RE: DENY MOBILE HOME PERMIT NO. 1440 - VICENTE G. MARTINEZ
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on the 3rd day of
August, 1988, considered the request of Vicente G. Martinez to
place one mobile home to be used as a principal dwelling, and to
be occupied in an A.-Agricultural Zone District on a parcel of land
more particularly described as follows :
Lot 2 , Block 6 , Aristocrat Ranchettes Subdivision,
Weld County, Colorado
WHEREAS, Vicente G. Martinez was present at said meeting on
August, 3, 1988 , and
WHEREAS, the Board of County Commissioners, after hearing the
testimony offered by the Department of Planning Services and that
of Mr. Martinez , finds that said request should be denied.
NOW, THEREFORE , BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of
Vicente G. Martinez to place a mobile home to be used as a
principal dwelling on the hereinabove described parcel of land be,
and hereby is , denied.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 3rd day of
August, A.D. , 1988 .

Subdivision, Weld County, Colorado
_Location: Approximately 1 mile north of the City of Fort Lupton.
The Department of Planning Services' staff has reviewed this request and
recommends that the request be approved for the following reasons:
This request:

X Be in harmony with the character of the
neighborhood.
X Adversely affect the immediate area.
X Be adequately served by water and sewage
_disposal facilities.
X Adversely affect the general health, safety
and welfare of the inhabitants of the area and
the County.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The applicant shall apply for a building permit for the mobile home
within thirty (30) days from the date of approval by the Board of
_County Commissioners.
2. Prior to the issuance of a building permit, the owner shall submit
evidence that a domestic well is supplying water in such a manner as to
be adequate in quality, quantity, and dependability for the proposed
use. 'The applicant shall also submit evidence that a 1,000 gallon or
larger, cistern is available on the property and can supply water for
the outside uses on the lot or that another legal water source is
available to supply both in-house and outside uses on the lot.

3. The 4omestic well on the property shall be limited to inside use only
for one single family dwelling and shall not be used outside the house
for any _purpose.
4. The return flow from the use of the well must be through an individual
waste water disposal system of the nonevaporative type where the water
is returned to the same stream system in which the well is located.
5. The mobile home will not be occupied until the applicant has complied
