AR2t'23596 RESOLUTION RE: APPROVE CLOSURE OF BRUNO AVENUE BETWEEN TATE AVENUE AND WELD COUNTY ROAD 33 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners received a request that Bruno Avenue be vacated between Tate Avenue and Weld County Road 33 , and WHEREAS, the Board, upon the recommendation of the Engineering Department, deems it advisable that said portion of Bruno Avenue, be closed with the Right-of-Way being retained by Weld County, and WHEREAS, the Board further deems it advisable that an Agreement be prepared by the Office of the County Attorney and the Engineering Department, to be executed by the abutting landowners, said Agreement to indicate the uses which will be permitted on that portion of Bruno Avenue to be closed. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Bruno Avenue be, and hereby is, closed between Tate Avenue and Weld County Road 33 , with Weld County retaining the Right-of-Way. BE IT FURTHER RESOLVED by the Board that an Agreement be prepared indicating the uses which will be permitted on the portion of Bruno Avenue which is to be closed, said Agreement to be executed by the abutting landowners. As previously stated in other letters, the road has been frequently used in the east as a raceway, a place to dump re— fuse, a lover 's lane, a sanctuary for little boys on unlicensed motorcycles, a bridle path, a bicycle path, and a walkway. No one ever complained about the equestrians, bicyclists or pedestrians. It was ddngerons, though, to have the racers and motorcyclists, maddening to have to remove other people 's garbage, and downright disgusting to have our ' children ex- posed to the presence of used condoms within a few feet of Our corral fence. Please add to the above that recently, since the road has been re-opened after being blocked for several years, the road is frequented by small children on three wheeled bikes without a vestige of protective clothing or a trace of adult Aopervision. . It was also observed duriik a recent grass fire in the area that the function of the dirt track as a firebreak is cancelled by the overgrowth of weeds. The recommendation of the t�'eld County Engineering Department that the right of way be retained by the county pending further development of the area might seem to have merit, except that only the segment from Mathews to Tate remains open in any sense, sand the properties on either side of that are 4 ten acre plots. Three of those are already occupied by people (including us) who would" rather see Bruno closed and vacated. We fail to see how any of the area which might possibly be served by Bruno Avenue in the future might not be served as well or better by Weld County Road 6 and 'field County Road 8. This property is one of four properties which borders on the recently opened portion of Bruno Avenue. I would like to ask that the county grant that this portion of Bruno Avenue be vacated. The open portion of Bruno Avenue between tate and Mathews Avenue lies in an established development which is not to be further subdivided; thus, would not inhibit any future development plans by vacating this area. The portion of Bruno Avenue between Mathews Avenue and Read 33 has already been gated from public use by the present owners. The previous resident at 2510 Mathews Avenue and the neighboring property to the south of Bruno Avenue have had problems involving livestock being destroyed or released by access to these properties along Bruno Avenue. Since I also keep livestock I would like to see this access to these properties eliminated by the closure of Bruno Avenue between Tate and Mathews Avenue to prevent any further possibility of undesirable accidents with livestock from happening. Scheltinga, County Engineer Dear Mr. Scheltinga; We are the owners of 30 acres in Country Estates and this letter is in response to the closing of Bruno Avenue. We very seldom use Bruno Ave, but we feel that this street should not be closed for safety reasons. There was a fire out here last week which three fire trucks responded, the fire burned a whole 10 acre section, which was right by Bruno Ave. I feel Bruno Ave. should be left open in case of emergencies or for any other reasons. This is a right of way street the same as Tate Ave or Mathews Ave and should be accessable by anyone. We would love to have our street closed for only the people that live on Tate Ave too, this would stop the dirt from blowing and speeding cars going by. These people on Bruno Ave want Bruno to be their private driveway, why should they be better than anyone else li'ring out here. Thank you for reading my letter.
