HomeMy WebLinkAbout870394.tiff n5 RESOLUTION RE: APPROVE AMENDMENT OF USE BY SPECIAL REVIEW FOR LIVESTOCK CONFINEMENT OPERATION TO ALLOW 3 ,000 HEAD - DOUBLE EIGHT LAND CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of May, 1987 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Double Eight Land Corporation, 39644 Weld County Road 39 , Ault, Colorado 80610 , to amend a Use by Special Review for a livestock confinement operation to allow 3,000 head on the following described real estate, to-wit: Part of the NWa, Section 17 , Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by G. Preston Williams, and WHEREAS, Section 24 .4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning. Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4.2 of the Weld County Zoning Ordinance as follows: a . The proposed use is consistent with the Weld County Comprehensive Plan Urban Growth Goals and Policies in that: (1) The proposed use is located within the Urban Growth Boundary of ean existing municipality. (3) The proposal does not constitute leapfrog development. (4) This proposal is compatible with the Comprehensive Plan' s transportation and public facilities and service goals and policies because it will not impact or require additional public facilities and services . b. The proposed use as a livestock confinement operation is provided for as a Use by Special Review in the A (Agricultural) Zone District. c. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan, and the Town of Ault' s Comprehensive Plan. The Town of Eaton has no objection to this request. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado , that the application to amend a Use by Special Review for a livestock confinement operation to allow 3 , 000 head on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review permit is for an amendment to an existing Use by Special Review for a livestock confinement operation increasing the capacity from 2, 100 head to 3 ,000 head of cattle as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein . The maximum number of cattle permitted shall be 3 , 000 . The livestock confinement operation shall be used for cattle only. The confinement of other animals shall require an amendment to the Use by Special Review permit. 2. No structures shall be allowed within 20 feet from the top edge of the bank of the Larimer and Weld Canal. 3. Liquid waste from the retention pond shall be pumped to farm ground for use as irrigation water and soil conditioner, and shall not be discharged to State waters. 4. The applicant shall be responsible for implementing and maintaining the runoff retention and containment facilities in accordance with the engineered report as approved by the Colorado Department of Health, Water Quality Control Division. All runoff retention and containment facilities shall meet and be maintained in accordance with the State Health Department' s Guidelines of Feedlot Runoff Containment Facilities and standards stated herein. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. 5. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6. The property owner or operator shall be responsible for complying with the Design Standards of Section 24. 5 of the Weld County Zoning Ordinance. 7. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 870394 1 � J Page 2 DEVELOPMENT STANDARDS - DOUBLE EIGHT LAND CORPORATION 8. Personnel from the Weld County Health Department, Weld County Department of Planning Services, and the Colorado Department of Health shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 9. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Morrison Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated April 13, 1987, and duly published April 30, 1987, in the Johnstown Breeze, a -public hearing was conducted to consider the request of Double Eight Land Corporation to amend a Use by Special Review for a livestock confinement operation to allow 3,000 head. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Swanson, Planning Department representative, read the favorable recommendation of the Planning Commission, which is subject to two Conditions and ten Development Standards, into the record. G. Preston Williams, vice president of Double Eight Land Corporation, came forward to answer questions of the Board. He stated that he has no problem with the proposed Development Standards. No public comment was made concerning this request. Commissioner Johnson moved to approve the request to amend the Use by Special Review, subject to the Conditions and Development Standards as recommended. The motion was seconded by Commissioner Brantner and carried unanimously. This Certification was approved on the 27th day of May, 1987. A quorum was present. The summary of the last regular meeting of the Weld County Planning Commission held on April 21, 1987, was approved as distributed. The Chairman announced Shawn Elworthy is requesting his case be postponed. Therefore, this request will be heard first in case the proposal is postponed and there are people in the audience who have come to hear this presentation. CASE NUMBER: USR-789:87:14 APPLICANT: Shawn Elworthy REQUEST: Use by Special Review permit for a commercial welding shop in the A (Agricultural) Zone district. LEGAL DESCRIPTION: Part of the W} of Section 32, T7N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: Adjacent to an annexed portion of the Town of Windsor, east of Weld County Road 15, and south of