RE: APPROVE ACTION OF BOARD OF COUNTY COMMISSIONERS OF WELD
COUNTY, COLORADO, CONCERNING SITE APPLICATION OF TOWN OF
PIERCE AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has received a Site Application from the
Town of Pierce concerning the application of wastewater onto
farmland located on the following described parcel of land,
to-wit:
Part of the NWk SWi SWe NWI of Section 36 ,
Township 8 North, Range 66 West of the 6th
P.M. , Weld County, Colorado
WHEREAS , the Regulations for Site Applications for the
application of wastewater onto farmland require review of the Site
Application by the Board of County Commissioners, and further,
that various local and State agencies be given the opportunity to
review and comment on said Site Application, and
WHEREAS, the Site Application from the Town of Pierce was
submitted to the Board of County Commissioner of Weld County for
review and comments, a copy of said Application being attached
hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board finds that said
Site Applicaiton is compatible with the Weld County Comprehensive
Plan and that it is in the best interest of Weld County to
recommend approval of said Application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Site Application
submitted by the Town of Pierce be, and hereby is, recommended
favorably to the Water Quality Control Division as being
compatible with the Weld County Comprehensive Plan.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Site Application.

ATTACHMENT TO SITE APPLICATION
In accordance with C.R.S. 1981, 25-8-702 (2)(a) , (b) , and (c), and the "Regulations for Site
Applications for Domestic Wastewater Treatment Works" , the Water Quality Control Division mus
determine that each site location is consistent with the longrange, comprehensive planning fo
the area in which it is to be located, that the plant on the proposed site will be managed to
minimize the potential adverse impacts on water quality, and must encourage the consolidation
of wastewater treatment works whenever feasible.
In making this determination, the Division requires each applicant for a site approval for a
domestic wastewater treatment works to supply an engineering report describing the project an,
showing the applicant's capabilities to manage and operate the faility over the life of the
project to determine the potential adverse impacts on water quality. The report shall be
considered the culmination of the planning process and as a minimum shall address the
following:
Service area definition including existing population and population projections,
flow/loading projections, and relationship to other water and wastewater treatment plants
in the area.
Proposed effluent limitations as developed in coordination with the Planning and Standard:
Section of the Division. (Allow minimum four weeks processing time. )
Analysis of existing facilities including performance of those facilities.
Analysis of treatment alternatives considered.
Flood plain and natural hazard analysis.
Detailed description of selected alternatives including legal description of the site,
treatment system description, design capacities, and operational staffing needs.
Legal arrangements showing control of site for the project life.
Institutional arrangements such as contract and/or covenant terms for all users which wil
be finalized to accomplished acceptable waste treatment.
Management capabilities for controlling the wastewater throughout and treatment within th(
capacity limitations of the proposed treatment works, i.e. , user contracts, operating
agreements, pretreatment requirements.
Financial system which has been developed to provide for necessary capital and continued
operation, maintenance, and replacement through the life of the project. This would
include, for example, anticipated fee structure.
Implementation plan and schedule including estimated construction time and estimated
start—up date.
Depending on the proposed project, some of the above items may not be applicable to address.
In such cases, simply indicate on the application form the non applicability of those.

Attachment to Site Application
The City of Thornton would like to run a pilot program, using sewage
effluent from the Town of Pierce to irrigate approximately 18 acres of
farmland. The basic concept is to use the available treated effluent from the
Pierce facility in conjunction with ditch water to irrigate the farmland.
The proposed project will not interfere with or change the treatment
process currently in place at the Pierce facility. The effluent currently
runs into one of three rapid infiltration ponds built under NPDES Permit
Number CO-0041211 . The City of Thornton is proposing to divert the water from
the infiltration ponds to an irrigation lateral . When the lagoon is full
approximately 1 . 16 cfs will be available for irrigation. When the level of
the lagoon drops about 2 feet to the bottom of the outlet pipes in the maximum
amount of water available will be about .6 cfs. The total amount of water
available for this project is 14 acre-feet when the lagoon is full and can be
used at a maximum rate of 1 . 16 cfs to 0.6 cfs depending on the level of the
lagoon. The usable storage in the lagoon could be used in about 8 days at
maximum rates. It will , however, take just about one month to fill the lagoon
again at the maximum daily design capacity of the treatment facility.
Although the amount of water available for irrigation will be limited in
this operation the City of Thornton will be using the project to show that
treated sewage effluent can be used to irrigate farmland.

Moved by Ann Garrison that the following resolution be introduced for
passage by the Weld County Planning Commission. Be it Resolved by the Weld
County Planning Commission that the Chairman sign the Site Application
indicating the Planning Commission's recommendation for approval for:

Federal, State, and local regulations pertaining to air, water, noise, and

J. Lee Bailey, Project Manager, explained their plans for recycling effluent
from the town of Pierce's sewage lagoons.
The Chairman asked Keith Schuett to read the recommendation of the
Department of Planning Services staff into the record.
Wes Potter asked that the conditions of approval recommended by the Health
Department be deleted. According to the tests done on the lagoons, the
quality of wastewater is much higher than was expected.

