greater amount of tax revenue than was levied from ad valorum taxation in the preceding year plus five per cent (5%) except to provide for the payment of bonds and interest thereon. (2) Increased levy -- procedure. (a) If the Board be of the opinion, the amount of tax limited by the preceding section will be insufficient for the county needs for the current year, it may submit the question of an increased levy to the County Council, and the County council shall examine the needs of the County and ascertain from such examination the financial condition thereof, and if in the opinion of a majority of the County Council that the County is in need of additional funds, the Council may grant an increased levy for the County in such amount as it deems appropriate, and the County is authorized to make such increased levy. However, no such excess levy shall be granted which will allow a greater revenue than would be produced by applying the previous year mill levy to the current years assessed valuation. (b) In case the County Council refuses or fails within fifteen (15) days after submission to it of an adopted budget to grant such increased levy, or all of it, or in the event an increase beyond that which the council is authorized to grant is sought, the question may be submitted to the qualified electors of the County at a general or special election called for that purpose. 3 (c) Due notice of submission of the question of whether to grant the increase levy shall be given by the County clerk for at least thirty (30) days in advance of the date set for the general or special election by giving a public notice as provided herein. If a majority of the votes cast at any such election is in favor of the increased levy as named in said election notice, then the County may make such increased levy. (d) In the event such increase shall be voted by the electors under the preceding subsections, the increased revenue resulting therefrom shall be included in determining the five per cent (5%) limitation in the following year. In the simplest terms, the impact of the limitation means that the County Commissioners are limited in raising property tax revenues to the preceding year's property tax revenue from ad valorum taxation of all county funds plus 5%. In the event the Board of County Commissioners wishes to exceed this limitation they may request approval from the County Council to exceed the 5% limitation up to an amount equivalent to the preceding year's mill levy times the current year's assessed valuation. In short, the Council can allow the property tax revenues to increase to an amount equal to the increase in assessed valuation annually. The Council's authority only comes into effect if the current year's assessed valuation through growth andiur reappraisal exceeds a 5% rate. The Board can take any mill levy increase to the voters in the event the Council denies an increase or if the increase that is requested is beyond the authority of the Council's limitation. Other counties in the state are limited by state statute to a ='% limitation. However, the state 7% limitation provides for the prior y?3r r-Dpert} tax plus 77, plus any growth attributable to "now construction". The key difference is that Weld County's limitation does not provide a "growth factor" to accommodate economic growth in the county by increasing property tax revenue that may he generated by the new assessed value attributed to growth. Absent in the Home Rule Charter limitation is any growth factor similar to what exists in the state statute. The 7% state property tax limitation defines growth as follows: Growth shall be defined as the increased valuation for assessment attributable to annexation or inclusion of additional land, the improvements thereon, and personal property connected therewith within the county for the preceding year; the increased valuation for assessment attributable to new construction and personal property connected therewith within the taxing district for the preceding year; the increased valuation for assessment attributable to increased volume of production for the preceding year by a producing mine if said mine is wholly or partially within the county and if said increase in volume of production for the preceding year by a producing mine if said mine is wholly or partially within the county and if said increase in volume of production causes a change in services or an increase in the level of services provided by the county; and the increased valuation for assessment attributable to previously legally exempt federal property which becomes taxable. 4 The impact of the Charter 5% limitation in a time of economic growth in the County is to lower the mill levy to all property owners, instead of capturing any of the added revenue potential from the new construction which would help pay for the added county services required. A Home Rule County by law must take the most restrictive of the state statute or home rule restrictions. The home rule limitation becomes even more restrictive as the state legislature provides property tax "safety valves" such as HB 1405 passed in 1983, allowing counties to exceed the 7% limitation for capital projects, such as jails and roads. Weld County cannot use the relief due to the Home Rule Charter 5% limitation. The county mill levy has been lowered consistently since the adoption of the charter. The mil levy was 25.82 in 1975. The mill levy in 1985 is 19.342. The growth of the county's property taxation has been effectively limited by Section 14-7 of the Home Rule Charter. The background information presented on the Home Rule Charter and its tax levy limitation helps to explain the critically important relationship between the charter, the Comprehensive Plan, and growth in Weld County. The county does not receive any additional property tax revenue from the taxes assessed to new industry and development. The additional assessed value attributed to new development and industry results in lowering the taxes paid by all Weld citizens, but limits the county in obtaining added property tax revenues to support the costs of county services required by the new growth. The county is not relieved of its responsibility to provide services to new growth by the fact that it does not receive additional income when growth occurs. The county must still allocate funds to provide many services because of legislative mandates or because the services are inherently county wide in scope. The county's ability to provide services under the existing budget limitations is decreased significantly by the combined effects of inflation, growth, and budget reductions at the federal and state levels. Since the adoption of home rule, annual inflation for the nation has averaged just under eight percent. In addition, Weld County's population has increased an average of four percent a year. As one can see, restrictions are severe. The current economic, legislative, and growth conditions are not conducive to meeting all the needs and demands being placed upon local government. As long as Weld County is responsible for the delivery of human services, including police protection and the maintenance of the extensive road and bridge program, the cost of county government will continue to increase this year and in future fiscal years. It lies at the con- junction of two important arteries of transportation: Colorado Highway 119 and Interstate 25 . Just as early settlers followed the trails of the fur traders along the Platte River and its tributary, the St. Vrain, present day development has generally followed the modern paths of trade and commerce. Interstate 25 connects the dynamic Front Range metropolitan areas stretching from Colorado Springs to Fort Collins . Colorado Highway 119 bonds Longmont and Boulder to 1-25 . The area now includes such diverse development as two motels, a dairy produce outlet, gravel mining, a retail liquor store, automotive and truck services, restaurants, residential mobile homes , a wholesale building supply and salvage outlet, light manufacturing, a state recreational area, and a farm-implement auction house. Recently, a proposed horse-racing facility has been approved by Weld County. Presently, four privately owned individual sewage systems are in service, none of which is available for usage by others . The systems have had a poor performance record concerning compliance with public health requirements for various reasons. In addition, there are numerous septic tank and leach field systems contributing to ground water degradation and pollution due to the high water table in the area. All other utility and personal services are "in place" and currently serve the area: Water, electricity, gas, telephone, school, fire protection, and ambulance. Future development (regardless of whether it is commercial, industrial, or residential ) is hampered by the lack of an adequate unitary sewer sanitation system. The petitioners thus propose the creation and formation of the St. Vrain Sanitation District to provide for the public health and general welfare of the inhabitants of the area and of Weld County by: - Eliminating the need for private, independent and inefficient sewage systems; - protecting the water quality of both the St. Vrain River, a tributary of the Platte, and the ground water in the area; and - providing Weld County with the basis for planned, orderly development in the Del Camino area. When formed, the St. Vrain Sanitation District will create bonded indebtedness in the initial estimated amount of $3 , 305 , 000 to be paid from a mixture of property taxes and sales of service taps. A modern and efficient "lagoon type" treatment facility will be constructed with sufficient capacity to service existing and foreseeable needs and designed for future expansion, if required. A disinfection system to