III TO MEDICAL PLAN DOCUMENT OF THE WELD COUNTY EMPLOYEE BENEFIT PLAN AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment No. III to the Medical Plan Document of the Weld County Employee Benefit Plan, and WHEREAS, the terms and conditions are as stated in said Amendment, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve Amendment No. III to said Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Amendment No. III to the Medical Plan Document of the Weld County Employee Benefit Plan be , and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Amendment No. III . The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 4th day of January, A.D. , 1989 , nunc pro tunc January 1 , 1989 . III To the Medical Plan Document of WELD COUNTY The Medical Plan Document of Weld County Employee Benefit Plan is hereby amended, effective January 1, 1989, as follows: Page 9 - Participation Definitions The following paragraph is deleted in its entirety: 4. Covered Employee is a permanent full-time employee of the Employer who is eligible hereunder and who has been enrolled in the Plan. To be considered a full-time employee, one must work an average of 32 hours per week. In addition, such an employee will not be covered unless on the "date of eligibility" the employee is actually working a full day on that date; otherwise, his/her effective date will be deferred until return to actual service for a full day' s work. The following paragraph is added in its entirety; 4. Covered Employee is a permanent full-time or part-time employee (whose position is scheduled to last at least 6 months) of the Employer who is eligible hereunder and who has been enrolled in the Plan. To be considered an eligible employee, one must work an average of 32 hours per week. In addition, such an employee will not be covered unless on the "date of eligibility" the employee is actually working a full day on that date; otherwise, his/her effective date will be deferred until return to actual service for a full day's work. Page 10 - Participation Definitions The following paragraph is added in its entirety: 9. Late Entrant - Note: If an eligible employee and/or dependent loses coverage under another group sponsored plan, he/she may be covered under this Plan without evidence of good health if application for such coverage is made within 31 days of the loss of the prior coverage. This provision applies to all employees hired after January 31, 1983. Page 26 - Covered Medical Expenses The following paragraph is deleted in its entirety: 9. Charges made by a legal qualified Physician for performing oral surgery consisting of cutting procedures for removal of tumors, BEN:Amend2 890028 cysts, and charges incurred to restore sound natural teeth within six months after the date of an accident, unless medically indicated that treatment be delayed, provided that the injury or condition and treatment thereof occurs while this coverage is in effect. Such charges includes dental X-rays and general anesthesia, Medical Necessary and prescribed by a legally qualified physician; The following paragraph is added in its entirety: 9. Charges made by a legally qualified Physician for performing oral surgery consisting of cutting procedures for removal of tumors, cysts, surgical removal of bony impacted teeth and charges incurred to restore sound natural teeth within six months after the date of an accident, unless medically indicated that treatment be delayed, provided that the injury or condition and treatment thereof occurs while this coverage is in effect. Such charges includes dental X-rays and general anesthesia, Medically Necessary and prescribed by a legally qualified Physician; Page 30 - General Limitations 37. No benefit shall be payable for accidental injuries involving motorcycles, unless: a. The Covered Person was wearing a protective helmet at the time of the accidental injury. b. The Covered Person has purchased the maximum medical payment coverage available through motorcycle insurance, but in no event an amount less than $2,000. Once the motorcycle coverage has paid the maximum benefit due, the Plan will provide normal benefits. IS IS AGREED BY Weld County that the provisions contained in the Plan Document and Amendment No. III thereto are acceptable and will be the basis for the administration of said Employer' s Medical Benefit Program described herein.
