RE: APPROVAL OF RECORDED EXEMPTION NO. 1010 - GREELEY TRADING,
INCORPORATED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended , did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land , to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1010 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1010 was
submitted by Greeley Trading, Incorporated for property which is
located in part of the N1 NE4, Section 33 , Township 6 North , Range
66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide one lot equaling 4 . 494
acres, into two lots equaling 3. 934 acres and 0. 560 acres, for the
purpose of separating the storage garage from the business .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions:
1 . The following note shall be placed on the recorded
exemption plat:
No sanitary sewer disposal facilities
exist for Lot A. If the use of the
property changes , a site plan review
under the Weld County Zoning Ordinance
will be required.

2 . The applicant shall submit a mylar plat to the
Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat
shall be prepared in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty
days from the date of approval by the Board of County
Commissioners.
3 . Prior to the recording of the plat, the plat shall be
amended to show that the 0. 540 acre parcel being created
is accessible from an ingress and egress easement off of
Weld County Road 64 .
The above and foregoing Resolution was, on motion duly made
and seconded , adopted by the following vote on the 20th day of
May, A.D. , 1987.

1 . The following note shall be placed on the recorded exemption plat:

Dear Commissioners:
This request for a recorded exemption is submitted by the Greeley Trading,
Incorporated. The parcel of land on which this request is being made is
described as Part of the Ni NE} of Section 33, T6N, R66W of the 6th P.M.,
Weld County, Colorado. The property is located adjacent to the City of
Greeley, south of "0" Street, or Weld County Road 64 and west of 59th
Avenue, or Weld County Road 31 . The parcel under consideration is the total
land holdings of the applicant. This request is to divide one (1) lot into
two (2) lots for the purpose of separating the storage garage from the
business.
Based upon the submitted information and the policies of the County, the
Department of Planning Services Staff recommends the request be denied for
the following reasons:
The applicant has not demonstrated that the proposal is compatible
with the future development of the surrounding area as permitted
by the adopted master plan of affected municipalities. The City
of Greeley has reviewed the application materials and have
indicated that the proposal is within the long-range expected
growth area (LREGA) . The city cannot provide sewer service, and
any degree of development caused by the lot spilt would be
incompatible with its comprehensive plan policies and goals for
orderly growth and development.
The applicant has not met the criteria whereby the minimum size of
any building site, tract, or lot created by such land divisions
shall not be less than one (1) acre. The applicant proposes a
division of the one (1) lot equaling 4.494 acres into two (2) lots
equaling 3.934 acres and 0.560 acres.

The applicant has not demonstrated that the proposed lot will have
access to a means for the disposal of sewage in compliance with
the Weld County Health Department. The Weld County Health
Department reviewed the application materials and could not
recommend approval of the utilization of a proposed septic system
because of the lot size being less than one (1) acre.

COMMENTS:
There is one access onto the property from "0" Street or Weld County Road 64
which is a County Collector.
The total 4.494 acres, more or less, is zoned I-1 (Industrial) . Existing on
proposed larger lot are 3 grain storage buildings, a warehouse, and a two
story office building. The storage garage is located approximately 175
feet, more or less, to the west of the office building on the proposed .560
acres, more or less. The north side of the total 4.494 acres, more or less,
is a black-topped parking lot. Also, existing to the north of the proposed
larger lot is the Colorado Southern Railroad and USR-491 which is an
agri-business/irrigation sprinkler systems storage facility.
West of the proposed recorded exemption is a cattle feeding business, and to
its west is the Lowell-Paul Dairy Farm. Loveland Industries is located
south of the site.

Gentlemen;
Greeley Trading Inc. , owners of the property described herein desire to subdivide
the property in order to separate a detached storage garage from the business
needs of Greeley Trading, Inc.
The following statements are made to address the questions and concerns of Weld
County in reviewing the application.
1 . The property was acquired from Great Western Sugar Company in September of 1978.
Many improvements were made on the property by Greeley Trading Inc. , to pro-
vide processing and storage facilities for beans.
The owners now desire to separate from the main part of the facility a detached
storage garage.
2. The integrity of the policies of the Weld County Comprehensive Plan would not
be jeopardized by this proposal since it does not alter the nature, use or
make up of the present use, only the ownership. The storage garage (on Lot A)
exists and would have private access to the County Road 64. The integrity of
the agriculturally oriented commiercial use on Lot B would not be affected.
No new residential units are being created.
3. The lots being created by this proposal will remain in the agricultural zone
and their use is consistant with the intent of the zoning district in which
they are located.

4. The present uses are compatible with the surrounding properties and no change
of use is requested. The property to the South of this property is being
developed as an industrial subdivision.
5. No change in zoning or request for variance is being requested and the proposed
split would not hinder future development as projected by either the County or
nearby municipalities.
6. This proposal is consistant with the efficient and orderly development of the
area, and easily blends with present and developing use of the area. A rail-
road spur serves Lot B and the industrial subdivision to the South.
7.. Subdivision of the property will not require any additional facilities. Lot A
will not require water or sewer service and Lot B presently has all services.
8. Neither lot is located in any geological hazard area, Weld County Airport Over-
lay or Flood Plain.
9„ This request will not change the access points , traffic movement or amount of
traffic on County Road 64.

Dear Brian:
The City of Greeley Planning Department has reviewed the recorded
exemption request by Greeley Trading, Inc . ( Case Number RE-1010 , City
Case #14 : 87 ) and has the following policy comments :
1 ) This site is within the Long Range Expected Growth Area (LREGA) .
2) The site has moderate water and access service costs , is outside
the 1 . 5 mile fire service radius , and has major sewer service
costs . The city can not provide sewer service without major
expense. Weld County requires minimum one acre lots for septic .
3 ) This site scored a 27 on the Suitability Index . For future
development , this suggests a significant level of incompatibility
between a land use and environmental , governmental service , or
transportation consideration .
4 ) Applicable Comprehensive Plan policies include:
A-2. 2 . .small commercial properties that are not functionally
integrated with adjacent commercial properties are to be
discouraged.
A-4 . 8 Development should have limited access onto collector and
arterial roadways ("0" Street) with access limited to the
safest location .
B-3 . 1 . 1 The city should target growth for those areas where
public service can be provided at a minimum cost .
These comments suggest that any degree of development caused by a lot
split action would not be in conformance with Comprehensive Plan policies
for orderly growth and development . Because of the existing land uses ,
this nonconformance is minimal , but the potential exists for future
service constraints .