comply with stream standards will also be installed. As required by state statute, the District will be governed by a five member elected board of directors which will administer the affairs of the District consistent with county and state health requirements, state statutes , and in accordance with this service plan. The following Exhibits set forth the specific information required by state statute and demonstrate: - that there is sufficient existing and projected need for organized service in the area; - that the existing service in the area is inadequate for present and projected needs ; - that the proposed special district is capable of providing economical and efficient service to the area • and - that the area will have the financial ability to discharge the proposed indebtedness on a reasonable basis . Tanaka 40 Inverness Drive East Englewood, Colorado 80112 -3- EXHIBIT B DESCRIPTION OF SERVICES DESCRIPTION OF SERVICES TO BE PROVIDED Once formed, the St. Vrain Sanitation District intends to provide for the acquisition, construction, completion, installation , and/or operation and maintenance of a complete local sanitary sewage collection transmission and treatment system. The system may include, but shall not be limited to, collection mains and laterals , transmission lines, lift stations (if necessitated ) and all appurtenant facilities, a sewage treatment facility, all required land easements, and rights-of-way. Pursuant to Section 32-1-103 ( 18 ) C.R.S. , the District may also provide for storm sewers and related flood and surface drainage. The sanitary and/or storm sewer services will be provided within the proposed boundaries of the District (as may be amended by exclusions and/or inclusions ) and without the District' s boundaries pursuant to Section 32-1-1001 (k) C.R.S. , at the discretion of the District' s Board of Directors and in compliance with then-existing and applicable state statutes . -4- EXHIBIT C FINANCIAL ANALYSIS Financial Considerations General After consultation with the engineers, and upon advice of Hanifen, Imhoff Inc. , investment bankers to the proposed District, it has been decided that the improvements to be constructed by the proposed District will be financed by the issuance of general obligation bonds to be authorized and issued in accordance with the authorizing act approved by the Colorado Legislature. The bonds, when issued, will mature in not more than 20 years from date of issuance with the first maturity being not later than three years from their date as required by statute. The proposed maximum interest rate will be 18% and the maximum discount 6% . The exact interest, rates and discounts will be established at the time the bonds are sold by the proposed District and will reflect market conditions at the time of sale. It is proposed that a total of $4 , 750 , 000 of bonds for various purposes will be submitted to the electors of the proposed District. for approval to fund the improvements . The amount to be voted exceeds the amount of bonds to be sold as shown in the attached schedules to allow for unforeseen contingencies and increases in construction costs not contemplated in this Service Paln. Based upon construction estimates as computed during the preparation of the Service Plan, it is anticipated that a total of $3 ,655 , 000 of bonds will be issued based upon 1985 construction costs. The bonds will contain adequate call provisions to allow the prior redemption or refinancing of bonds sold by the proposed District. The amount of bonds sold will be based upon final engineering estimates or actual construction contracts. Organizational costs to include legal fees will be included in the issuance expenses for the first bond issue. The proposed District will have as a source of revenue to retire the bonded debt, sewer tap fee charges and in addition, a mill levy assessed on all taxable property in the service area, which is estimated at an average of 10 mills throughout the bond repayment period. This mill levy may vary depending upon the elected board' s decision to fund the projects contemplated in the Service Plan. In addition, from the proceeds of the bonds , the proposed District will capitalize interest from the series of bonds to permit payment of interest during the time lapse between development of taxable properties and certification of this development on the tax rolls . Interest income through the reinvestment of construction funds, capitalized interest and annual tax receipts will provide additional income to meet operational expenses. -5- Cost Summary and Bond Development The following schedules reflect the amount of bonds to be sold to finance construction costs, including related expenses of the sale of bonds. For the purpose of calculation, and upon advice of Hanifen, Imhoff Inc. , interest rates have been assumed to be 10% or the projected bond issues. Projection of Assessed Valuation For purposes of developing the financial plan, it was assumed that living units and commercial development within the proposed District would be assessed at various percentages depending upon the year of construction. It is also assumed that the assessed valuation will be realized one year after construction and that tax collections will be realized two years after initial construction. Cash Flow Schedule The cash flow schedule projects the anticipated flow of funds and is based upon estimates of construction and project needs for bond financing to finance the proposed District' s improvements . VRAIN SANITATION DISTRICT PREPARED BY NELSON ENGINEERS GREELEY, COLORADO JULY, 1985 D- I GENERAL OVERVIEW ST. VRAIN SANITATION DISTRICT SECTION I General Scope of Report • This report prepared by Nelson Engineers, is a preliminary engineering feasility study. It has been prepared to furnish all interested parties in the vicinity of the proposed district; the Weld County Commissioners ; the health department of Weld County, Larimer-Weld Regional Council of Governments, and the Colorado Department of Health; and investors with engineering information pertinent to the creation of a sanitation district in the proposed St. Vrain Sanitation District. During the preparation of the report we have performed preliminary site inspections, evaluated service areas, and completed preliminary designs and cost estimates. Every effort has been made to create a sanitary sewer system with the greatest flexibility and capacity to serve the area while recognizing the constraints of bonding capacity that exist with the proposed area of service. Exhibit No. 1 shown on the following page provides a vicinity map showing geographically the location of the proposed District. In the course of the study, many meetings have been held by the Steering Committee and its consultants to review and analyze each of the several alternates that were developed for service to the general area, and finally the alternate designed specifically for the area as shown on Exhibit No. 2 . Each of the alternates studied included an area of development, assessed value, growth potential, a sewerage system, cost estimates therefore, and financing evaluations. The initial district, as proposed herein and as described later, is very cost effective and has the potential for expansion as development occurs either in the proposed district or in its vicinity. The knowledge gained from the study of various alternates encompassing larger areas and. greater facilities has provided assurances to the Steering Committee and its consultants, that the most practical and most economical system, with expansion capabilities, has been selected for the initial development of the St. Vrain Sanitation District. There have been many recent changes in the area which result in extensive pressure for development which require all the normal utility services. All services are available except public sewer facilities. The general area along I-25 and the St. Vrain Creek is recognized as needing sanitation facilities to provide for that desired development. Trembly, Water Resources Projects Manager, Larimer-Weld Regional Council of Governments (LWRCOG) , to Rod Allison, Weld County Planning Department, "The Colorado Water Quality Control Commission has policies which discourage the proliferation of small wastewater treatment facilities . The history of small plants in Colorado is fraught with frequent discharge permit violations and poor plant operations, which have lead the Commission to adopt such policies . The Water Quality Commission and Water Quality Division are particularly critical of predesigned-field erected, "package" waste treatment facilities, because of their poor track record of operations in Colorado. " See also Attachment "A" , which is a letter dated July 5 , 1983 , to Chuck Carlson, Chairman Weld County Board of Commissioners from Jonathan M. Rutstein, Executive Director, Larimer-Weld Regional Council of Governments . This letter states in part as follows : "The Committee also wishes to advise Weld County that it will not be in a position to recommend approvals on State Health Department site applications for new or expanded domestic wastewater treatment facilities in the immediate area near the intersection of Colorado Highway 119 and Interstate 25 , until such time as a service plan has been prepared and approved by Weld County and LWRCOG as a part of the 208 Areawide Water Quality Management Plan. " Description of the Area The general area to be served by the proposed improvements is in the vicinity of the intersection of I-25 and Colorado Highway 119 . This area is near the St. Vrain Creek and includes most of the existing development at the intersection of the highways, more commonly known as the Del Camino area. (See Exhibit No. 1 ) . The current development consists primarily of commercial development, which is a service type