WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of April, 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Ulrich Farms , Inc. , 14605 Weld County Road 21 , Platteville, Colorado 80651, to amend a Special Use Permit to allow expansion of a livestock confinement operation (3500 cattle) on the following described real estate, to-wit: NEB, Section 22 , Township 3 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. J A SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING April 1, 1986 A regular meeting of the Weld County Planning Commission was held on April 1, 1986, in the County Commissioners' Hearing Room, Weld County Centennial Building, 915 Tenth Street, Greeley, Colorado. A quorum was present. The summary of the last regular meeting of the Weld County Planning Commission held on March 18, 1986, was approved as distributed. CASE NUMBER: Amended SUP-127:86:9 APPLICANT: Ulrich Farms, Inc. REQUEST: Amend a Use by Special Use permit to allow expansion of a livestock confinement operation LEGAL DESCRIPTION: The NEi, Section 22, T3N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 2.25 miles west of Platteville; north of State Highway 66 and east of Weld County Road 19 APPEARANCE: Ken Lind, Attorney, represented Ulrich Farms, Inc. This is an application to increase the size of an existing feedlot. In 1971 this was approved as a Special Use Permit for one thousand five hundred head of cattle. In the early 1980's this was increased to approximately two thousand head of cattle. The president of Ulrich Farms was not aware they needed to expand their Special Use Permit. This amendment would allow three thousand five hundred head of cattle. There are sprinkler systems in the corrals for dust control. Wastewater run-off, etc. , conforms to all State standards. The town of Platteville Planning Commission has met. He spoke to them on the phone, and they were unanimous in recommending approval of this expansion. Summary of the Weld County Planning Commission Meeting April 1, 1986 Page 2 Everything in the area is zoned agricultural and it is not within any town's expansion plan. Two petitions in favor of the expansion were circulated to the members of the Planning Commission. One was signed by all neighbors within a mile; only two neighbors were against this proposal. The second petition was circulated to those living further than a mile from the property. These were retained by the staff as evidence. Also, Ulrich Farms purchases the majority of their feed from farmers in the vicinity so the feedlot is an important source of income to the area. Ken Ulrich, Ulrich Farms, Inc. , explained their programs for odor, dust, and fly control. Also, expansion of the feedlot from two thousand two hundred to three thousand five hundred head will depend on the cattle market and other economic conditions. Debbie deBesche reported on a letter from Maxine Dudley, Colorado State Health Department, stating the Ulrich Farms have met the strictest standards for drainage ponds and run-off. Tape 236 - Side 2 The Chairman called for discussion from the members of the audience. Alvin Steinmark, Attorney, represented John DiTirro, Jr. , surrounding property owner. The DiTirro's are the nearest neighbors to this feedlot, and they are opposed to the expansion to three thousand five hundred head of cattle primarily because of the odor problem. He does not object to the feedlot staying at its current size. John DiTirro, Jr. , surrounding property owner, stated he is not here to cause hard feelings with his neighbors or to deprive them of a living, but he is against the expansion because of the odor problem. Richard Hergert, farmer living 1.5 miles north of the feedlot, stated he sells the majority of his corn to Ulrich Farms and he is in favor of this expansion. Randy Mayer, farmer living one-half mile south of the feedlot, reported he sells a lot of his crops to Ulrich Farms. He lives very close to the feedlot, but he does not notice the odor where he lives. Debbie deBesche reported Jackie Palombo, surrounding property owner, called and stated she was opposed to the expansion of the feedlot because of the odor, etc. She asked Mrs. Palombo to submit her objections in writing, but to date, the staff has not received any formal written objection. Summary of the Weld County Planning Commission Meeting April 1, 1986 Page 3 The Chairman asked the applicants if they had reviewed the recommendation, conditions, and Development Standards as outlined by the Department of Planning Services staff. They stated they have no objections to anything outlined. The Chairman asked Debbie deBesche to read the recommendations, conditions, and Development Standards into the record. MOTION: Lydia Dunbar moved Case Number Amended SUP-127:86:9 for Ulrich Farms, Inc. , to amend a Use by Special Use permit to allow expansion of a livestock confinement operation be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff and the testimony heard by the Planning Commission. Motion seconded by Lynn Brown. The Chairman called for discussion from the members of the Planning Commission. Discussion followed. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ann Garrison - yes; Louis Rademacher - Yes, he realizes that John DiTirro will have an odor problem once in awhile. He lives next to Reynold's Cattle Company and they enlarged from six thousand head to between ten and fifteen thousand head and a couple of times a year he will get a little odor, but it isn't all that bad. Many dairies have gone out of business now, and since he farms ten quarters, he and many other farmers need some local places they can sell their products to. Mrs. Kline has lived on this property and operated this business from her property since 1973. She has a small acreage and there are other small acreages and businesses in the area. She also has portable toilets which are used by construction companies, farm workers, and large gatherings. He presented a letter from a water attorney who felt she had a very good chance to continue to use this well for her business. The letter was retained by the staff for