The Department of Planning Services' staff recommends approval of this
request with certain conditions. The application of wastewater onto
farmland will not adversely affect the local water quality if the conditions
of the Weld County Health Department are met.
The request is compatible with the Weld County Comprehensive Plan
Environmental Quality and Natural Resource Section which states: "All land
use proposals shall be designed and operated to conform to all applicable
Federal, State, and local regulations pertaining to air, water, noise, and
other environmental quality standards." Conditions of approval set forth by
the Weld County Health Department will ensure environmental quality
standards are met.
The Department of Planning Services' staff's recommendation for approval is
conditional upon the following:
1. The facility shall follow a nondegradation policy regarding the
groundwater at the application site. The groundwater quality
shall not be degraded beyond the existing levels at the site.
2. The facility managers shall conduct consistent monitoring of the
effluent quality, irrigation water quality, and the field crop
uptake. The effluent application rates shall be adjusted
accordingly to ensure that the water percolating to the
groundwater table will not degrade that water quality below the
existing levels at this date. This adjustment includes
termination of the application of effluent in the event that the
groundwater quality at the site is deteriorating.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The Colorado Department of Health, Water Quality Control Commission's
regulations require that the applicant submit the site application to all ,
appropriate local governments, planning agencies, and state agencies for
review and comment prior to submission to the Colorado Department of
Health's District Engineer.
The regulations further state that if the proposed facility is located in
the unincorporated area of a county, the county planning agency should be
requested to comment upon the relationship of the treatment works to the
local long-range comprehensive plan for the area as it affects water
quality, including the location in the flood plain and capacity to serve the
planned development.
The Weld County Health Department is recommending denial of the application
because it is incomplete and there are serious concerns about ground water
contamination at this site.

TECHNICAL APPENDIX A AMENDMENT TO INCLUDE ADDITIONAL POINT OF DISCHARGE,
TOWN OF PIERCE WASTEWATER EFFLUENT
INTRODUCTION
The Town of Pierce currently operates a Minor Municipal Lagoon Plant, to
treat and discharge its wastewater (Plate I) . The plant consists of the
following major elements: an aeration pond with three surface aerators, a
chlorinator, and three infiltration ponds. Four groundwater monitoring wells
(one up-gradient and three down-gradient) are utilized to collect groundwater
samples to monitor the effluent quality.
The Town of Pierce and the City of Thornton have entered into an
agreement to mix the waste water effluent with irrigation water from the
Collins Lateral . The mixed water would be used to irrigate approximately 18
acres of farm land adjacent to the plant (Figure 1) . The mixed water would be
used periodically during the months of April through October. When mixed
water is not being used, the effluent would be discharged through the
infiltration ponds in accordance with the existing permit.
DESCRIPTION OF PROPOSED OPERATION
Effluent would be discharged at rates ranging from 0 to 0.6 cubic feet
per second (cfs) , depending on crop need and/or nutrient load. Flow of
irrigation water in the lateral would range from .6 to .7 cfs, resulting in a
maximum ratio of lateral water to effluent of 1 to 1 .
The maximum usable storage of the lagoon is 14 acre-feet. The discharge
from the lagoon would vary from 0 to 0.6 cfs. At the maximum rate of flow it
would take approximately 12 days to drain the storage capacity of the lagoon.
It would take approximately 30 days to refill the lagoon at the design
capacity of influent flow. Consequently, the 30-day average flow would be

0. 1521 million gallons per day (MGD) . This value is less than the existing
permitted capacity of 0. 1788 MGD.
SITE CHARACTERISTICS
The site is characterized by relatively flat terrain, which slopes to
the south at approximately 25 feet per mile (< 1%) . The principal surface
water feature in the area is Spring Creek, which drains the proposed area to
be irrigated.
Soil in the area is the Dacono Clay Loam. The thickness of the soil is
approximately 2.3 feet. The soils are derived from the underlying sand, and
silty clay. Figure 2 is a hydrogeologic cross-section drawn through four
wells drilled just east of the facility. The cross-section indicates that the
soils are underlain by 3 to 5 feet of sandy, silty clay. Underlying the clay
is 25 to 27 feet of very gravelly sand. Underlying the sand is bedrock. The
bedrock is the Laramie Formation, which is composed of shale, claystone and
siltstone.
The City of Thornton has been monitoring the water levels in the wells
Ishown on the cross-section. Depth to water measurements are made twice a
month during the irrigation season, and once a month during the non-irrigation
Iseason.
IThe seasonal maximum and minimum water levels are shown on Figure 2.
Water levels are highest near the end of the irrigation season and lowest just
Iafter the start of the irrigation season. Water level measurements in the
monitoring wells around the infiltration pond show the same relationship.

