RE: APPROVE INTERGOVERNMENTAL AGREEMENTS WITH TOWNS OF EATON,
GROVER, NEW RAYMER, AND KERSEY FOR 1988 COMMUNITY
DEVELOPMENTAL BLOCK GRANT PROGRAM AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Intergovernmental
Agreements for the Towns of Eaton, Grover, New Raymer, and Kersey
for the 1988 Community Developmental Block Grant (CDBG) Program,
and
WHEREAS , after study and review, the Board deems it advisable
to approve the Agreements , with the terms and conditions being as
stated in said Agreements, copies of which are attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Intergovernmental
Agreements with the Towns of Eaton, Grover, New Raymer, and Kersey
for the 1988 CDBG Program be , and hereby are , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreements .
The above and foregoing Resolution was , on motion duly made
and seconded , adopted by the following vote on the 19th day of
April , A.D. , 1989 .

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, entered into this /J '4 day of in.9RCS' , 19S9, by and between
the BOARD OF COMMISSIONERS OF WELD COUNTY, COLORADO, a body politic of the State of
Colorado, hereinafter called "the County," and the City of Eaton „a
body politic, hereinafter called "the City,"
WITNESSETH:
WHEREAS, pursuant to the Housing and Community Development Act of 1977, as
amended, hereinafter called "the Act," the United States, acting by and through the
Secretary of the Department of Housing and Urban Development, hereinafter called
"HUD," is making available to the State certain funds for community development
activities as set forth in the Act; and
WHEREAS, the State of Colorado, through the Department of Local Affairs, has
the legal authority to provide funds to counties for community development activities;
and
•
WHEREAS, the City has expressed interest in allowing the County to operate a
Housing Rehabilitation Program within its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a program proposal
to the State to carry out the Housing Rehabilitation Program within their
jurisdiction; and
WHEREAS, the parties hereto desire to provide assurances and delineate the
areas of cooperation between the County and the City, with respect to housing
rehabilitation activities.
NOW, THEREFORE, in furtherance of said Resolution, and in consideration of the
mutual conditions, covenants and agreements herein contained, it is agreed by and
between the parties as follows:
1. Planning the Housing Rehabilitation Program: the parties, through their
executives and staff, shall cooperate with each other in developing the Housing
Rehabilitation Program proposal, with all parties giving due consideration to the
needs of its citizens and goals, objectives, .rules and regulations of the Act;
2. Term of Agreement: this Agreement shall remain in full force and effect
until the program proposal is approved by the State and a contract is executed by
by all parties. In the event the program proposal is approved by the State, this
Agreement shall remain in effect through the completion of program activities;
3. Authorization to submit a proposal: the County is authorized to submit
a proposal to the State on behalf of the City to apply for funds under the Community
Development Block Grant Program and to act on behalf of the City, with regard to any
subsequent negotiations, presentations or information in conjunction with the grant
application;
4. The City shall have no obligations or responsibilities, financial or
otherwise, concerning the administration of Community Development Block Grant
Housing Rehabilitation Programs and the County agrees to indemnify the City from
any and all liability, loss or damage the City may suffer in connection with the
administration of the project upon approval of the proposal.

Dear Clerk to the Board,
The enclosed Intergovernmental Agreements have been executed by the incorporated
municipalities of Eaton, Grover, New Raymer and Kersey. This is required by the
Community Development Block Grant guidelines for our 1988 CDBG Program. (Our
program's target area was recently expanded to include these communities.)
We request a resolution by the Board which authorizes their execution of the
enclosed Agreements. We hope that this may be added as an item of business at
the next Board meeting.