evidence. If her request to use the well in her business is denied they have made plans to haul water from an approved site to conduct their business. Rex Kline, son of Betty Kline, reported that in their yard they have a speaker turned up so they can hear it when they are outside. They did not realize this was offensive to any of their neighbors. They only have it turned up during the day now. They dump the refuse from their truck in an approved site in Larimer County. Barrels of liquid used in the portable toilets are stored outside. There are five tanks for salt water and one tank for oil that will be skimmed off of the salt water on this site. The salt water will be injected into the Alliance Formation, which is about 8,800 feet deep. They feel this is a safe way to dispose of salt water. They have also obtained the approval of the State Oil and Gas Conservation Commission. Lynn Volkers, Production Manager for this site reported there are one to two trucks entering the site each day. We presently have a Special Use Permit to grow and fatten 12C'O head of cattle and would li ! e to enlarge the permit to feed =500 head of cattle. 2. With agriculture being as depressed as it has been we need to be as efficient as we can be,. We feel a larger feedlot will help us Lie more efficient. The properties on all four sides and four ioinino corners are engaged in farming. Their major crops are corn , hay, 'potatoes, pinto beans, and onions. 4. The closest r esi dentual structures, other than our own , wool d bee ,about 300 ft. to the east , 1200 ft. to the south , 200_) ft. to the west , and .=o'x ft. to the north. - 5. This is not a commercial feedlot , therefore the only cattle owners would he John Ulrich or I enneth Ulrich. 6. The number of employees would be about 4, working 6 to 10 hours- per day. 7. Ther water used for the cattle would be ground water , which is from adjudicated wells. The wells are augmented through Central Weld Water Conservancy District. O. The access route would be Colo. Hyw. 66 to Weld County Road 2J , then 1/2 mile north on Weld County Road 21 . 9. The feed purchased would mostly be hauled in on farm trucks from neighbors. The cattle are hauled into and out of the lot on semi-trailers. To feed 51)0 head of cattle per year would require 40 loads of cattle hauled into the lot and eo loans of cattle out of the lot. The only increase in traffic would be to haul the cattle in and out of the lot. 10. the waste from the lot would be spread on the surrounding land. 11 . The only increase in facilities would be corrals, having almost no fire danger. 12. The ma::i mum number of animals would be 3500 cattle. 1:. The manure from the lot is spread directly on to farm ground weather permitting. If unable to spread di r-ectl y onto farm ground it will be stoc6p1Led on about I acre of ground to the west of the facilities. 1 =! . The economic cft feeding cattle wou] d dictate the rest of the construction. Hopefully by 1990 we would be -feeding the proposed :500 hd. Additional Information and Supporting Documents 1 . Weld County is a strong agricultural county in which cattle feeding is an important part. This feedlot will provide a market for about 1 ,500 acres of corn. 2. Since we are in an agricultural community, we feel that our- feed i of would be consi stant w.i th the intent of the district we are loc ate:d i.n. When we built the existing corrals, we did so on our least productive ground. Part of the corrals we built on very sandy soil which was very uneconomical to farm. The rest of the corrals were built on a small six acre field that was also some of our 1 east economical ground to -Fur m. 4. We see no danger to the surrounding inhabitants other than dust , which we have installed sprinklers in each corral to control the dust. 5. All thw: properties adjacent to the proposed lot are engaged in raising crops which include livestock: feed. We would provide en e: cellent market for the corn and hay from the neighboring properties. 6. The proposed feedlot would not be prohibitive to the growth and development of any town or subdivision since the closest one is Platteville and it is about three miles to the east. The possibility of F'lattevill{e growing to the west , toward the proposed feedlot is limited because of the South Platte River location. 7. The proposed feedlot is on some of the highest ground in the area. It is not in any flood plain . geologic hazard , and to our- hest of 1 ncwledoe not in a Weld County Airport overlay district. 3. The drinking water used for the IivestocE. will be from Well al Case No. :x.56, Exhibit A. We also have a 5/8 ' tap with Central Wald County Water District for emergency use. 9. However, it is common for feedlots to generate short periods of intensive heavy hauling with cattleliners. If this hauling occurs during periods when the road bed is saturated or when frost is coming out of the ground in the spring, extensive road damage can result. A Special Use Permit condition should be considered that would require the applicant to repair any road damage caused by heavy truck traffic that is generated by the feedlot. I note in the referral packet that the Colorado Department of Health has regulations for runoff control facilities that would contain the runoff from a 25-year, 24-hour storm. Mr. Lind presented, as Exhibit E, a letter from Central Colorado Water Conservancy District regarding a water augmentation plan. He also gave the Board copies of petitions from neighbors which had been previously presented. Ken Ulrich, an owner of Ulrich Farms, spoke regarding fly control, dust control, odor control and the runoff ponds. Mr. Lind requested that Development Standard #3, regarding repair of Weld County Road 21, be eliminated. It was the concensus of the Board that this Development Standard be retained. Mr. Lind was agreeable to this decision. Randy Mayer and Richard Hergert, neighbors and suppliers for Ulrich Farms, both spoke in favor of this application. Commissioner Brantner moved to approve amending the Special Use Permit, subject to the recommendations of the Planning Commission.