Weld County Road 76. APPEARANCE: Shawn Elworthy, property owner and applicant, asked that this case be continued until the May 19, 1987, meeting of the Planning Commission because one of his key witnesses is out of town, and he just discovered yesterday that the Planning Staff's recommendation is for denial. He would like additional time to respond to this recommendation. Denise Hamernick, surrounding property owner, reported both she and her husband work in Fort Collins. They moved here because they did not want anything industrial or commercial in the area. The Elworthy's work in the building until late at night and disturb the neighborhood. The Chairman stated the Planning Commission does not want to hear any testimony at this time. The question is: should this case be continued. Jim Seifken, surrounding property owner, stated he did not want to see this case continued because Mr. Elworthy should have had ample time to prepare for this request. Andi McCoy, surrounding property owner, reported she had taken off work to come to this hearing. She asked that the request not be continued. MOTION: Lynn Brown moved Case Number USR-789:87:14 for Shawn Elworthy for a Use by Special Review permit for a commercial welding shop in the Agricultural zone district be heard today because of the imposition it would cause the surrounding property owners to continue the case to May 19. That testimony not be heard from the surrounding property owners and then the request be continued because of the difficulty in maintaining continuity that this presents, and that this request be moved back to its original position on the agenda. Motion seconded by Paulette Weaver. The Chairman called for discussion from the members of the Planning Commission. No further discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. CASE NUMBER: USR-780:87:4 APPLICANT: Thomas McCauley (Continued from April 7, 1987) REQUEST: Use by Special Review permit for a single family dwelling unit on a parcel of land under the minimum lot size. LEGAL DESCRIPTION: Part of the Ni SW} of Section 18, TBN, R67W of the 6th P.M. , Weld County, Colorado. LOCATION: 9 miles west and 1 mile north of Pierce. Summary of the Weld County Planning Commission Meeting May 5, 1987 Page 3 APPEARANCE: Gerry McRae, P.E., McRae and Short, Inc. , represented the applicants. He asked that testimony apply to both of this case and the following case. Information on these two cases was presented on April 7, 1987. The Planning Commission continued these cases to allow more information from the Soil Conservation Service to be obtained. The Chairman asked if there was anyone in the audience who represented the Soil Conservation District. Milton Baumgartner, Chairman, West Greeley Soil Conservation, the Soil Conservation Authority for this area. They do not have any detailed information on land divisions. This would take a case by case review. Most housing areas do follow their recommendations. There is not an erosion problem in this area because most of the land has not been broken out of native grasses. He suggested covenants or standards which contain the Soil Conservation Services' recommendations be filed with the deed. The Soil Conservation Service is a referral agency; not an enforcement agency. Tom Varra, owns property in the area and is on the Soil Conservation Board. This area is going to have a lot of pressure for development. It lays along a ridge with a beautiful view and is close to Fort Collins. Development in Larimer County and the Budweiser plant, which is about one mile away, have • already changed this area considerably. Lee Morrison explained when the Board of County Commissioners cannot be enforcement officers. Tape 279 - Side 1 Unbroken land requires a plowing permit. Jerry McRae reported this 160 acre site is presently farmed in dryland wheat. He asked that Development Standard #2 be rewritten to protect this land when the farming operation is discontinued. AMENDMENT: Lynn Brown moved a new Condition 4 be added to read as follows: 4. Prior to the issuance of a building permit, a soil conservation plan approved by the West Greeley Soil Conservation District shall be submitted to the Department of Planning Services. Milton Baumgartner stated he felt a soil conservation plan should be required continuous to subsequent owners because in this area twenty acres of land is required for a cow and a calf. AMENDMENT: Paulette Weaver moved Development Standard Number 2 be amended to include the following: 2. The Soil Conservation Plan approved by the West Greeley Soil Conservation District shall be maintained and complied with on the property, and the property shall remain within the boundaries of the West Greeley Soil Conservation District or its successors. Summary of the Weld County Planning Commission Meeting May 5, 1987 Page 5 Clyde Abbott, Chairman, Platte Valley Soil Conservation Service, asked if these rules were going to be just for this development or will they be County wide? He asked the Planning Commission to realize they are dealing with nine separate soil conservation districts within the County and he feels there should be something County wide. Now is the time to work out a plan, County wide, that all districts could participate in. Chad Noland, surrounding property owner, reported he owns property within one—half mile of this request. He also has three cases coming before the Planning Commission today. They are not talking