Planning Commission Re: HIGH COUNTRY TURF USR-498:82:13 Dear Chuck, As a follow-up to our meeting of Monday, July 14, 1986 this is a formal request for an opinion of the procedure to follow regarding the sale of our farm and the purchaser's intended use of the property subsequent to purchase of same. At this meeting it was explained the new purchaser intends to remove from production the present crop of blue grass and will require a permit or authority to construct from 4 to 10 greenhouses for production of wholesale products such as herbs, for example. It is not the intent to develop a walk-in or retail outlet on the farm premises. This labor intensive business will require a resident manager in addition to the owner being on the premises, therefore an additional single family resience building permit well be necessary on the 150 acres being purchased. In our meeting it was mutually agreed and understood that: 1- The single family building permit could be obtained without specific zoning applications if the additional residence met the test of farm related business. 2- Construction of from four to as many as ten greenhouses where- no additional traffic in the form of retail customers and the like would also not require any special zoning applications. This would be a simple agricultural use and within current zoning rules. 3- The new owner should abandon the existing USR as the sod crop is phased out. Please proceed to verify from your staff and the Commissioners, if necessary, these understandings are proper and your staff will be bound thereby. As explained the closing for this sale awaits resolution of the county's position regarding these issues. Your early response would'be greatly appreciated. Sincerely, JCL W. Butcher High Country Turf 7440 1-25 Frontage Road Erie, CO 80516 RE: USR-498:82:13 Dear Mr. Butcher: Thank you for your letter of July 15. Additional information is needed before our department can make a decision regarding your proposal. If you will submit the following information, it will help the staff in it's review. 1. A plot plan that shows the boundaries of the property you plan to sell. The plot plan should also show the existing and proposed structures on the property and the existing or proposed use of each structure. 2. A better description of the greenhouse operation. What is involved after the herbs are picked? What is the amount and type of traffic involved? Does any processing or packaging occur on the property? Number of employees used. 3. Explain the type of agricultural uses proposed for the property other than the greenhouse operation. Identify the number of people involved with the uses on the total property. Who will reside in the existing and proposed dwellings. Is everyone living on the property involved with the uses on the property? If not, explain. 4. The application materials in the approved Use by Special Review permit describe activities other than the sod operation--fabrication of plumbing elements for underground sprinkler systems and construction of shipping containers and pallets. A letter should be submitted indicating that all activities approved under the Use by Special Review permit will cease and when these activities will cease. �- Mr. John W. Butcher Page 2 The staff is in no position to enter any agreements with you or potential purchasers of the property. Our responsibility is to ensure that the property is in compliance with the County's land-use regulations. Each land-use application process and the review criteria is explained in the regulations and supplemented with procedural guides. If an applicant can satisfactorily demonstrate that he has met the criteria identified in the appropriate section of the land-use regulations, approval can be granted.
