ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT, by and between the WELD COUNTY, STATE OF
o U COLORADO, hereinafter called "County" , and Ball Corporation
o Aerospace Systems Division, hereinafter called "Operator" , is

A WHEREAS, the Operator has applied for a Change of Zone from
o w• an agricultural zone to a Planned Unit Development for a Cryogenic
o Research Center to be located in the South one half (S 1/2) of the
o a Norhtwest one quarter (NW 1/4 ) and the Southwest one-quarter (SW
«n A 1/4 ) of Section 27, Township 4 North, Range 68 West of the 6th
o• Principal Meridian, Weld County, Colorado.

w NOW, THEREFORE, in consideration of the mutual covenants and
n conditions hereinafter set forth, the County and Operator mutually
rn agree as follows :

a 1 . The designated route to be improved by the Operator will

Q, U be Weld County Road 7 from the north property line of
z the Cryogenic Research Center to the south for a distance
O H of approximately one mile. The County will improve the
: H road from that point to Weld County Road 38, a distance
rim of approximately 3/4 mile.

rn w 2. The Operator will upgrade the one mile section according
rn w to Exhibit A. The County will upgrade the 3/4 mile
o z section with approximately 4" gravel. The County will

o from Weld County Road 38 to the north property line of

3 . The County has the authority to designate to the Operator

Reference: Ball Aerospace Systems Division (BASD)
Cryogenic Research Center (CRC)
This letter is relative to a telephone conversation between Rod Allison,
Weld County Planning Department , and Jeff LeDoux, Nelson Engineers, on
August 17, 1987; relaying your message to Ball Aerospace Systems Division
concerning the offsite road improvement agreement for the referenced
property. It is our understanding from that conversation that the
commissioners have determined that BASD should be responsible for the
total cost to improve Weld County Road (WCR) 7, from WCR 38 to 1/4 mile
south of WCR 42 and that Weld County will continue the maintenance of the
road. We ask that you re-evaluate your decision for the following
reasons :
1. WCR 7 is presently in need of improvement whether or not
the CRC site is developed. This will be particularly
true when the bridge 3/4 mile north of the site is
repaired and the traffic along WCR 7 increases . It is
our understanding that Weld County has filed for federal
funds to assist in the repair of this bridge.
2. The CRC projected volume of traffic on WCR 7 will be
approximately 20% of the existing traffic and the
sharing of road improvement cost appears justified.
3. In previous discussions with the County Engineer
concerning the CRC and its low volume of traffic (17
AADT) using a County gravel road, he indicated that a
gravel road would be adequate as long as the AADT was
less than 200. Once the AADT is above 200, paving is
necessary to meet dust emission standards . BASD has
assumed from these discussions that WCR 7 was adequate
and met County gravel road standards, and therefore BASD
did not anticipate any offsite road improvement cost.