industry serving the public traveling through the area and the local citizenry. There are four privately-owned existing individual sewerage systems within the area, with each serving a separate development. These systems have a history of poor operation due to limited qualified operators, and overloading in some cases. In addition, it is difficult for the local and state health officials to administer to individual systems on a regular basis. There are no public sewage collection lines in the proposed district area . The area is served by other utilities normally required for development. These utility services are as follows : -15- Domestic Water -- Left Hand Water Distict Little Thompson Valley Water District Longs Peak Water District Central Weld County Water District Electric -- Union Rural Electric Association Gas -- Public Service Company of Colorado Telephone -- Mountain Bell Fire -- Longmont Rural Police -- Weld County Ambulance -- Tri-Town and Longmont • School -- St. Vrain REJ1 The area is within the St. Vrain Creek drainage basin on relatively flat lands with a high groundwater table. These conditions are not conducive to the use of septic tank systems because of the presence of groundwater. In addition, much of the land surrounding the area is actually in the Army Corps of Engineers designated floodzone. Several property owners in the proximity of the Del Camino area have expressed interest in developing their lands . Such development may be impossible unless a public sewerage system is established. Some of the proposed development consists of major residential and commercial facilities on land along the east side of I-25 near Colorado Highway 119 and opposite the existing development at the highway intersection. A horse racing track with associated development, a major residential development project, and a recreational area development with associated housing construction are all proposed for the area immediately north of the St. Vrain Creek on both sides of I-25 . Also, to the west along Highway 119 , there is proposed a large mobile home and low cost housing development. Although the initial district may not include all of these proposed development areas, they are in the common drainage basin, and can be readily served by the District as the need is established and as adequate financing becomes possible. The Del Camino area and the environs is included as a unit area in the Larimer-Weld Regional Council of Governments Water Quality Management Plan. Such designation results from the fact that the area is served readily by a common drainage basin, which facilitates the development of a sewerage system. The LWRCOG staff states that the 1978 208 Areawide Water Quality Management Plan is outdated and is presently being revised and that the service plan for the "Del Camino" area would fit into that revision. The LWRCOG recognizes a need for public sewer in the area as a result of the extreme pressure of development there. The LWRCOG also recognizes that sewerage service is not -16- readily available from any existing entity because of either distance, topography, or both, and the resultant high cost of service. The Weld County Comprehensive Plan is more than 10 years old and is outdated in some respects . That plan recommends agricultural uses without any qualifications in the general area of the proposed District. Yet considerable spot zoning has already occured. Additional developments have been approved in the vicinity such as the race track facility and added • agriculturally oriented businesses, with the potential to generate considerable sewage wastes . To this time there is no comprehensive plan which incorporates sewage waste treatment and acknowledges the extensive changes in land use that have and are occuring in the general vicinity. The following is an excerpt from a recent report developed by the Larimer-Weld Regional Council of Goverments : "Another area currently being considered for significant proposed development is in the vicinity of the intersection of I-25 and State Highway 119 , commonly referred to as the Del Camino area. This area is within the St. Vrain Creek drainage basin, just east of Longmont. There are four existing developments at this location, each with its own individual sewerage system. They include the Del Camino Restaurant, Texaco Truck Stop, Love' s Country Store, Stuckey' s and the River Valley Village Mobile Home Park . Several other property owners in the proximity have expressed interest in developing their land, and in each case they have been advised that additional individual sewage treatment systems would not be recommended. In particular, a combination commercial and residential development is being considered for land on the east side of I-25 , opposite the Del Camino development. Also, a horse racing track with associated development is proposed on the east side of the Interstate north of St. Vrain Creek, and a residential project would be built on the opposite side of the Interstate by the same developers. As a result of preliminary discussions with the State and County Health Department and Larimer-Weld Regional Council of Governments, property owners in this area have begun the process of forming a special district which could plan, construct, and operate a wastewater collection and treatment system. To be called preliminarily the St. Vrain Sanitation District, this entity should be formed and operational during 1985 . It would then take an estimated additional two years, approximately, to construct the sewers and treatment -17- plant. The plant would be sized to accommodate development envisioned by about the year 2000. The expected operation would provide good secondary treatment with discharge to St. Vrain Creek. A temporary plant might be required to serve the racetrack if it proceeds on its plan to develop and become operational in 1986 . This plant would then be abandoned and the track connected to the regional system when it becomes available. " In addition, since the St. Vrain Creek drains a relatively large area surrounding the proposed district, the proposed district could provide service by gravity to a very large area in the drainage basin. The basin, and thereby the district service area potential, extends to Weld County Road 13 on the east, to the top of the ridge and drainage north of State Highway 66 , to the Weld-Boulder County line on the west, and to an almost limitless boundary along Boulder Creek and several miles along I-25 to the South. (See Exhibit No. 2 ) . Although no specific prediction is provided regarding growth rates into such an extensive service area, it is important to note the potential for service of the so-called nucleus or core district as discussed in this report. In a very general overview of the area, the service areas may be predicted as indicated on Exhibit No. 2 . The proposed improvements in this service plan are intended to serve only the properties within the district boundaries , an acea of 2110 acres more or less , as designated on Exhibit No. 2 , and as further detailed on Exhibit No. 4 Although part of the district is within the City of Longmont ' s planning area, no provisions have been made for sewerage service to any part of the proposed district in the immediate or near future. The topograph of the area is not conducive to economical service to this area by the existing sewerage system of the City of Longmont. Because the proposed District is downstream from Longmont' s sewerage system, sewer service by the City of Longmont would require either the installation of considerable amounts of sewer lines including a pumping station and force main to pump sewage upstream to the existing system, or the moving of at least part of the existing sewage treatment system downstream from its present location to intercept gravity sewer flows from any or all of the proposed district. As a result, any extension of service to the district by Longmont at this time would be less cost effective than the service to be provided as part of this service plan. A part of the proposed District is within the planning area of the Weld County Tri-Area Sanitation District. A review of the plans of that district show no conflict with its master plan or area of service. The engineer engaged by the district, John Burgeson of RED Engineering, Inc. , informs that there are no plans to provide -18- service north of the north line of Section 19 , Township 2 North, Range 67 West, and Section 24, Township 2 North, Range 68 West. That line is south of the proposed District boundary and higher in elevation. There are presently plans underway for significant capital expenditures to improve the operation and treatment. capability at the existing Tri-Area sewage treatment facility. Should either the City of Longmont or the Weld County Tri-Area desire to serve any of the proposed District area, and such service is deemed feasible, the St Vrain Sanitation District may enter into an intergovernmental agreement therefor. THK Marketing Analysis In preparation for development of this service plan, land- owners in the proposed district retained the firm of THK Associates, Inc. , of Englewood, Colorado to prepare a "Market Analysis" for the proposed district. That analysis is an extensive study of growth trends and land uses in the North Denver/Weld County Area, and has been used as a resource material for this service plan. The THK study encompasses 4 , 325 acres in the vicinity, a larger area than that proposed for the initial district. It discusses the general area from a philosophical viewpoint and a statistical basis . ( See Exhibit No. 3 ) . The projected regional growth trends and "Capture Rate" by the Del Camino area of all development in the North Denver/Weld County area as derived in the THK report are accelerated when compared to past