Revised Statutes , as amended, certain local improvements may be

Township 4 North, Range 68 West of the 6th Principal Meridian,

>4 at Reception #1550063, Envelope 397 , re-recorded at Reception
u x #1576284 , Envelope 456 , and as Lots 4 and 5 of Block 1 were
replatted at Reception #1812605, Envelope 1794 , and Northmoor
aor7 Acres Second Filing, recorded at Reception #1585866 , Envelope 480,
in the records of the Weld County Clerk and Recorder based upon

the petition of owners of 73 of the 121 lots in said subdivisions.
m w The petition has been filed with the Clerk to the Board to
construct certain improvements on Weld County Road 44 between
Interstate 25 and Weld County Road 11; Weld County Road 11 between
Weld County Roads 42 and 44; and Weld County Road 42 between Weld
County Roads 11 and 13 , as described in this Resolution, and
WHEREAS, notice of a public hearing concerning creation of
the District and the construction and installation of the
improvements therein has been given by publication in one issue of
the Platteville Herald, a newspaper of general circulation in the
County, not less than thirty days prior to the date of hearing, in
addition, a notice was delivered or mailed by first class mail to
each property owner within the proposed district not less than ten
days prior to the hearing, and
WHEREAS, at the time and place set forth in the notice, the
Board of County Commissioners met in open session for the purpose
of hearing and considering any objections and protests that might
be made against the proposed district or the improvements to be
constructed or installed, and

W NOW, THEREFORE, BE IT RESOLVED by the Board of County
ti El Commissioners of Weld County, Colorado:
en p A. That a local improvement district for the construction
w and installation of street improvements, to include
shaping, grading, drainage, preparation of the base and

N grading, compaction, and paving, together with any
o necessary incidentals on certain County Roads as
hereinafter described, is hereby created and established

wa c4 in accordance with the laws of the State of Colorado,
and shall be known and designated as "Weld County
w Northmoor Local Improvement District No. 1988-1. " All
N proceedings heretofore taken by the Board of County
r' Commissioners and the County staff and then adopted in
aaw connection with the district are hereby ratified,
approved and confirmed. This proposal to create said
district was initiated by the Board of County
Commissioners by Resolution of May 25, 1988 , upon a
petition, proper in form, subscribed by a majority of
the owners of property who will bear the cost of more
than 1/2 of the total proposed assessment in the
district and notice duly given as heretofore stated.
B. That the Engineer's reports, together with all of the
details, specifications, estimates, maps and schedules
thereto attached or appended, are hereby approved and
adopted.
C. That the area to be included within the district
includes Northmoor Acres Subdivision and Northmoor Acres
Second Filing, which are located in the SW} of Section
24 , Township 4 North, Range 68 West of the 6th Principal
Meridian, County of Weld, State of Colorado, more
particularly described as all lots and blocks in both

pave Weld County Road 44 between Interstate 25 and Weld

Z County Roads 11 and 13 , to a resulting roadway with
rig 24-foot travel lanes with 4-foot shoulders on each of
o the above described Weld County Roads. Base course will
v a be installed for the purposes of the paving of the
ww 24-food roadway and installation of the shoulders and
base course preparation will include final grading,
CO wetting and compaction. Paving will consist of
N N placement of two inches of hot bituminous pavement, 24
feet in width, with all work to be built according to
w w Weld County specifications, to be approved by the Weld
County Engineer. The major construction quantities
include approximately 4,700 tons of hot bituminous
pavement, 58 ,000 tons of aggregate base course for
preparation of the base , and traffic control devices for
control of the construction area.
E. That the construction and installation of the
improvements in and for the district, as shown by the
plans, specifications and maps thereof, prepared by the
Weld County Engineer and approved by the Board of County
Commissioners of Weld County, and now on file in the
office of the Clerk to the Board, be, and the same are
hereby authorized and ordered, the materials to be used
in the construction of said improvements to be in
accordance with such maps , plans , and specifications.

Based on the findings and determination of this Board,

Second Filing will specifically benefit from the
proposed improvements based on the following facts:
1) The market value of the property will increase; and
2) The proposed improvements will adapt the property
to more profitable use; and
3) The proposed improvements will facilitate access to
the properties and thereby increase the convenience
of use of said properties .

