RE: APPROVE AGREEMENT BETWEEN WELD COUNTY AND DAVE AND JUNE
FAGERBERG CONCERNING REMOVAL OF EARTH MATERIAL FROM BORROW
DITCH AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been advised that material in a borrow
ditch which is located in Part of Section 13 , Township 7 North,
Range 66 West of the 6th P.M. must be removed for drainage
purposes, and
WHEREAS, Dave and June Fagerberg own the property where said
ditch is located, and
WHEREAS, an Agreement for removal of earth material has been
presented to the Board of County Commissioners for its approval ,
and
WHEREAS , the terms and conditions are as stated in the
Agreement, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS , after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement between
Weld County and Dave and June Fagerberg for the removal of earth
material from said borrow ditch for drainage purposes , be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.

AGREEMENT
THIS AGREEMENT, made this 6th day of May, 1985, by and between
DAVE A. AND JUNE I . FAGERBERG, hereinafter referred to as Owner, of
3527 Cindy Place, Greeley, Colorado 80631, and the WELD COUNTY ROAD AND
BRIDGE DEPARTMENT, for the benefit and on behalf of the Board of County
Commissioners, Weld County, Colorado, hereinafter referred to as Weld
County.
WHEREAS, material in the borrow ditch needs to be removed for drainage
purposes, and
WHEREAS, the owner owns the land described as the SWa of Section 13,
Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado ,
on which the material is located.
NOW, THEREFORE, the owner and Weld County agree that Weld County may
use its equipment to remove the earth material from the borrow ditch and
from the side of the road adjacent to the owner's land.
BE IT FURTHER AGREED that the owner will pay one-half (2) of the
expenses incurred for the removal of said material .
IN WITNESS WHEREOF, the parties hereto have duly executed the agree-
ment the day and year first-above written.