and present conditions. The actual growth and development may be limited by the current financial capability of the area ; however, the THK analysis does point out the extensive potential and pressure for growth in the vicinity of the proposed district. Such growth results in the immediate need for the development of an adequate sewerage or wastes handling system, since all other utilities are already available in the immediate area. The THE report delineates various land uses in the area . It provides a "Conceptual land use plan" , which outlines how the various acreages can be expected to develop and the related density of use. That plan has been used in this service plan to establish a growth projection from the projected land uses of areas within the initial district. The THK report further projects a population (including an assigned population equivalent for commercial, office, and industrial uses ) of 49 , 500 for its 4, 325 acre area of study. Nearly 40% of the acreage analyzed is in open space, public rights-of-way, ditches, and waterways. The area within the initial district is relatively flat and has a high groundwater table. As a result, the layout of the sewer system is somewhat restricted . Because of the high ground- water table, few basements or other underground structures are anticipated. Except for the area immediately adjacent to the intersections of 1-25 and Colorado Highway 119, the district is very sparsily populated at this time (see Table No. 2 ) . Although extensive development seems imminent, until a financial base is established, only a nucleus district can be established. Then as a need arises in an area outside the district, the sewer services can be expanded to meet that need so long as such service is feasible. It is expected that the early major development will occur in close proximity to the existing highways, those being I-25 , and Colorado Highways 119 and 66 . The location of these roadways are shown on the various exhibits . In each instance of sewer line extension that includes highway crossings, a boring will be required . Such crossings are expensive. As a result of these factors, the highways and the current roadway systems do materially influence the location and cost of the individual sewer lines . A number of other subsurface and surface obstructions are anticipated in the proposed construction projet. These are canals, ditches, gas and oil pipelines, power lines , domestic water lines , and other utility lines as well as the roadways already mentioned. -20- D- 2 DESIGN CRITERIA SECTION II Design Criteria Description of the District The proposed area for the initial development of the St . Vrain Sanitation District is shown on Exhibit No. 4 . It encompasses 2110 acres more or less with its primary contributors those existing within the Del Camino area. Most of the property owners have indicated a desire to avail themselves of a sanitary sewer system. Most of the area is represented to have great pressure for future uses other than agriculture. The area included in this Service Plan can readily be served by the proposed system. The legal boundary description of the proposed district within which initial sanitary sewer service will be provided is attached hereto. Assessed Valuation The assessed valuation of the proposed district was obtained from the records of the Weld County, Colorado assessor. The values used are taken from the 1984 records, the latest available at this writing. The total estimated 1984 assessed valuation of the proposed district area is $1, 451, 073 . Area Growth - According to the population records of Weld and Boulder Counties, the current annual rate of change of population is 2. 5% and 3 . 2% respectively, for the period from 1970 to 1984 . According to the same data, the highest annual growth rate in the metropolitan vicinity occurred in Douglas County, which had a 10 . 7% growth rate per year. Both Adams and Weld Counties had a 2 . 5% change, the lowest rate of the nine metropolitan counties except Denver County, which had a zero growth. As the THK report points out, the district is destined to grow more rapidly than surrounding areas, especially when a solution to handling domestic wastes is provided. According to the THK report, the rapid growth will occur because of the following major factors : 1. Excellent north/south access via I-25 , which bisects the site. 2. Excellent east/west access via Colorado Highway 66 and 119 . -21- 3 . Close proximity to metropolitan Denver and Stapleton Internation Airport. 4 . Close proximity to major employers (strong corporate base ) . 5. Exceptional potential for industrial growth due to location and access. 6. Good labor market. • 7. Office development demands resulting from employment growth. 8 . Outstanding geographic attributes of the site. It is unreasonable to expect 100% development of the district area within the design period of 20 years; however, it is reasonable to expect some development outside the boundaries of the initial district to occur that would be dependent upon this district for sewerage services . Population Equivalents The population of the district has been determined by using base criteria as follows : 1. The THK study regarding future growth and proposed zoning. 2. Landowner input regarding their individual development plans and schedules. 3 . Type of development, both existing and proposed. 4 . Establishing population equivalent factors for each type of development. 5 . Existing population. The current population, and for that matter, the projected population is represented primarily by commercial/retail, office, and industrial (COI ) development. The majority of land is recommended for that type of zoning by THK. Such recommendations are supported by the existing development and the landowners proposing to use the new sewer system. To reasonably evaluate the waste loads anticipated, a "population equivalent" (p.e. ) is assigned to the COI type of development. In this analysis a factor of 20 persons/acre of COI -22- development is used to project the p.e. Thus, the waste load of a zoned area is determined by multiplying the acreage by a factor of 20 . The factor of 20 persons/acre is derived from an analysis of existing COI development and represents a reasonable average. Many high density developments in metropolitan areas have much higher factors of p.e. , as do specific types of users generating exceedingly high strength wastes. Other areas in remote locations may be much less than 20 persons/acre. An evaluation of existing COI uses in the Del Camino area based upon land area used, square footage developed, and type of uses seem to confirm the use of a conservative 20 persons/acre as the p.e. for COI development in this general area. For purposes of analyzing other types of growth and determining population, the following rates have been used. These factors have been developed by THK in their extensive study of area growth. Upon application of the above factors to the type and area of development proposed, a reasonable population can be established for facility design purposes. Population After a count of existing units, both residential and other- wise, a current p.e. of 1,774 is estimated for 1985 within the proposed district boundary. Based upon all the foregoing criteria and growth occurs within the proposed District, the following Population Equivalent Growth Projections can be made as shown in Table No. 2 . In this case it is necessary to design based upon the strength of an average domestic sewage; that is a quantity of flow of 100 gallons per capita (or p.e. ) per day, BOD (biochemical oxygen demand) of 250 parts per million, and a suspended solids of 250 parts per millon. There are no wastes expected to be generated in the proposed district that will differ materially from the characteristics described above. By using those characteristics and the population equivalent factor as described earlier, the total waste loads can be determined; however, each new user of the sewage system, especially industrial types, must be carefully evaluated to determine whether or not their waste follows the patterns described herein. Should a waste generator that has a higher strength waste be connected, the service charge and the connection charge must be adjusted in accordance with the waste strength and quantity. Water Quality Objectives There are presently a number of adopted environmental goals which must be recognized in the process of developing a new sewerage system. Applicable goals exist at many levels of government and in several areas of environmental concerns. It is from the Federal level that the primary impetus for more stringent control of water pollution sources has come. Section 101, Declaration of Goals and Policy, of the Federal Water Pollution Control Act of 1972 , states in part: " (a) The objective of this Act is to restore and maintain the chemical, physical, and biological integrity of the Nation' s waters. In order to achieve this objective it is hereby declared that, consistent with the provisions of this Act -- (1) it is the national goal that the discharge of pollutants into the navigable waters be eliminated by 1985 ; ( 2 ) it is the national goal that wherever attainable, an interim goal of water quality which provides for the protection and propagation of fish, shellfish and wildlife, and provides for recreation in and on water be achieved by July 1, 1983 ; ( 3 ) it is the national policy that the discharge of toxic pollutants in toxic amounts be prohibited ; -25- Section 201, paragraph (d ) , of the Act further states : " (d) The administrator shall encourage waste treatment management which results in the construction of revenue producing facilities providing for: (1 ) the recycling of potential sewage pollutants through the production of