RESOLUTION RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW HEARING - JAMES AND NORMA CHITTENDEN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of March, 1985 , at the hour of 2 :00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of James and Norma Chittenden, 25469 Weld County Road 50 , Kersey, Colorado 80644 , for a Use by Special Review for an agricultural recreational facility, and WHEREAS, at said hearing, the Board heard the testimony of those present and reviewed the submitted evidence, and WHEREAS, it was determined that the recommended conditions and Operation Standards which were presented at said hearing were not acceptable to the Board or the applicants , and WHEREAS , after study and review, the Board deemed it advisable that this hearing be continued to April 17 , 1985 , at 2 :00 P.M. to allow the Planning staff time in which to prepare a revised or an optional set of conditions and Operation Standards for further review by the Board and the applicants. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hearing concerning the Use by Special Review application of James and Norma Chittenden be, and hereby is, continued to April 17 , 1985 , at 2 : 00 P.M. , at which time the Board will consider a revised and/or optional set of conditions and Operation Standards. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated March 13, 1985, and duly published March 14, 1985, in the La Salle Leader, a public hearing was conducted to consider the request of James and Norma Chittenden for a Use by Special Review Permit for an Agricultural Recreational Facility. Lee D. Morrison, Assistant County Attorney, made this matter of record. James Mayerl, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. He said this recommendation is subject to five conditions and fifteen Operation Standards, which he also read into the record. (During this hearing, certain documents were submitted to the Board by: Ron Lambden; James Gustafson; Belva Spooner; and Robert Boren. These documents were marked as Exhibits by Mr. Morrison.) Ron Lambden, Attorney representing the applicants, came forward and made his presentation. He requested that several Operation Standards be amended. Wes Potter, representing the Health Department, explained the requirements which his department feels would be necessary to maintain this type of operation and also the criteria for the proposed noise barrier. (Tape Change #85-24) Those people appearing who were opposed to this request were: Robert Boren; Mildred Boren; Alfred Burton; Ken Spooner; Virginia Stradley; Ken Schott; Belva Spooner, Dawn Masters; Jeanne Miller; and James Gustafson, Attorney representing Robert Boren. Dan Rulla came forward to say that he is in favor of this operation. Following a short break, Don Carroll, of the Engineering Department, came forward to report on costs of gravel and maintenance for this road. Mr. Carroll said his estimate of these costs was based on using two inches of gravel to cover the distance of this road from WCR 50 to the residence. He said that in his opinion, gravel is the most appropriate material to use to upgrade this road. Mr. Carroll recommended that the road be upgraded every three to four years, with more frequent upgrading if there is heavy traffic. He then explained what is considered as heavy traffic. After Mr. Carroll's report those who came forward to express their approval for this operation were: Harry Thompson; Richard Blair; Mary O'Conner; Gloria Rulla; and Dennis Garcia. James Chittenden, the applicant, also came forward to offer comments. (Tape Change #85-25) Mr. Lambden made his final remarks on behalf of the applicants. Discussion followed concerning the proposed / Page 2 RE: USR - CHITTENDEN amendments to the conditions and the Operation Standards. Commissioner Kirby moved to continue this hearing to April 17, 1985, at 2:00 P.M. at which time the Board will consider a revised and/or optional set of conditions and Operation Standards. Commissioner Lacy seconded the motion which carried unaninimously. The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording . 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services office . 3 . Within thirty ( 30 ) days from the date of approval by the Board of County Commissioners the applicants shall improve the common access from Weld County Road 50 to the applicants residence . Improvements shall consist of laying a gravel base a minimum of two inches ( 2 " ) in thickness . 4 . Within thirty ( 30 ) days from the date of approval by the Board of County Commissioners the applicants shall submit evidence stating that they have received approval from the Weld County Board of Health for the sewage disposal system associated with the recreational facilities . 5 . Prior to scheduling the case before the Board of County Commissioners the applicant shall supply the Department of Planning Services with written information on how persons living in the proposed home will be engaged in the operation of the Use by Special Review activities . OPERATION STANDARDS James and Norma Chittenden USR- 663 : 85 ° 1 1 . The uses permitted shall be an Agricultural Recreational Facility as described in the application materials on file in the office of the Department of Planning Services and subject to the Operation Standards below . 2 . The maximum number of people allowed on the subject site at any one time shall be four hundred ( 400 ) 3 . A license shall be obtained from the Weld. county Health Department if food preparation , handling or storage is conducted on the subject site in conjunction with the Use by Special Review Activity . 