The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicants have shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the intent of the Weld County Comprehensive Plan ' s Agricultural Goals. The proposed Special Review Permit will not remove productive agricultural land from production. 2,00/60 f_' -- 890153 Page 2 RE: USR - DAVIS b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Special Review Permit. c. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the Agricultural Zone District. The surrounding area is used for pasture land and a grain storage facility. No objections have been received from surrounding property owners. d. No overlay districts affect the site. e. The Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the the neighborhood and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a home business (trucking operation) located in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 2 . Prior to recording the plat, the owner/operator shall obtain from the Weld County Building Inspection Department all applicable building permits for the two accessory structures located on site. 3 . Prior to recording the plat, the Special Review Permit plat shall be amended to show the following: a. The frame shed 's boundary adjustment; and b. An additional 25 feet of right-of-way reservation south of State Highway 14 . 890153 Page 3 RE: USR - DAVIS 4 . Except for the two accessory structures identified in Condition #2 , no additional building permits or electrical permits shall be issued until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 5 . Within six months from the date of final approval by the Board of County Commissioners, the frame shed, located adjacent to Weld County Road 77 , shall be relocated in accordance with the setback regulation as described in Section 31 .5 . 2 of the Weld County Zoning Ordinance. 6 . An individual septic disposal system (ISDS) evaluation on all existing septic systems shall be performed prior to issuing the required septic permits on the existing systems . 7 . If the usage of the shop increases either by the total number of employee hours worked in the shop or by having one full-time employee equaling eight hours per day, the applicants shall apply for an Individual Sewage Disposal System Permit for the facility. The Site Specific Development Plan and Special Review Permit is for a home business (trucking operation) located in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S . , as amended. 3 . Waste oil , treatments, anti-freeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . An Air Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors and the requirements of the permit shall be maintained at all times. 5. The maximum permissible noise level shall not exceed the light industrial limit of 70dB (A) , as measured according to 25-12-102 , Colorado Revised Statutes. 6 . No permanent disposal of wastes shall be permitted at this site. 7 . Fugitive dust shall be confined to this site. 8 . All waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions . 9 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 10 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 11 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with 890153 Page 2 DEVELOPMENT STANDARDS - DAVIS the Development Standards stated herein and all applicable Weld County Regulations . 12 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . 13 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards . Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners . 890153 HEARING CERTIFICATION DOCKET NO. 89-6 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A HOME BUSINESS (TRUCKING OPERATION) LOCATED IN THE A (AGRICULTURAL) ZONE DISTRICT - PAULINE AND DANIEL DAVIS A public hearing was conducted on February 8, 1989, at 10:00 A.M. , with the following present: Commissioner C.W. Kirby, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner George Kennedy Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Brian Bingle The following business was transacted: I hereby certify that pursuant to a notice dated January 11, 1989, and duly published January 25, 1989, in the Platteville Herald, a public hearing was conducted to consider the request of Pauline and Daniel Davis for a Site Specific Development Plan and Special Review Permit for a home business (trucking operation) located in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Bingle, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. He stated that the Health Department has granted a variance to Condition 6 which states that an individual sewage disposal system must be installed and has set limits at which a system shall be required. Daniel Davis, one of the applicants, came forward to present information regarding this request. He asked for a change in the second part of Condition 2, requiring that the frame shed adjacent to Weld County Road 77 be moved prior to recording the plat. After discussion, he agreed that he could move the shed within six months. Pauline Davis came forward and asked for clarification of the changes being discussed. (Tape Change #89-7) The reasons for requiring building permits for the outbuildings already on the property were explained. No public comment was offered concerning this request. Commissioner Lacy moved to approve the request of Daniel and Pauline Davis for a Site Specific Development Plan and Special Review Permit, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation, with the second part of Condition #2 becoming a separate Condition allowing six months for moving the shed, and Condition #6 amended to use the wording contained in the Health Department variance.