IN WELD COUNTY, COLORADO, TO BE KNOWN AS WELD COUNTY
NORTHMOOR LOCAL IMPROVEMENT DISTRICT NO. 1988-1, FOR THE
PURPOSE OF CONSTRUCTING AND INSTALLING STREET
IMPROVEMENTS TO INCLUDE COMPACTION, GRADING, PAVING,
TOGETHER WITH ANY NECESSARY INCIDENTALS, IN CERTAIN
ROADS THEREIN, AND OF A PUBLIC HEARING THEREON.
All owners of real estate and property hereinafter described and all
persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has adopted a Resolution declaring
its intention to create a local improvement district within an
unincorporated area of Weld County, Colorado, to be designated as Weld
County Northmoor Local Improvement District No. 1988-1, for the purpose of
constructing and installing street improvements to include compaction,
grading, paving, together with any necessary incidentals, and to assess the
cost of said improvements against the property specifically benefited by the
improvements as proposed by petition of owners of the property who would
bear more than one—half of the total proposed assessment within the
district, all in accordance with the laws of the State of Colorado.
1. All persons are further notified that the kind of improvements
proposed and the streets to be improved are as follows:
Weld County, Colorado, plans to grade and pave Weld
County Road 44 between Interstate 25 and Weld County
Road 11; Weld County Road 11 between Weld County Roads
42 and 44; and Weld County Road 42 between Weld County
Roads 11 and 13, all adjacent or leading to Northmoor
Acres Subidivision and Northmoor Acres Second Filing.
The improvements include grading, paving, and other
appurtenances.
The major construction quantities include
approximately 4,700 tons of hot bituminous pavement,
58,000 tons of aggregate base course for preparation of
the base, and one traffic control device.
2. The area to be included within the district includes all lots and
blocks located within Northmoor Acres and Northmoor Acres Second Filing,
located in the SWI of Section 24, Township 4 North, Range 68 West of the 6th
Principal Meridian, County of Weld, State of Colorado, as recorded at
Reception #1550063, Envelope 397, re-recorded at Reception #1576284,
Envelope 456 and as Lots 4 and 5 of Block 1 were replatted at Reception
#1812605, Envelope 1794, and Reception #1585866, Envelope 480, in the
records of the Weld County Clerk and Recorder. The district shall also
include the rights-of-way of the County Roads described in Paragraph 1
herein.

3. The assessments for said improvements may be paid in ten (10)
equal annual installments of principal with installments of interest on
unpaid installments at an interest rate of ten percent (10%) simple interest
per annum.
4. The assessment will be due and payable without demand within
thirty (30) days from and after the final publication of a resolution
assessing the cost of said improvements, against the real property described
as the described lots in Northmoor Acres and Northmoor Acres Second Filing.
In the event any owner of real property shall fail to pay the whole of such
assessment against his or her property within said thirty (30) days, then
the whole cost of the improvements so assessed against such property shall
be payable in not more than ten (10) equal, annual installments of principal
with interest on the unpaid installments, as aforesaid. The first of such
installments shall be due and payable at such time as may be determined in
and by the assessing resolution or ordinance and the remainder of said
installments shall be due and payable successively on the same day in each
year thereafter, unless otherwise determined by the Board of County
Commissioners, until paid in full.
5. As shown by the estimates of the Engineer, the total cost of the
street improvements to be assessed against the property within the district
is estimated not to exceed one hundred thirteen thousand three hundred
dollars ($113,300) . This represents an estimate of the cost of the labor
and materials for installation by contract of the hot bituminous pavement
and base preparation and the installation of traffic control devices. The
Board of County Commissioners, pursuant to CRS, 30-20-606, has found and
determined that each and every described lot in Northmoor Acres and
Northmoor Acres Second Filing will specifically benefit from the proposed
improvements based on the following facts:
a. The market value of each of the properties will increase; and
b. The proposed improvements will adapt the property to a more
profitable use; and
c. The proposed improvements will facilitate access to each of the
properties and thereby increase the convenience of the use of said
property.
Based on the findings and determinations of the Board of County
Commissioners, it is intended that all of the costs of the street
improvements will be assessed equally against all of the lots within
Northmoor Acres Subdivision and Northmoor Acres Second Filing.
Property owners are specifically referred to the schedule of estimated
proposed assessment on file in the office of the Clerk to the Board of
County Commissioners from which the approximate amount to be assessed
against any particular lot or parcel of property may be determined, but
further it is stated that the estimated cost per lot is $936.37, based upon
the Engineer's estimated cost divided equally among 121 lots in the
subdivisions.