agriculture, silviculture or aquaculture products, or any combination thereof ; (2 ) the confined and contained disposal of pollutants not recycled; (3 ) the reclamation of wastewater; and, ( 4 ) the ultimate disposal of sludge in a manner that will not result in environmental hazards . " These goals are to be achieved through the implementation of wastewater planning and management techniques , a discharge permit system, and a realistic funding concept. Designated areas within each state must develop plans for the treatment of all waste waters within their boundaries. The St. Vrain Sanitation District is in the South Platte River Basin for which a Water Quality Management Plan exists . Any new facilities in the St. Vrain Sanitation District area must conform to that water quality management plan. The Colorado Water Quality Control Act of 1973 established the apparatus necessary to implement water pollution controls at the state level. This legislation established a State Water Quality Control Commission responsible for the promulgation of water quality standards and control regulations . Following is an excerpt from the legislative declaration of the Act. "It is hereby further declared to be the public policy of this state to conserve state waters and to protect, maintain, and improve the quality thereof for public water supplies, for protection and propagation of wildlife and acquatic life, and for domestic, agricultural, industrial, recreational, and for beneficial uses, to provide that no pollutant be released into any state waters without first receiving the treatment or other corrective action necessary to protect the legitimate and beneficial uses of such waters ; to provide for the prevention, abatement, and control of new or existing water pollution; and to cooperate with other states , and the federal government in carrying out these objectives . " -26- The state is also required to operate a permit system for treatment facilities as specified in the federal legislation. Permits must obtain federal approval with enforcement by both state and federal agencies. All permit holders must maintain a vigorous self-monitoring program to ensure their own compliance to state standards. The permit system is implemented by the Colorado Department of Health. The St. Vrain Sanitation District will be required to obtain a discharge permit. Water quality standards have been adopted for the South Platte River Basin. These standards, effective January 30 , 1984 , vary from segment to segment within the basin. In this report the segment of the St. Vrain Creek from Hygiene Road to the confluence with the South Platte River, is of primary interest. The following Figure No. 2, taken from the published standards, shows the Stream Classification and Water Quality Standards of the pertinent stream segment; that is a Class 2 recreational, Class 1 warm aquatic, and agricultural classification. The standards require that discharges into the stream will not change the conditions beyond those stated. Some of the more common limitations are as follows : Dissolved Oxygen (DO) 5 mg/1 ph 6.5 to 9. 0 Fecal Coliforms 2000/100m1. Ammonia (NH3 ) 0.06 mg/1 Nitrite (NO2 ) 0 . 05 mg/1 The detail of all constituents are shown on Figure 2 . Generally a treatment system including good secondary treatment with chlorination will meet the criteria for waters classified as agricultural. Although the stream classification is not expected to change during the initial 20 year period, it is necessary to design the treatment facility with capability of incorporating advanced treatment methods or equipment without costly or extensive modifications . In the early stages of this proposed system, nitrification will probably not be required to reduce the ammonia-nitrogen concentration. As stated earlier, good secondary treatment with chlorination will generally satisfy the standards, especially when the discharges to the stream are small in comparison to the rate of flow in the stream. As the discharges increase and if the standards change, naturally nitrification will be required, thus giving the system the capability to insure that the ammonia-nitrogen concentration will be reduced. Past legal action by the State Supreme Court of Colorado has prohibited reuse of treated sewage for irrigation purposes. Water that has been used and then treated does not belong to the user but must be returned to the stream, according to the courts . Health Issues As stated earlier, there are four privately-owned existing individual sewerage systems within the area. In addition, there are numerous septic tank and leach field systems. In an area experiencing growth pressures and density of development that exceeds the capabilities of septic tanks and leach fields, a public sewer system of sufficient size to justify continual experienced maintenance is essential. This is the case in the Del Camino area. Although for the most part the individual systems are providing an acceptable treatment and effluent most of the time, the necessary frequent maintenance is lacking. Each official inspection report states a problem such as : 1. Poor or no ventiliation in enclosures. 2. Pump station overflowing. 3. Grinder not operating. 4 . Accumulation of grease in excess of capacity. 5. Outfall to local irrigation ditches. These problems point out the difficulty of operating small systems effectively. As a result, the local and state health departments report a history of poor operation. Those same departments find it difficult to administer to individual systems on a regular basis. Expansion of any of the existing privately owned systems to serve an enlarged area of need does not appear feasible. Many of the present problems of these systems would simply be aggravated. Concentration of septic tanks and leach fields results in contamination of the surrounding soils and/or groundwater. Treatment plant discharges to other than major streams creates the potential for health hazards due primarily to lack of dilution capability. One plant, strategically located, serving an area of impending growth can mitigate most of the health problems associated with domestic waste treatment and disposal. In addition, such a facility is far more economical to build and operate, as well as, being more readily available to good operation and administrative practices. -28- The single public sewerage system serving a common area complies with the stated goals of the Larimer-Weld Regional Council of Governments, the Colorado State Health Department, and the U. S. Environmental Protection Agency. The proposed St. Vrain Sanitation District complies with those agency' s goals. Sewer Design Sewer Pipes - To avoid overloading and prevent surcharging of the lines, it is normal design criteria that all lateral sewers should be designed and reviewed when running full for 400 gallons per capita per day, or nearly four times the anticipated average flow. The trunk and outfall sewers should have a capacity, under the same conditions, of not less than 250 gallons per capita per day, or nearly two and one-half times the anticipated average flow. This criteria, recommended by the Colorado Department of Public Health, has been used for the preliminary design of the sewer system. To further comply with these regulations, certain minimum, or greater, grades must be maintained to provide a minimum velocity in the sewer pipe of two feet per second to avoid settling out of the solids within the sewers. As stated earlier, the general area of the district is relatively flat. For the most part, the sewers are designed using minimum allowable grades, and yet providing for the minimum velocity of two feet per second. So that adequate capacity for future growth is available, the size of trunk sewers have been increased to accommodate the minimum grades and the growth factor. The entire area of the proposed district is subject to a relatively high water table and considerable gravelly soil conditions. The combination results in high cost contruction since it is necessary to dewater all pipe trenches and protect workers from bank caving of the unstable trench sides. Because of the high groundwater table throughout much of the area, little or no basement or other deep construction is expected. Therefore, the sewers can be and have been designed utilizing a shallower depth than would normally be the case. That shallower depth is expected to result in construction cost savings while still providing adequate sewer service to the area. In all cases, the sewer design will comply with the applicable local, state and national published criteria for design of sewers. See Exhibit No. 4 for sanitary sewer layout. Manholes - Manholes will be provided as required where there is a change in grade of the sewer pipe, pipe sizes, or direction . In no case will the manholes be spaced more than 400 feet apart . Most municipal systems normally have manholes at every street intersection. The design of manholes shall conform to the regulations of Weld County, LWRCOG, and the Colorado Department of Health. -29- Pumping Stations and/or Siphons Because of the relatively flat area and high groundwater, it will be necessary to use a pumping station upon crossing of the St. Vrain Creek along State Highway 119 . It is generally preferred to avoid lift stations and siphons because of potential maintenance problems; however, in this system, they will be required but used only when justified to avoid uneconomic deep sewers and to expand needed service area. A pumping station will also be required at the treatment plant entrance. Other pumping stations may be required as the system grows. Location will be dictated by area growth, topography, and service needs. All pumping stations and siphons will be designed and constructed in accordance with the standards of the Colorado Department