RE: APPROVE CONTINUANCE OF HEARING TO CONSIDER REQUEST OF CECIL
W. KING FOR A CHANGE OF ZONE FROM A (AGRICULTURAL) TO P.U.D. ,
(PLANNED UNIT DEVELOPMENT) WITH R-1 (LOW DENSITY RESIDENTIAL)
USES
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 13th day of May,
1987 , at 2 : 00 p.m. for the purpose of hearing the application of
Cecil W. King, 4707 Weld County Road 29, Fort Lupton, Colorado
80621 , requesting a Change of Zone from A (Agricultural) to P.U.D.
(Planned Unit Development) with R-1 (Low Density Residential) uses
for a parcel of land located on the following described real
estate, to-wit:
Part of the SEq SE;, Section 9 , Township 1
North , Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, Section 28 . 4 . 1 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners, after hearing the
testimony and statements of those present, studying the request of
the applicant and the recommendation of the Weld County Planning
Commission , deems it advisable that this hearing be continued to
July 15 , 1987 , at 2 : 00 p.m. , to allow the applicant time to obtain
additional information regarding the proposed water supply and
roads.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the application of Cecil W. King for a Change of Zone
from A (Agricultural) to P.U.D. (Planned Unit Development) with
R-1 (Low Density Residential) uses be, and hereby is, continued to
July 15 , 1987 , at 2: 00 p.m. to allow the applicant time to obtain
additional information concerning the proposed water supply and
roads for presentation to the Board.

RE: CHANGE OF ZONE FROM A (AGRICULTURAL) TO Y.U.D. (PLANNED UNIT
DEVELOPMENT) , R-1 (LOW DENSITY RESIDENTIAL) - CECIL W. KING
A public hearing was conducted on May 13, 1987, at 2:00 P.M. , with the
following present:
Commissioner Gordon E. Lacy, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Gene Brantner
Commissioner Jacqueline Johnson
Commissioner Frank Yamaguchi
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Rod Allison
The following business was transacted:
I hereby certify that pursuant to a notice dated March 23, 1987, and
duly published April 2, 1987, in the Johnstown Breeze, a public hearing
was conducted to consider the request of Cecil W. King for a Change of
Zone from A (Agricultural) to P.U.D. (Planned Unit Development) with
R-1 (Low Density Residential) uses. Lee Morrison, Assistant County
Attorney, made this matter of record, noting that this hearing was
continued from May 6, 1987, to allow proper posting of the property
under consideration. Rod Allison, Planning Department representative,
read the recommendation of the Planning Commission for denial of this
application into the record. Tim Callahan came forward to represent
the applicant and addressed the concerns of the Planning Commission
regarding the proposed P.U.D. In response to a question from
Commissioner Johnson, Mr. Allison stated that this request is being
submitted as a P.U.D. because the applicant could not meet the
subdivision requirement of public water and sewer service. Much
discussion was held about the availability of water and well permits in
this area. Carl Passmore, an adjacent landowner, came forward to speak
in favor of granting this request. Mr. Allison reviewed the steps
involved in the P.U.D. process, and stated that more information is
required of the applicant. It was the consensus of the Board that
additional information is needed concerning various water possibilities
and road improvements which may be necessary. Mr. Callahan stated that
sixty days would be necessary to obtain the requested information.
Commissioner Johnson moved to continue this hearing to July 15, at 2:00
p.m. , at which time the applicant is to present further information
concerning water and roads. The motion was seconded by Commissioner
Brantner and carried unanimously.
