Be it therefore Resolved by the Weld County Planning Commission that the following be adopted: CASE NUMBER: USR-723:86:3 NAME: Town of Johnstown - Bill Gray, Mayor ADDRESS: P.O. Box 306, Johnstown, CO 80534 REQUEST: Use by Special Review permit to allow expansion of a water treatment plant for a public utility. LEGAL DESCRIPTION: Pt. SE} of Section 1, T4N, R68W of the 6th P.M. , Weld County, Colorado LOCATION: 1} miles west of Johnstown, north of Highway 60 and west of Weld County Road 13. 1. The submitted materials are in compliance with application requirements of Section 25.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Weld County Planning Commission that the applicant has shown compliance with Section 25.8 of the Weld County Zoning Ordinance as follows: - Alternatives to this proposal have been adequately assessed and the proposed action is consistent with the best interest of the people of Weld County. Reasonable efforts have been made to minimize the impacts on croplands in the Agricultural Zone district. - The expansion of the water treatment plant will utilize an area immediately adjacent to the existing treatment plant. The site selection area is zoned Agricultural and preserves agricultural land by using an existing water treatment site. - The proposal will not have an undue adverse effect on existing and future development of the surrounding area. The area is zoned Agricultural. Crop production remains the predominant uses in the area. (� _ do1419 PLC(44),_45 Town of Johnstown - Bill Gray, Mayor USR-723:86:3 February 18, 1986 Page 2 - The nature and location for expansion of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark, or archaeological sites. - The design of the proposed facility mitigates negative impacts on the surrounding area to the greatest extent possible. - No overlay districts affect the site; and - Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request and the responses of the referral entities which have reviewed this request. The Weld County Planning Commission's recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services' office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within six (6) months from the date of approval by the Planning Commission, the Town Board of Johnstown shall return to the Department of Planning Services with a proposal to resolve the seepage problem caused in the area by the facility. The Use by Special Review permit is for expansion of a water treatment plant for a public utility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. The site shall be maintained in such a manner so as to control soil erosion, dust, and growth of noxious weeds. 3. All Construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 6. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 7. The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. In order for the system to be ready for the summer load, it is necessary for construction to begin immediately. Because of oversight, the Town did not apply for a Use by Special Review Permit under Section 30-28-110 , C. R.S. , as amended, and applicable County regulations until on or about January 9, 1986. The Town acknowledges its obligation to proceed as required by law in connection with this process, but because of the scheduling considerations set forth above, we respectfully request you to authorize the issuance of a building permit for the project at this time, subject to all other applicable rules and regulations, pending action on the Use by Special Review Permit by the Planning Commission. In connection with this request, the Town acknowledges and agrees that by beginning construction on the basis set forth above, it does not have, nor will it acquire any vested rights whatever to continue with construction pending the order of the (i C ; Planning Commission, or following such order if the Planning Commission does not approve the Use by Special Review. LEGAL DESCRIPTION: Part of the Si SW} of Section 24, T4N, R68W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles southwest of Johnstown; south of Weld County Road 44, and west of Weld County Road 13. be approved by the Weld County Planning Commission for the following reasons: 1. The Use by Special Review site shall be enclosed by a six (6) foot chain link fence with three (3) strand barbed wire top. 3. Ail Construction done on the property shall. be in accordance with the requirements of the Weld County Building Code Ordinance. 4. After construction, all distrubed areas shall be seeded to native grasses as recommended by the Big Thompson Soil Conservation. 5. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 6. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 7.