of Health and other practical considerations. Sewage Treatment Plant Sewage treatment facilities have been designed on a preliminary basis using an average hydraulic flow of 100 gallons per capita per day (gpcd) , and an organic loading of 0 .2 lbs. of BOD per capita per day. Maximum hydraulic flow rates are predicted to be about 150 gpcd, while minimum flow rates are predicted to be about 50 gpcd. These assumed flow rates conform to the design recommendations of the Colorado Department of Public Health and other normal and practical design considerations. During this evaluation, several treatment systems were analyzed. The most practical systems were: 1) the oxidation ditch utilizing surface aerators and settling basins; 2 ) the "so- called" package treatment plant utilizing forced aeration and settling basins, all combined in one tank; and, 3 ) the sewage lagoon with surface aeration and a polishing pond. All three systems would include chlorination facilities. The analysis consisted of evaluating on the basis of treatment results, first cost, maintenance and operations comparisons, longevity of service, and numerous other factors. These factors are shown in the following table with ratings comparisons . A "1" rating represents the best while a "3" rating represents the poorest. As a result, first cost is of utmost importance. In addition, the initial treatment system must operate satisfactorily below its design capacity and must have reasonable expansion capabilities as a result of the small treatment load initially and the expected rapid growth of the district. Study of the foregoing table indicates that the lagoon system seems to serve more of the higher priority factors than the other systems. The basic objection to the lagoon system is the space required. Fortunately there are adequate land areas in the vicinity of the treatment plant site. For these reasons, the designs and related cost factors included in this report incorporate the use of an aerated sewage lagoon with chlorination. The lagoon system will be designed in accordance with published recommendations of the administering health agencies. It will include expansion potential with capability for adding aerators as the area grows. Disinfection facilities will be included. Because the proposed treatment plant site is in the Corps of Engineers designated floodzone, special consideration for flood protection is required. All units, including dikes and tops of basins, will be constructed above predicted flood stage. Adequate riprap and other required flood protection has been included in the construction cost estimates. Period of Design It is generally considered practical that the sewage treatment facilities be designed and constructed for fifteen to twenty years hence, while sewers are designed and constructed for -31- much longer periods. This is true because of the relatively short life of mechanical equipment in the treatment facility, coupled with the problem of operating a treatment facility in its early years, far below its design capacity. On the other hand, because of the long life which is reasonably expected from sewer lines, they are generally designed and constructed for a period in excess of twenty-five years. In this case, as explained earlier, due to minimal current development and the expected rapid growth during the next five to eight year period, the treatment plant is planned for a three stage development during the initial period of 20 years. The cost for the first stage is included in the cost estimates included herewith. The second and third stage developments will occur as needed , as growth occurs, and will be paid from planned surpluses and/or additional bonding at time of expenditure. Sewer line extensions will be provided in accordance with adopted policies of the board of directors. As the district can provide the needed facilities utilizing its financing schedules, it will do so. If funds are not available, developing areas will be required to pay the cost of extensions to serve their needs. The district is committed to cooperate to provide reasonable extensions to serve areas that can be feasibly incorporated into the systems. Stream Standards The Colorado Department of Health through its Water Quality Control Commission has established "Basic Standards and Methodologies" effective January 30, 1984. These standards define the authority, scope, and purpose of the adopted regulations to classify state waters and assigning standards of sewage treatment to maintain and improve the quality of the waters of the state. Any new system must comply with these standards for the area in which the system is installed, as described earlier. The goal of these standards is to insure the suitability of Colorado' s waters for beneficial uses. The standards for the reach of the St. Vrain Creek in the Del Camino area are shown on Figure No. 2 . -32- D-3 PROPOSED IMPROVEMENTS SECTION III Proposed Improvements Collection Sewers The proposed sewerage system layout is shown on Exhibit No. 4 . The sewage collection system will be constructed of polyvinyl- chloride pipe with water tight joints. Once the district is formed and the initial system is in place, users connecting after that time will provide their own sewers connecting to the new system, unless the district has established a surplus for that purpose, or it is in the best interest of the district to issue additional bonds to finance additional extensions. The sewers will be as shallow as practical to reduce the effect of the excessive groundwater throughout most of the area . In areas of high groundwater, deep basement construction needing sewer service generally will not occur. Wherever depth of sewers can reasonably be decreased, less cost will be expected for construction. Pumping Stations A pumping station in the vicinity of Colorado Highway 119 and St. Vrain Creek has been planned and included in the cost estimates. For the reasons stated, a lagoon system has been selected because it best fits the needs and capabilities of the district as they can be determined at this time. The lagoon treatment system will consist of a pumping station, aeration basins using surface aerators, and a chlorination facility including a continuous chlorine feeder and a detention basin. Discharge to the river will be through a measuring and sampling device and an outfall pipe. As described earlier, the treatment system will be constructed in three phases, each with a capacity of about 500 ,000 gpd, which represents a 5,000 population equivalent. Provisions for expansion of the system will be incorporated in the design and construction. Land and Easements Acquisition of land will be required for the sewage treatment plant. A minimum purchase of 20 acres is required to provide the space for treatment and provide a reasonable buffer from adjacent properties . The recommended locations for the treatment plant are shown on Exhibit No 4 ; however, there are other locations that will satisfy the site criteria. Both recommended locations are in the Corps of Engineers designated floodzone; however, they are sufficiently removed from the active floodway so that reasonable riprapping can provide the necessary protection. The locations are in areas of shallow depths of flooding. The district must obtain site approval for the treatment. plant site from the Colorado Water Quality Control Commission. The process of obtaining approval must follow the defined procedures of the commission wherein the commission: 1 ) evaluates suitability of the site through consideration of the local long-range comprehensive plan for the area as it affects water quality and any approved regional water quality management plan for the area; 2 ) determines that the plan on the proposed site will be managed to minimize the potential adverse impacts on water quality; and, 3 ) encourages the consolidation of wastewater treatment facilities whenever feasible. Each application for site approval is evaluated on its own terms, but it must include complete preliminary design data, comprehensive planning information about the area, and facility management considerations. The application, with submittal of technical data, will allow the division staff to evaluate such matters as service area and population, treatment capabilities -34- and alternatives, flood plain information, financial capabilities, and legal and institutional requirements. Also in regard to comprehensive planning, the application forms will require information as to the relation of the proposed facility to existing and regional facilities and require that appropriate local governments and planning agencies have an opportunity to review the proposed project. Easements for sewers will be required for all construction. Every attempt will be made in the final designs to use public rights-of-way whenever possible. During the final design process easements over and across private properties can be obtained. A permanent easement of at least 20 feet should be acquired with a construction easement of at least 60 ' and preferably 80 ' in width. The costs of land and easements are included in the cost. estimates. Summary of Environmental Effects The construction of a this proposed sewerage system with stream discharge and with existing known conditions presents no insurmountable environmental problems. The selected site vicinity for treatment appears to be acceptable. Sewer line construction will be disruptive at the time, but the long term benefits to the environment will be much greater than the temporary problems . The possible secondary impacts of the project as discussed in the following paragraphs, are common to the proposed type of construction. The construction effects of the new treatment facility and trunk sewer lines are minor. Excavation during construction may cause minor