about a large development. He is concerned that the land should not be disturbed as this is marginal agricultural land, and rules should be set and enforced to preserve it. The Chairman asked the applicant if he had reviewed the recommendations, conditions, and development standards as outlined by the Department of Planning Services staff. He stated they have and have no objections to these as amended. • MOTION: Ann Garrison moved Case Number USR-780:87:4 for Thomas McCauley for a Use by Special Review permit for a single family dwelling unit on a parcel of land under the minimum lot size be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for denial based on the fact • that the County cannot, with the current resources it has available, enforce any regulations we setdown to protect the environment. Also, she would like to tie her recommendation to the new Comprehensive Plan, page 26, #4 within the Agricultural Policies and also on page 41, conditions 4, 5, and 7. Condition #5 says that new residential development shall demonstrate compatibility with existing surrounding land-use in terms of general use, building heights, scale, density, traffic, dust, and noise. Condition #7 says that there should be conservation of natural site features such as topography, vegetation, and water courses should be considered in project design. She does not believe that at this time we are able to fulfill conditions either 4, 5, or 7 given this residential development . Motion seconded by Paulette Weaver. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Paulette Weaver - Yes, she agrees with everything Ann stated. Unfortunately we don't have the staff to design or enforce plans. If people would act responsibly we would not have to worry, but unfortunately we have too many cases where they don't. At this time more breakup of these- lands is not in Summary of the Weld County Planning Commission Meeting May 5, 1987 Page 6 the best interests of the County or the people in the area. Louis Rademacher - No, because they say Greeley should be up there and prime agricultural land would then still be intact, but they don't want to develop up there when this land is not suitable for farming and doesn't bring in revenue for the County. He feels this development would bring in some • revenue for the County. LeAnn Reid - Yes; Lynn Brown - No; Lydia Dunbar - No, because we do have to have some people for our land too. Ann Garrison - Yes; Jack Holman - Yes, because once we begin a project like this there is no stopping it. Therefore it is better to stop it here than to allow it to continue. He realizes that we have have approved a couple of land splits such as this in this area, but he is afraid that if we don't stop it now it will be a continuous thing for all of the property in this area, and dividing the property is probably not the best thing to do with the property in this particular area. Motion carried with four voting for the motion and three voting against the motion. APPEARANCE: Jerry McRae, P.E., McRae and Short, Inc., represented the applicant. He asked that comments from the previous testimony be entered into the record and applicable to this request. Lee Morrison explained that even though the comments from the previous case are applied to this request, the Planning Commission should amend the conditions and development standards to correspond to the previous amendments. AMENDMENT: Paulette Weaver moved Condition 114 be added to read as follows: 4. Prior to the issuance of a building permit, a soil conservation plan approved by the West Greeley Soil Conservation District shall be submitted to the Department of Planning Services. MOTION: Ann Garrison moved Case Number USR-781:87:5 for Thomas McCauley for a Use by Special Review permit for a single family dwelling unit on a parcel of land under the minimum lot size be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for denial based upon the reasons outlined in USR-780:87:5. Motion seconded by Paulette Weaver. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Paulette Weaver - Yes, for the reasons stated in USR-780. Louis Rademacher - No, for the same reasons stated in USR-780; LeAnn Reid - Yes; Lynn Brown - No, because clearly we have heard evidence that this is marginal land for agricultural purposes. It is adjacent to a lot of rapid development within Larimer County, and we have not heard clear-cut evidence that reducing the plots to 80 acres is going to Summary of the Weld County Planning Commission Meeting May 5, 1987 Page 8 either enhance or worsen the state of the soil conservation. Lydia Dunbar - No, for the reasons stated in USR-780; Ann Garrison - Yes; Jack Holman - Yes, for the same reasons stated in USR-780. Motion carried with four voting for the motion and three voting against the motion. CASE NUMBER: USR-782:87:6 (Continued from April 7, 1987) APPLICANT: Chad and Jaymie Noland REQUEST: Use by Special Review permit for a single family dwelling unit on a parcel of land under the minimum lot size. LEGAL DESCRIPTION: Part of the Ni SW} of Section 7, T8N, R67W of the 6th P.M. , Weld County, Colorado. LOCATION: 9.5 miles west of Pierce and 2.5 miles north of Pierce. APPEARANCE: Chad Noland, property owner and applicant, passed around pictures of this area. These were retained as evidence. He asked that testimony be applied to all three cases. This land is different from the previous two cases because this is grassland and has