RE: DENY REQUEST OF WILLIAM G. CREWS, ON BEHALF OF SUNSHINE
VALLEY PETROLEUM CORPORATION AND H & C COLTON COMPANY, TO
PRE-ADVERTISE AMENDED USE BY SPECIAL REVIEW
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, William G. Crews , Attorney-in-Fact for Sunshine
Valley Petroleum Corporation and H & C Colton Company, submitted a
letter to the Board requesting pre-advertising for an Amended Use
by Special Review application, and
WHEREAS, a copy of said letter is attached hereto and
incorporated herein by reference , and
WHEREAS , said request was considered at the regularly
scheduled Board meeting of October 26 , 1987 , where only four
Commissioners were present, and
WHEREAS, after review, a motion was made and seconded to
approve said request for pre-advertisement and set the hearing
date as December 2 , 1987 , and
WHEREAS, Commissioners Johnson and Brantner voted aye and
Commissioners Lacy and Yamaguchi voted nay; therefore, the motion
for approval of the request failed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request from
William G. Crews , on behalf of Sunshine Valley Petroleum
Corporation and H & C Colton Company, to pre-advertise an amended
Use by Special Review be , and hereby is , denied.

This letter constitutes a request by Sunshine Valley Petroleum Corporation and
H & C Colton Company, as Applicants, for preadvertising in connection with the
above two requests to amend existing U.S.R. permits.
Fourth quarter drilling by both companies is planned, but the steps necessary
for the amendment process will consume much of the remainder of 1987.
Additionally, prompt drilling will benefit the involved surface owners in that
total restoration following drilling will occur at an earlier date and thus
expedite return of the disturbed areaa to agricultural 11Ce. Both applicants
believe that preadvertising and a prompt. hearing before the Board will be of
benefit to all parties.
All costs as-acriated with preadvertising will by paid by the Applicants.
Invoices for preadvertising should be sent to the undersigned.
Your consideration of this request and scheduling for the earliest possible
hearing date are sincerely appreciated. If you have any questions, please do

The Board has received a request from Bill Crews to pre-advertise
two amended Use by Special Reviews . Both of these will be heard
by the Planning Commission on November 17 .
We currently have two cases which have been heard by the Planning
Commission which we expect to schedule for November 25 , the day
before Thanksgiving.
We would not recommend scheduling any more cases on that date , so
if you wish to approve the request to pre-advertise these cases,
we would recommend that both hearings be scheduled on December 2 ,
1987 , at 2 : 00 p.m.