erosion, sedimentation and disruption of vegetation. Noise, dust, and aesthetic degradation would also accompany construction activities. The proposed plant site may be subject to flooding. A thorough analysis of that condition must be accomplished prior to final design of the facilities so that appropriate solutions can be included in the design. The primary permanent construction effects of the proposed facilities would be aesthetic in nature. The treatment system will require special consideration to assure a minimum negative visual impact. Appropriate exterior designs and landscaping must be provided. There are no known historical or archeological sites that would be effected by the proposed project. -35- The adverse operational effects of the selected treatment system would be minimal. Utilization of aerated ponds will reduce the space required when compared to non-aerated ponds, and should pose no negative impact on the agricultural area in the vicinity. All present and future stream discharge standards can be met by the facility. The aesthetic character of the St. Vrain Creek would be improved. The proposed system would return all treated wastewater to the stream without significant evaporative loss, allowing for greater water reuse downstream. While sewage collection and treatment facilities in themselves do not cause community growth, they do make it possible when other growth pressures exist. Because of the attractiveness of this district area for development, it is expected that available sewerage facilities will bring more development to that vicinity. The following are negative secondary environmental impacts which could result from expanded sewerage facilities, if preventive measures are not adopted : a. Subdivision development greatly increases the amount of sediment carried into streams and reservoirs, especially on sloping land with inadequate revegetation. b. Some of the region' s productive agricultural land lies within the potential service area of the proposed facility. This resource and its contribution to the local economy could be lost. c. Much of the area' s aesthetic quality is derived from its open and undisturbed character. Residential and commercial development could degrade this aesthetic aspect. d. Rapid development can impose burdens on the community to provide additional public services and facilities . Schools, water systems, streets, police, fire protection, and many other functions would have to be expanded to meet added demands. The project will surely have potentially beneficial secondary impacts on the environment. Sewerage facilities would make it possible to reduce the number of individual septic tanks in the area, thereby reducing the threat of groundwater degradation. In addition, the contribution of the facilities toward eliminating pollutant discharge into the St. Vrain Creek would benefit users of downstream waters. Secondary economic impacts include the creation of additional jobs and the expenditure of additional monies in the area as well as creating a substantial increase in the tax base. -36- Short-Term Use Versus Long-Term Productivity The unavoidable direct impacts of the proposed project are not severe in nature and would not outweigh its environmental benefits. Neither the construction nor the operational effects stated previously would significantly alter the long-term • productivity of the natural environment. By eliminating the discharge of pollutants into surface and subsurface waters, the project would, in fact, increase the long-term productivity of the St. Vrain Creek drainage basin. -37- D-4 COST ESTIMATES SECTION IV Cost Estimates General The following cost estimate is based on current construction bid prices for comparable work. These estimates include costs of major portions of the work and the conditions which might affect the final cost of the work. Engineering design, construction observation, easements, and contingency items are included as thirty percent of the estimated construction cost. Land purchase for the treatment plant site is also included in the estimate. Construction costs in this general area have continued to rise during the past several years. Due to various conditions, such as impending growth and general increases of costs, the construction costs are expected to continue this upward trend. The presented costs are based on 1985 prices. The annual increase is impossible to predict, but based on past performance, the increase will probably range between 5% and 10% annually. Although these estimates represent the best information available, there is no guarantee of the actual costs to be incurred. There may be unforeseen factors that can substantially affect the final costs of construction when considering that the current cost predictions are based on preliminary data at a time many months prior to actual design and construction. Every effort will be made to accomplish a final design commensurate with the financial program that is adopted as a result of the service plan for the St. Vrain Sanitation District. Future Costs This project will probably require sewer extensions at some time in the future, even though the sewage collection facilities included as a part of this total plan are adequately sized for the predicted growth. Such extensions would result from growth in areas not planned for service in this plan. It is impossible to predict where those needs might occur, therefore no cost estimates can be provided. Methods for accommodating these unknowns have been discussed in a preceding section. The project will also require expansion of the sewage treatment facility to keep pace with the projected growth. It is estimated that the first expansion of 500 , 000 gpd will be required in about 1990 at a cost of $1,000,000 , and a second expansion of 500 , 000 gpd will be required in about 2000 at a cost approximating $1,000 , 000 . [SEE ATTACHED AREA MAP.] Recent development activities in this area have focused attention on the need for long-range wastewater facilities and service area planning to accomodate future anticipated growth, and the proliferation of small wastewater treatment facilities to serve individual small subdivisions or commercial . establishments. While there has been development pressure in this general area for some time, the possible location of a new Hewlett-Packard manufacturing facility just inside Boulder County, east of Longmont, has intensified that situation. Weld County has been designated by the Governor of Colorado as a waste treatment management agency pursuant to Section 208 (c)(1 ) of the federal Clean Water Act. In this management agency capacity Weld County has certain responsibilities to ensure coordinated and timely provision of wastewater treatment services to protect water quality. 1eld County should address the issue of wastewater facilities planning for the previously identified area through the preparation of a wastewater services area plan and facilities plan, as more fully set forth in the Larimer-Weld ArPawide Water Quality Management Plan. A summary of these provisions is also attached. Boulder County supports the comments from the City of Longmont in their letter of September 17, 1985 and have the following comments. Section 32-1-207 of the Colorado Revised Statutes describes the methods of modification of a plan. Paragraph (2) states that material modifications of the service plan require approval of the board of county commissioners. These changes are only for changes of a "bask or essential nature" and "shall not be required for changes of a mechanical type necessary only for the execution of the original service plan or for changes in the boundary of the special. district." (emphasis added) • Based on the above language from state statutes, we have been advised that it is possible for a district to be formed and then expand across a county line without review. Boulder County is concerned about this possible expansion for several reasons. The unincorporated portions of eastern Boulder County are designated non-urban on the Boulder County Comprehensive Plan and in most cases are zoned for agricultural or other non-urban uses. Sewer services in this area have not been planned for and may disrupt development patterns in the area. In addition, expansion into the Longmont Service Area may also result in varying levels of service as well as competition for services for residents in the area. Boulder County requests that a condition of approval be made for this proposal that stipulates an amendment to the service plan if the district boundaries are modified. You are hearing today a proposal for creation of a sanitation district in the southwestern portion of the county -- what is commonly called the Del Camino area. The Chamber supports this proposal and asks that you vote to approve formation of the district. Our understanding of state law is that there are four "musts" in terms of criteria the proposed district must satisfy in order to receive your approval . These criteria tend to relate to need and duplicity of service. While health officials are best qualified to speak to health issues , it seems obvious that a proliferation of private septic systems in an area destined for development is undesirable. The sanitation district, then, provides an opportunity to address a need that is already present as well as one that is growing. The privately-funded and operated district also would allow a need to be met without Weld County going into the municipal services business. We fully realize the implications such a district would have on further development in the area. It's hard to pretend the district would not be an encouragement to more development. We recognize, though, that the area really needs no further encouragement in reality when you take into account its location along a major transportation corridor and its proximity to a community of 50,000 people. The wise move, it seems to us, is to prepare for it, to plan for it. This development would have a significant impact on these highways and could require improvements to existing at-grade intersections and interchanges, particularly at I-25 and S.H. 119. The County may want to require a traffic impact study to identify the potential demands on the transportation system. This study could address constraints on development such as the lack of a continuous frontage road on the west side of I-25 and the limited availability of access to S.H. 119 due to its access category. In addition, this service area proposal could be included in the Interstate 25 North Front Range Corridor Study which is currently being undertaken through the Larimer Weld Council of Governments (LWCOG) . We believe that the formation of a district along the I-25 corridor has potential ramifications on the growth and development of the City of Longmont. We also believe that there are several unresolved issues, the resolution of which could affect the development of the St. Vrain Valley. 