never been broken out of native grasses. These proposed tacts are one—half mile wide by one—fourth mile long. Taxes on twenty acres of dryland are twenty dollars per year, but taxes on the eighty acres his house is on are $1,200 per year. They will require no new utilities that have not been run into the area. The County road is already maintained by the County. Lee Morrison reminded the Planning Commission that eighty acres of irrigated or 160 acres of dryland are required for a single family residence in rural Weld County. The Chairman called for discussion from the audience. John Byrns, Fort Collins, stated if this request is granted he wants to build him home on one of these parcels. He would intend to be a guardian of the land. It is unsuitable for farming and grazing in parcels of this size. He would be willing to comply with the soil conservation recommendations. It is unfair to punish those who intend build homes and live in this area as the size of the parcel is no indication of soil erosion. Dwight Morgan, KCOL Corporation, reported they have a four hundred foot high radio tower on this site and they expect to install a new nine hundred and twenty-one foot tower. They have obtained approval from the FCC to install this new tower and it would have no environmental hazards. They are requesting easements for these anchor points. Personally, he feels Chad Noland is doing the right thing with this land. Summary of the Weld County Planning Commission Meeting May 5, 1987 Page 9 Lanell Swanson reported the KCOL radio tower site is described under Conditional Use Permit #1 and if they install a new tower they will need to apply to amend their Conditional Use Permit. Tom Varra, surrounding property owner, stated he is not speaking for the Soil Conservation Service now, but for himself. He wants the Planning Commission to know Mr. Noland has 320 acres and he feels it should not be broken down any smaller than 80 acres parcels because in the future it may bring congestion to the area and the land should remain in compliance with the Comprehensive Plan. Lanell Swanson reminded the Planning Commission members Condition #4 and Development Standard #2 should be amended to comply with those in USR-780 and 781 to insure the land will remain in native grasses. AMENDMENT: Paulette Weaver moved Condition 1/4 be added to read as follows: 4. Prior to the issuance of a building permit, a soil conservation plan approved by the West Greeley Soil Conservation District shall be submitted to the Department of Planning Services. The proposed use of the property would be a continuation of a cattle feedlot operation, with the exception of an increased capacity from 2100 head to 3000 head. There is a total of 15 feedlot pens existing on 10.58 acres. 3690 linear feet of concrete feedbunk with apron and headrail is also part of the improvements. Double 8 is requesting an amended permit to allow an increased legal capacity of the. feedlot. Supporting data proves that 3000 head of cattle can easily be fed with the existing improvements. The amended permit would allow this feedlot to operate at it's utmost: efficiency. Adjacent property owners listed on permit application are involved in three types of agriculture activities. These uses are row-crop farming, sheep feeding, and cattle feeding. The location and ownership of residential structures within a mile of the property is shown on the attached map. The number of employees would be approximately two full-time individuals with occasional part-time help. The source of water will continue to be a 3/4" tap serviced by North Weld County Water District. See attached letter of certification, Access to the feedlot is available by Colorado State Highway 14 and Weld County Road 39, which is paved. Vehicular traffic will continue to exist as it has previously with the normal activity of the feedlot. This involves the use of a feed mixer truck and occasional grain and livestock deliveries by semi-truck. Sewage favilities existing on the property are septic systems approved by Weld County Health Department. An evaluation was made on December 18, 1986. An 80 by 200' silage bunker exists for silage storage. Approximately 10 plus additional acres are available for feed storage and equipment. A storm water retention facility and animal waste system does exist and is approved by Weld County Health Department. Please see attached letter. Should this property cease to be used as a feedlot, reclamation plans are to return the area to pasture. Since this is an existing operation no construction or start-up dates are applicable. SUPPORTING DOCUMENTS AND MATERIAL REQUIRED FOR APPLICATION: The existing feedlot was and will remain consisted with the Weld County Comprehensive Plan in an agricultural zone district. A feedlot operating in this area is compatable since the district contains -several other sheep and cattle feeding operations. The location of the feedlot was chosen based on the lack of productivity as farmground. The feedlot concerned has operated for the past 15 years with no negative impact on the health, safety, and welfare of its neighbors. Surrounding land is used for row crop farming, cattle and sheep feeding. Owners and operators are shown on attached map. The feedlot being located in an agriculturaly zoned area, and being surrounded by cattle and sheep feeders as well as farming operations proves that it is and will be compatible with future development.