6. It is anticipated that special assessment bonds will not be
issued.
7. Upon completion of said improvements, or as soon as the total cost
thereof is definitely ascertained, the cost of the improvements shall be
apportioned equally to each of the described lots in Northmoor Acres
Subdivision and Northmoor Acres Second Filing. Notice of such apportionment
shall be given and a hearing will be held prior to the adoption of a
resolution or ordinance assessing such cost, all as provided by law.
8. Not less than thirty (30) days after the publication of this
Notice, a resolution authorizing said improvements will be considered by the
Board of County Commissioners, to-wit: July 6, 1988, at 2:00 P.M. , or at an
adjourned meeting thereafter, in the meeting room of the Weld County
Centennial Center, 915 10th Street, Greeley, Colorado.
9. A map, estimate, and schedule showing the approximate amount to be
assessed and all resolutions and proceedings are on file and can be seen and
examined by any person at the office of the Clerk to the Board of County
Commissioners at any time during business hours on or before the date
referred to in paragraph 8.
10. All complaints and objections that may be made in writing
concerning the proposed improvements by the owner or owners of any real
property to be assessed will be heard and determined by the Board of County
Commissioners at the meeting specified above, or at some adjournment
thereof, before final action shall be taken.
All estimates include any of the costs of inspection and collection and
other incidental costs which may assessed to the District.

We, the undersigned petitioners, do hereby request that the
Weld County Road and Bridge Director and/or the Weld County
Commissioners approve and so order the paving of the following
described sections of roads located in Southwest Weld County:
That portion of County Road 44 starting
at Interstate 25, East to the Junction
of County Road 11 . County Road 11 South
to County Road 42 to the junction of
County Road 13.
As a result of the development of this area, which previously
was used for agriculture, the County has enjoyed a tax base
growth for this tract of property in excess of Ten Million
Dollars. The amount of traffic carried on the above described
roads has increased to the point where we are forced to drive
on roads that are substandard and unsafe. • Within a few days
after the roads are graded, that portion from I-25 to Northmoor
Drive becomes ruts and washboard. This condition makes it
difficult to control a vehicle and creates a dangerous driving
situation. When the road is dry, the dust problem has reached
the point where it is environmentally unacceptable. When the
road is wet, we are required to drive in mud.

It is our opinion that in view -of the current low oil prices
. and the high cost of properly maintaining this section of road,
it would be both cost effective and consistent with county
policy to provide services to areas which pay for them by
virtue of tax contribution.

Dear Mr. Rutt:
This letter is in response to your letter and petition dated
October 19, 1987 regarding the paving of three miles of Weld County
Roads in the Northmoor Acres area.
It has been the policy of the Board of Weld County Commissioners that
the expenses of paving roads that access subdivisions must be shared
by the lot owners within the subdivision and the county. Recently,
the access to Indianhead Subdivision on Weld County Road 15 was paved
in this manner. The direct cost of the asphalt and the labor cost to
lay down the asphalt was shared equally by each individual lot owner.
The cost to Weld County for the Indianhead project including lay down
was .$21.30. If two inches of asphalt was laid on the three miles of
access requested by the petition, the cost for asphalt would be
$98,000.00. Spread over 121 lots in Northmoor Acres, the expense per
lot would be approximately $800.00. All preparatory work, such -as
importing base course, grading, compaction, watering and shoulder
construction would not be charged to the lot owners.
Also, the Board of Weld County Commissioners has established a method
to spread the cost over a period of ten years. An interest rate of
10% simply compounded over a ten-year period would be charged. The
annual cost to repay $800 at 10% would be $130.20.
The formation of a local improvement district to accomplish such a
project follows specific legal steps. If you think homeowners in
Northmoor Acres would be willing to create a Special Improvement
District please contact Lee Morrison, Assistant County Attorney,