1. The Weld County Comprehensive Plan designates this area for agricultural uses and states that urban style growth shall occur within or adjacent to existing municipalities. If the purpose of this proposal is to provide the necessary services to support more intensive development, it does not appear to be consistent with the Weld County Comprehensive Plan. 2. The City is concerned about the impact an additional wastewater treatment facility may have on the future expansion of our existing facility. At some point in the future, waste load allocation within the St. Vrain Basin may be implemented. Such allocation may hinder expansion of individual treatment facilities; regional wastewater treatment processes may become a necessity. Our concern, therefore, is that any district should construct its facilities to be compatible with future municipal and regional service. 3. The service plan presented discusses future expansion of the District. Because of our proximity to the district, we are concerned that district expansion might interfere with the growth and development plans of the City. Therefore, we would like to have the opportunity to review with the Weld County Board of Commissioners any expansion of the district. Mr. Rod Allison September 17, 1985 Page 2 4. If a sanitary district is established to support urban level development, we believe that the growth should occur in a logical , rational manner. The eastern "flagpole" extension of the district along SH119 is not con- sistent with rational growth patterns . If there is substantial crowth and development in the Del Camino area, the City would prefer that our entrances remain open and clear without strip development. 5. What are the planned land uses for the area? If more intensive develop- ment is planned for the area, we would like to suggest that a land use plan be done for the district and adopted by Weld County. 6. The provision of certain services and facilities are discussed in the service plan but not all urban services will be provided. We are con- cerned that the residents of this area will use some City of Longmont services, such as the library and parks , without contributing revenue to support them. Because of this area' s proximity to the City of Longmont, development should be required to meet urban level (City) development standards with respect to public safety, streets, utilities, and building construction. This will ensure that if annexation is ever practical it will also be likely to occur, and the County could then be relieved of the burden of providing urban services to this area. An overlay zone could address this specific need. If the Board of County Commissioners believes that the approval of the service plan for the St. Vrain Sanitation District will further the goals and policies of Weld County, the City of Longmont respectfully requests that the following conditions be included: 1. The eastern flagpole extension along SH119 be eliminated. 2. A cooperative agreement be entered into between Weld County and the City of Longmont which would give the City input into the consideration of any expansion of the District. 3. Adequate services be provided to the area to insure that it does not become a burden on the taxpayers of Longmont. 4. Measures be taken to ensure that SH119 remains an attractive entrance to the City of Longmont. 5. Development within the district be required to meet City standards with respect to utilities , streets, building construction, public safety measures , and other infrastructure. Please consider the following comments in your processing of the plan, and I will discuss the matter with our 208 Water Quality Advisory Committee at their next meeting (September 19th) to ascertain if they have any additional concerns to express. On page 27 and again on page 36 there are statements made concerning the levels of treatment which will meet the applicable water ouality standards. Good secondary treatment with chlorination may not be able to meet an effluent limit for ammonia based on the standard of 0.06 mg/1 NH3 and low flows in the creek. This NH3 standard is meant to protect the Aquatic Life Warm Water Class I classified use. In the discussion about sewer construction on page 29 it is mentioned that a relatively high water table exists in much of the area. We recommended that extreme care be given to preventing the infiltration of groundwater into sewers and manholes during the design and especially the construction of the collection system. With these comments for your consideration we support the plan for the creation of the district and provision of the sewerage service. The plan is consistent with our Regional Water Quality Management Plan. Issues that were discussed included the level of treatment that may be required to meet permit limits and protect St. Vrain Creek, the limits or boundaries of other entity service areas, and the need for careful planning to provide the best long-term regional solution for service to the area. A Final PUD subdivision plat has also been submitted and aporoved on May 24. 1984. This development was oesioned to accornodate domestic water from Little Thompson Water District and sewer service through individual sewage systems. Recently, plans for creation or the St. Vrain Sanitation District nave come to our attention. Although we are not currently a part of the group proposing the creation of this District, we would like to express our desre to encourage the Planning Commission and Board of taunty Commissioners to approve the creat ion of this District. Hlthouon we can see some opportunity for our project to become a Part of the District at a future date, if economically feasible, we see the real value in the creation of this District in protection the surface waters and ground waters of this general St. Vrain River area. We are all aware of the high ground water table that exists around Del Camino, the number of package wastewater treatment plants, and the number of large commercial septic systems. First and foremost, we believe that the creation of the Sanitation District wit 1 the construct ion of a wastewater treatment plant meeting the high standards of the State Health Department, will ensure continued clean water in the St. Vrain River and the ground water in the vicinity. St. Vrain Sanitation District There is no question that the Del Camino area will develop. The report contained many phrases such as extensive potential , pressure for growth, extensive development seems imminent. Also, the report indicates one of the last stumbling blocks in this development is the availability of sanitary sewers. As I read the service plan and saw the projected growth and population that is anticipated I thought of the demand on the road systems. I am sure the costs to improve just the existing county roads will be as much or more than the approximately 2.7 million dollars it will cost to construct the sewer system. The only county road in the area that is paved is county road 24 running east of the Interstate 25 and State Highway 119 intersection. Road 24 is presently in need of repair. I am sure that development will occur and the St. Vrain Sanitation District will undoubtedly be a major catalyst. I hope those deliberating on this issue will take road impact into consideration. Warden, Director, Finance & Administration \--1 \ St. Vrain Sanitation District Service Plan Subject ------- I have reviewed the service plan for the St. Vrain Sanitation District from the financial feasibility point of view. The project would require a general obligation bond totalling $4,750,000 which must be approved by the electors of the proposed District. The amount of bond exceeds the anticipated total cost of $3,655,000. Final bond amount would depend upon final engineering estimates. The issue would be retired by tap fees, and a mill levy of 10 mills throughout the 20 year bond retirement period. Based on the assumption of development of the district and a 10% interest rate, the schedules presented seem realistic and the project feasible. If the issue is done in the near future the 10% interest rate appears reasonable. No comment is made regarding the development rate of the district. The assessed value is projected to go from $1,451 ,073 in 1984 to $9,538, 136 in 1994 and $20,969,162 in 2004 in the "Estimated Financial Plan" on page 12. The reviewing authorities may want to discuss the basis of these estimates on pages 7 — 12 of the plan with the applicants.. If the estimates are realistic the plan is feasible, if the estimates are not realistic the financial plan does not appear feasible since the lack of development would adversely impact the tap fees and assessed values.
