RE: APPROVAL OF RECORDED EXEMPTION NO. 1139 - MAURICE AND PATTY
PIKE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board ,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1139 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1139 was
submitted by Maurice and Patty Pike for property described as Lot
A of RE #504 , and located in part of the SWI , Section 5 , Township
6 North, Range 67 West of the 6th P.M. , Weld County, Colorado,
being more particularly described in the plat which shall be
provided by the applicant and known as Exhibit "A" , said plat to
be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 12 acres and 8 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions : 1) An ISDS evaluation by the
We].d County Health Department on all existing septic systems will
be necessary prior to issuing the required septic permits on the
existing system; 2) A Weld County Septic Permit is required for
the proposed home septic system and shall be installed according
to the Weld County Individual Sewage Disposal Regulations; 3) The
applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the
requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from
the date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees; and
4) Prior to recording, the applicant shall amend the plat to show
the following:

NOTE: "If the proposed house is built with a
basement, it could be affected by seepage.
The Lake Canal Ditch is higher in elevation
than Lot A of this Recorded Exemption #1139 .

and seconded, adopted by the following vote on the 1st day of

Re: Recorded Exemption #1139
Dear Commissioners:
This This recorded exemption request is submitted by Maurice and Patty Pike. The
parcel of land on which this request is being made is described as Lot A of
RE-504, located in part of the SWI of Section 5, T6N, R67W of the 6th P.M. ,
Weld County, Colorado. The parcel is located approximately one mile north
of the Town of Windsor, north of Weld County Road 72, and east of Weld
County Road 15.
The request is to divide a 20.06 acre tract of land, which is the total
contiguous land holdings of the applicant, into two lots of 12.2 acres and
7.9 acres, more or less.
The Department of Planning Services' staff has concerns about the level of
development and the potential for continued divisions to occur in this
section. The staff wants the Board to be aware of the development pattern
that has occurred on this property and on those properties in the
surrounding area.
The original warranty deed recorded in 1957, described this lot as a portion
within the total contiguous land holdings of Mr. Greenwald, in both the NW}
of Section 8 and the SWI; of section 5, T6N, R67W of the 6th P.M. , Weld
County, Colorado. In 1978, that portion of land in the SW} of Section 5 was
deeded separately to Mr. Bolter. In April of 1981, the Bolters submitted a
recorded exemption application which was approved and created the lot now
owned by the Pikes. In the SE} of this section the staff has approved two
recorded exemptions. In the NEl of Section 8, abutting Weld County Road 72,
there are six parcels which were created prior to August 30, 1972. This
property lies within Windsor's Urban Growth Area and is situated one mile

south and one mile north of the incorporated boundaries of Windsor; however,
it is still the responsibility of the County and other entities other than
Windsor to provide services. Services such as road maintenance, police and
fire protection, school busing, snow removal and other urban type services
are necessitated by residential development. As density increases, so do
service demands.
The staff requests that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2 E. (1) (a) through
(m) have been met.

RE: RECORDED EXEMPTION APPLICATION
1 . The 20-Acre tract was acquired on November 12, 1985. It contains one set
of improvements which is the residence of Joe & Patty Pike. They now de-
sire to offer for sale the Easterly 8-+ Acres for a new residence.
2. The integrity of the policies of the Weld County Comprehensive Plan would
not be jeopardized by this proposal since the creation of a 8+- Acre tract
does not appreciably alter the nature, or present use of this tract. New
construction would only be single family dwelling and other agriculturally
related structures. Furthermore, this proposed split would be in compliance
with applicable state and county regulations.
3. The lots created by this proposal will remain partly in agriculture in use
as well as agriculturally zoned, and thus this proposal is consistent with
the intent of the zone district in which they are located.
4. To remain compatible with the existing land uses, only those uses presently
permitted on the surrounding properties will be permitted on the proposed
parcels.
5. In applying for this Recorded Exemption, we are not seeking a land use
variance or any change in zoning so the proposed split would not hinder
future development as projected by either the County orrearby municipalities.
There will be no change in the existing infrastructure except the services
and a single road access.
6. This proposal is consistent with efficient and orderly development in that
it easily blends in with what is currently permitted or taking place in
the area.

7. The existing residence is served by the North Weld Water District and has
individual sewage disposal system consisting of a septic tank and leach
field. The new construction on Lot A would have similar services.
Application will be made to Weld County for the necessary building per-
mits and sewage disposal system for the new construction.
8. The property under consideration is not located in a geological hazard
area or the Weld County Airport Overlay, and is NOT located in a general
Flood Area as defined by the Flood Insurance Rate Map, Community Panel
Number 080266-0475 C, effective date September 28, 1982..
9. This Recorded Exemption request will not adversely affect the ability to
use the remaining portion of the lot.