groundwater is flowing to the south-southeast at a gradient of 25 feet per

mile. A long-term pc ping test was conducted in an i, rigation well just east
of the facility (Figure 1) during September of 1987. The analyses of the test
idata indicated a hydraulic conductivity on the order of 500 to 750 feet per
' day (ft/day) . Groundwater modeling conducted by the City of Thornton
indicates a value of effective porosity of 0.20. Applying Darcy's Law: R =

K is hydraulic conductivity in feet per day
i is the hydraulic gradient in ft/ft, and
Pe is the effective porosity (dimensionless)
' yields a range of flow rates of 13 to 19 feet per day (4,700 to 6,900 feet per
year) .

WATER QUALITY
Three types of water will be involved in the proposed program. The
' three types are as follows:
1) Collins Lateral ,
i2) Waste Water Effluent, and
3) Groundwater
Samples of these three types of water have been collected and analyzed
for select chemical parameters and bacteria. The results of the analyses for
general water quality parameters are summarized on Table 1 , and complete
results are presented in Appendix A-1 . The analyses indicate that Collins
Lateral water has the best overall water quality, and the groundwater has the
' lowest quality.
Collins Lateral water is characterized by low nitrates and chlorides,
and moderate to high sulfate, total dissolved solids and coliform bacteria.
Monitoring Well Number 4 is the up-gradient well . The analyses for this well

are most representative of ambient groundwater quality. The analyses for Well
Number 4 indicate that the groundwater is characterized by relatively low
chlorides and high nitrates, sulfates, TDS and coliform bacteria (Sulfates,
TDS and coliform bacteria exceed drinking water standards) .
Analyses for trace metals in the Collins water and the effluent indicate
the concentrations are either below detection limits or well below standards
for drinking water, human health and agriculture (Table 2) .
MONITORING
The City of Thornton proposes to install a monitoring well at the
location shown on Figure 1 . Two samples would be collected during December,
1989 and March, 1990, to act as background water quality indicators. During
the irrigation season, groundwater samples would be obtained monthly from the
proposed monitoring well and the existing monitoring wells. Analytical
parameters for the monthly samples would be the same as those specified in the
existing permit. The background water quality samples would be analyzed for
the same parameters plus the drinking water metals.
A soil sample was collected from the area to be irrigated. The sample
was analyzed for physical properties and geochemical characteristics. The
results of the analyses are presented on Table 3 . We propose to collect soil
samples annually from the irrigated fields and analyze them for the parameters
indicated on Table 3. These parameters were selected to monitor the uptake of
metals and nutrients in the soil .

RE : November 21st Hearing on the Town of Pierce ' s Site
Application .
Dear Wes ,
I understand that the Planning Commission continued
action on the Site Application until December 5 , 1989 .
The continuance will allow Weld County Staff and the
applicant to discuss issues raised at the hearing .
I would like to address some of these issues if I
may .
If and when the Site Application is approved the
City of Thornton will enter into an "Operations
Agreement" that will address the overall operation of
the sewage lagoon with the Town of Pierce . Issues
addressed will include but not be limited to :
1 ) The proposed operation of surface
discharge of effluent will occur during the
irrigation season and will return to infiltration
bed discharge during the off -season and at other
times when surface discharge is not feasible or
permitted .
2 ) Operations will be monitored keeping the
processes within the lagoon , functioning as
designed thus keeping the effluent in compliance
with the NEDES permit . Ground water shall also be
monitored . Reports sh,.111 be routinely submitted to
the Town of Pierce and Weld County Health

3 ) Sewage effluent will be co-mingled with
surface irrigation waters at' a ratio of no less
then one to one during the irrigation season . (May
through October) No surface discharge shall occur
unless surface irrigation water is available for
co-mingling .
4 ) Compensation for leasing the sewage
effluent .
I will attend the Weld County Planning Commission
Hearing on Tuesday , December 5th , and be available for
• any questions or discussion regarding the Site
Application .

Subject:
The staff has reviewed the proposal for an amended site application for an
alternate point of discharge for effluent from the Town of Pierce
Wastewater Treatment Facility.
The Division recommends conditional approval based upon the following.
A. That the facility rigidly follow a non-degradation policy
regarding the groundwater at the application site. The Weld
County Health Department strongly endorses the concept of not
degrading the groundwater quality beyond the existing levels at
the site.
B. That the facility managers conduct consistent monitoring of the
effluent quality, irrigation water quality, and the field crop
uptake. The effluent application rates shall be adjusted
accordingly to insure that the water percolating to the
groundwater table will not degrade that water quality below the
existing levels at this date. This adjustment would include
termination of the application of effluent in the event that the
groundwater quality at the site is deteriorating.
