RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT TO INCLUDE STORAGE OF TRACTOR TRAILERS, RECREATIONAL VEHICLES AND MOBILE HOMES AND AN ADDITIONAL DWELLING - DALE BARR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of May, 1988 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Dale Barr, 1492 Weld County Road 11 , Erie, Colorado 80516 , for a Site Specific Development Plan and Amended Special Review permit to include storage of tractor trailers , recreational vehicles and mobile homes, and an additional dwelling on the following described real estate, to-wit: Part of the SW} , Section 25 , Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a . The proposal is consistent with the intent of Weld County Comprehensive Plan agricultural goals in that the proposal will not remove productive agricultural land from production. 880322 Page 2 RE: AMEND USR - BARR b. The proposal is consistent with the intent of the Agricultural Zone District in which the use is located. c. The uses permitted will be compatible with the existing surrounding land uses and with future development of the surrounding areas as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e . The Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review permit to include storage of tractor trailers, recreational vehicles and mobile homes, and an additional dwelling on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Within 60 days of approval by the Board of County Commissioners , the applicant shall submit evidence to the Department of Planning Services that: a. A soil erosion control plan has been approved by the West Adams Soil Conservation District. b. The Special Review permit is for the storage of tractor trailers, recreational vehicles and mobile homes, and an additional dwelling as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. -There shall be no more than 200 tractor trailers, recreational vehicles , and mobile homes stored on the site at any one time. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . Waste oil, waste paints, stains, antifreeze , waste material , and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . Wood shavings , sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris , and other potential nuisance conditions . 6 . Fugitive dust must be confined on this site . 7. An individual sewage disposal system, or vault, is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. _8 . The property shall be maintained in compliance with the Weld County Building Code Ordinance and each individual mobile tome shall be blocked and tied down. 9 . An authentication form, available from the Weld County Treasurer ' s Office, shall be obtained for the movement of any mobile homes off the site or from any location within Weld County. 880322 Page 2 DEVELOPMENT STANDARDS - BARR 10 . An Oversized or Overweight Load Permit shall be obtained from the State Highway Department for each and every mobile home prior to travel on or across State highways. 11 . The soil erosion control plan approved by the West Adams Soil Conservation District shall be maintained at all times. 12 . To ensure adequate fire protection, the following measures shall be adopted: a. Semi-type trailers shall be spaced no less than six feet between trailers and motor homes and mobile home type trailers shall be spaced no less that 10 feet between units. b. Tractor trailers, -recreational vehicles , and mobile homes shall be grouped in multiples of six or less. Each group shall be separated by a minimum of fifteen feet. c . An address shall be visible from Weld County Road 11 fronting the easement. Said numbers shall be a minimum of 5 inches in height and 3/4 inches in stroke. d. Your fire extinguishers shall be located on each storage lot being used. All fire extinguishers shall have a minimum rating of 4A-60BC, mounted three to five feet from the ground and properly marked for easy visibility. e . "No smoking" signs shall be strategically located throughout the area. f. All weeds , and grass, shall not exceed six inches at any one time or place in the Use by Special Review storage areas. g. A 4 ,000 gallon underground water storage tank shall be installed and maintained at all times in accordance with the Brighton Fire Protection District Standards . h. The access roads serving the Special -Review site shall have a surface that is sufficient to travel every day of the year for the purpose of controlling and extinguishing any and all potential fires. i . Trailers shall not be used for the storage of any materials of any type. 880322 Page 3 DEVELOPMENT STANDARDS - BARR 13 . No _retail sales or any other business shall be conducted on or from the property. 14 . Only personal items owned by the caretaker shall be stored in area "D" shown on the plat. 15 . No individual tractor trailer, recreational vehicle, or mobile home shall be stored on the Special Review area for a period in excess of 24 months. 16 . Upon termination of the use as a storage site , all debris, the stored items, and all associated equipment shall be removed from the site within a period of ninety (90) days by the owner/operator. 17. An accurate file shall be maintained on each item stored on the property. The information shall include, but not be limited to, the following: serial number, color, size, make, model , and date that each tractor trailer, recreational vehicle, or mobile home was placed on the property and the date that each was removed. 18 . Upon request, the owner/operator shall provide records to the Department of Planning Services staff indicating the dates that tractor trailers, recreational vehicles, or mobile homes were moved onto the property. 15 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .3 of the Weld County _Zoning Ordinance. 20 . The property owner or operator shall be responsible for complying -with the Operation Standards of Section 24 .6 of the Weld County _Zoning Ordinance . 21 . Personnel from the Brighton Fire Protection District, Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 22 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Dale Barr, Chief Richard Engle and myself on April 26, 1988 at the Brighton Fire Protection District Station 1 , the following items were discussed and resolved. 1 . ) Item number 1 on the letter dated March 28, 1988 stated that a minimum separation of 10 feet shall be present between each trailer , vehicle, or temporary structure . This requirement will be changed to read semi type trailer spacing shall be no less than 6 feet between trailers . Motor homes and mobile home type trailer spacing shall be no less than 10 feet between units . Trailers , vehicles or temporary structures shall be arranged as not to exceed a maximum of 6 in a group with a minimum of 15 feet between groups . 2 . ) Item number 5 on the letter stated that all weeds, vines or other growth shall not exceed 3 inches in height at any time in the designated storage areas . At this time all parties have agreed to change this requirement to read all weeds , vines or other growth shall not exceed 6 inches in height at any time and shall be cut back to 3 inches in all storage areas . This requirement will be monitored to assure that the proper height is maintained and if the height is allowed to exceed 6 inches at any time, the 3 inch requirement -shall be reinstated . 3 . ) According to Mr. Barr, the no smoking signs are in place. 4 . ) The portable fire extinguishers are to be replaced. 5 . ) Item number 8 stated that a 5000 gallon water storage tank would be required. Upon a site inspection on March 30, 1-988, the following items were noted. 1 . ) Trailers were parked in groups larger than 6 units . 2 . ) Many units were parked closer than 6 feet apart. 3 . ) Of the four fire extinguishers located on site, two were discharged and not usable. 4 . ) The weeds on site were not cut to the required 3" height. Weeds as tall as approximately 1 foot were observed. 5 . ) Poor electrical wiring practices were used. 6 . ) Access road is poorly graded. - 7 . ) There were no "NO SMOKING" signs found on the site. The -Brighton Fire Prevention Bureau feels that the new restrictions on unit spacing and water supply requirements are necessary due to the type of equipment that is -proposed for storage on the site . The portable fire extinguishers on site are required to the inspected annually by a qualified company. At this time, it does not appear that this has been done.
