RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR GREYHOUND KENNEL (120 DOG MAXIMUM) - CHARLOTTE WATKINS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of October, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Charlotte Watkins, 905 South Denver Avenue, Fort Lupton, Colorado 80621 , for a Use by Special Review for a greyhound kennel (120 dog maximum) on the following described real estate, to-wit: Part of the NE; SW4 and Part of the NW4 SEa, Section 6 , Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present , has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. 851202 A2/ / S/. I Page 2 RE: USR, WATKINS b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The activities proposed will be compatible with existing agricultural uses as well as with the future projected development in the immediate area. The future uses are intended to remain agricultural in nature. The intended proposal will not have any significant traffic impacts . d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a greyhound kennel (120 dog maximum) on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The use of the property as a kennel facility shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to using the property as a kennel facility, the applicant shall submit evidence that a well permit has been issued and that the well will supply water in such a manner as to be adequate in quality, quantity and dependability for the proposed uses of the property. 4 . Prior to using the property as a kennel facility, the applicant shall submit an erosion control plan for the property as required by Development Standard number three. The Use by Special Review permit is for a kennel facility for a maximum of one hundred twenty greyhounds as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2 . The greyhound kennel facility shall comply with the Colorado Racing Commission ' s rules and regulations pertaining to greyhound kennels. 3 . The applicant shall implement and maintain an erosion control plan for the property. The plan shall be approved by the Southeast Weld Soil Conservation District. A copy of the approved plan shall be submitted to the Department of Planning Services. 4 . Building and grounds shall be kept clean, in good repair and free of trash. Animal waste shall be removed daily from the kennel area and stored in an enclosed container. The waste shall be removed on a weekly basis. 5 . If any plumbing facilities are planned or required for the kennel , a separate septic system shall be installed for the kennel facility in accordance with the requirements and regulations of the Weld County Health Department. 6 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 . 5 of the Weld County Zoning Ordinance. 8 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 of the Weld County Zoning Ordinance. 9 . Representatives or members of the Weld County Health Department, Colorado Racing Commission, and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Page 2 RE: DEVELOPMENT STANDARDS - USR, WATKINS Development Standards stated herein and all applicable Weld County Regulations. 10 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11 . The property owners and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-81 RE: USE BY SPECIAL REVIEW FOR A GREYHOUND KENNEL (120 DOG MAXIMUM) - CHARLOTTE WATKINS A public hearing was conducted on October 30th, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Debbie Campbell Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated October 7, 1985, and duly published October 17, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request for a Use by Special Review for a greyhound kennel (120 dog maximum) from Charlotte Watkins. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that there are 4 conditions and 11 Development Standards associated with this Use by Special Review. Charlotte Watkins came forward to give her presentation. She commented that she and Melvin Johnson are the owners/operators of the property. She also addressed issues concerning noise. Mr. Johnson also came forward to answer questions of the Board. Arthur Doll, Security Coordinator for the Colorado Racing Commission, came forward to speak in favor of the request. After discussion, Commissioner Brantner moved to add a Development Standard concerning the permit being issued to the owners of the kennel and not the subject property. Commissioner Lacy seconded the motion. Mr. Morrison explained that high standards are associated with the operation of racing kennels, which is clearly stated in the application materials and that adding this Standard would not be necessary. After discussion, Commissioner Kirby and Chairman Johnson stated that they will vote against the motion giving reasons for doing so. After further discussion, Commissioner Brantner withdrew his motion. Commissioner Lacy moved to approve the request of Charlotte Watkins for a Use by Special Review for a greyhound kennel, subject to the recommended conditions and Operation Standards. APPEARANCE: Charlotte Watkins, property owner and applicant, stated Melvin Johnson's name should also have been on the application as the name of the kennel will be Johnson Kennels. There are four employees at this site and most of their supplies, food, and veterinarian services are obtained locally. Lee Morrison stated that as a rule a Use by Special Review request runs with the land, so as long as she is the property owner it does not make any difference what the kennel is called. Melvin Johnson, kennel owner, stated most of the dogs at this site will be racing dogs. There will be no training here. There will be about fifty dogs based at this kennel. The kennel area will be back from the road about fourteen hundred feet and will not be visible from the road. The Chairman called for discussion from the members of the audience. It is big business with Colorado having five tracks in operation at different times of the year. Greyhound kennels and farms are kept very clean. The dogs provide the owners with their income and as a result the owners take care of the dogs . After visiting three kennels in the area I have a very high respect for a well managed kennel or farm. Droppings are picked up at least twice a day, their beds are kept clean, the dogs do not bark as a rule and an ex- cellent health program was in effect .
