RESOLUTION
RE: ESTABLISHMENT OF PEST CONTROL DISTRICT KNOWN AS THE CHALK
BLUFFS PEST CONTROL DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to the provision of Title 35 , Article 5 ,
CRS, the Board of County Commissioners of Weld County, Colorado,
caused a ballot to be mailed to the landowner in a given area,
requesting establishment of the Chalk Bluffs Pest Control District
for the eradication of grasshoppers , and
WHEREAS, the statute requires that at least sixty-six and
two-thirds percent (66 2/3%) of the landowners and lessees must
vote in favor of the district and that said landowners and lessees
own or lease fifty percent (50%) of the land in the proposed
district (excluding acreage owned by the federal government or
acreage owned by the state government not subject to a lease) , in
order that it be established, and
WHEREAS, the report of the accounting committee indicates
that these requirements have been met, and
WHEREAS, the Board believes it to be in the best interests of
the County to establish said district.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Chalk Bluffs Pest
Control District be, and the same hereby is, established, said
area being more particularly described as set forth in Exhibit
"A" , attached hereto and made a part of this Resolution by
reference.
BE IT FURTHER RESOLVED by the Board that said District shall
be established for a period beginning this date and to remain in
effect until June 15 , 1986.

As you recall, David L. True of the True Ranches, petitioned the
Board in July, 1985 , for the establishment of the Chalk Bluffs
Pest Control District near the Colorado/Wyoming boarder. He was
the only Petitioner, because the True Ranches owns all of the land
within the boundaries of the proposed district. On July 8 , 1985 ,
the Board signed a resolution authorizing the preparation of the
ballots for the vote to establish the pest control district. The
single ballot was mailed on July 24 , 1985 , to Mr. David True. The
ballot has been received by the Clerk to the Board, it has been
counted, and to no one's surprise, the vote was in favor of the
establishment of the district.
Section 35-5-104 (3) , CRS , says the following:
"If, after a tally of the votes has been made,
the Board finds that sixty six and two thirds
percent of the landowners and lessees voting
have voted in favor of the district, and the
landowners and lessees voting own or lease
fifty percent of the land in the proposed
district, the Board shall declare the district
established. "
The Board must therefore declare the district established. One
hundred percent of the landowners, representing one hundred
percent of the land in the proposed district, voted in favor of
the establishment of the district.

3 . Place this Ballot in the enclosed small envelope marked
"BALLOT, " and seal the envelope.

4. The description of the boundaries of the proposed Chalk
Bluffs Pest Control District are as follows:

P.M. , Weld County, Colorado:
All of Section 30 ; the West Half of Section
19 .
In Township 12 North, Range 65 West of the 6th
P.M. , Weld County, Colorado:
All of the lands in Section 13 , 14 , and 15 ,
which lie within Colorado; All of Section 21 ,
22 , 23 , 25 , 27 , and 35; All of Section 24 ,
except the Northeast Quarter of the Southeast
Quarter; The East Half of Section 26 .
In Township 11 North, Range 65 West of the 6th
P.M. , Weld County, Colorado:
The Northeast Quarter of the West Half of
Section 1 ; All of Section 2; The Northwest
Quarter, the Northwest Quarter of the
Southwest Quarter, the West Half of the
Northeast Quarter, and the Northeast Quarter
of the Northeast Quarter, all of Section 12 .
In Township 12 North, Range 64 West of the 6th