4 . No alcohol shall be distributed on the subject site in conjunction with the Use by Special Review activities without approval ere the issuance of proper permits by the Board of County Commissioners . 5 . Hours of operation shall be limited to 8 : 00 a . m . to 10 : 00 p . m . Sundays through Thursdays and 8 : 00 a . m . to 12 : 00 midnight Fridays and Saturdays . 6 . An identification sign shall be placed at the entrance to the subject site . The sign shall be made of wood . It shall not exceed sixteen ( 16 ) square feet in area . The sign shall clearly identify the route to the subject Use by Special Review site 7 . The applicant shall maintain the gravel easement from Weld. County Road 50 to the applicants residence . The gravel base shall be a minimum of two inches ( 2 " ) in thickness . 8 . All activities after daylight hours ( including hay rides and buggy rides ) associated with the subject Use by Special Review request shall be confined to the subject site . 9 . The Use by Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility . 10 . All litter shall be contained on the Use by Special Review subject site . All litter associated with the Use by Special Review shall be picked up daily . 11 . The applicant shall comply with the design standards for the Use by Special Review , Section 24 . 5 et seq . ; of the Weld County Zoning Ordinance . Miller At the Agriculature Soil Conservation Office (A.S.C.) The soil type on Parcel #0963-32-0-00-046 Section 32. Consists of#38-Nelson fine sandy loam 3 to 9 percent slopes. This is moderately deep, well drained soil on plains at elevations fo 4,800 to 5,050 feet. It formed in residuum derived from soft sandstone. Included in mapping are small areas ofsoils that have sandstone at a depth of more than 40 inches. Typically the surface layer is light brownish gray fine sandy loam about 8 inches thick. The underlying material is light olive brown fine sandy loam. Soft sandstone is at a depth of about 28 inches. Permeability is moderately rapid. Available water' 40 inches. Surface runoff is medium to rapid, and the ero- sion hazard is moderate. This soil is suited to limited cropping. Intensive cropping is hazardous because of erosion. The cropping- system should be limited to such close grown crops as al- falfa, wheat, and barley. This soil is also suited to ir- rigated pasture. A suitable cropping system is 3 to 4 years of alfalfa followed by 2 years of corn and small grain and alfalfa seeded with a nurse crop. Close grown crops can be irrigated from closely spaced contour ditches or sprinklers. Contour furrows-or sprin- klers should be used for new crops. Applications of nitrogen and phosphorus help in maintaining good production. The potential native vegation on this range site is cominated by sand bluestem, sand reedgrass, and blue grama. Needleandthread, switchgrass, sideoats grams, and western wheatgrass are also prominent. Porential production ranges from 2,200 pounds per acre in favora- ble years to 1,800 pounds in unfavorable years. As range condition deteroirates, the sand bluestem, sand reedgrass and switchgrass decrease and blue grams, sand dropseed, and sand sage increses, Annual weeds and grasses invade the site as range condition becomes poorer. Iianagement of vegation on this soil should be based on taking half and leaving half on the total annual produc- tion. Seeding is desirable if the range is in poor condition. The underlying sandstone is the most limiting feature of this soil. Neither septic tank absorption fields nor sewage lagoons operate properly. Site preparation for dwellings is more costly. Environmental and beautifica- tion plantings of trees and shrubs may be difficult to establish, This soil, however, does have good potential for such recreational developement as camp and picnic areas and playgrounds. Capability subclass IVe irrigated, VIe nonirrigated; Sandy Plains range site. The soil type on Parcel #0963-32-0-00-046 Section 32. Consists of#73-Vona loamy sand, 3 to 5 percent slopes. This is a deep, somewhat excessively drained soil on plains and high terraces at elevations of 4,600 to 5,200 feet. It formed in eolian or alluvial deposits. Included in mapping are some leveled areas. Also included are small areas of soils that have a loamy substratum and some areas of soils that are noncalcareous to a depth of 60 inches. Typically the surface layer of this Vona soil is grayish brown. The upper 6 inches is loamy sand and the lower 5 inches is fine sandy loam. The subsoil is brown and light the substratum to a depth of 60 inches is sandy loam. Permeability is moderately rapid. Available water capacity is moderate. The effective rooting depth is 60 inches or more, Surface runoff is slow, and the erosion hazard is low. The soil is suted to limited cropping. Intensive cropping is hazardous because of soil blowing. The cropping system should be limited to such close grown crops as alfalfa, wheat, and barley. The soil is also suited to irrigated pasture. Box 86 Greeley, CO 80632 Dear Milt: I have reviewed the Weld Co. referral for an application from James and Norma Chittenden for a Use by Special Review Permit for Agricultural Recreation Facilities to be located in part of the SE% of Section 37, T5N, R64W of the 6th P.M., Weld County, Colorado; 2.5 miles southwest of Kersy, north of WCR 50 and east of WCR 51. The request is for approval of an application to have a business related to horse rides, hayrides and barn parties. Not mentioned in the application state- ments but shown on the vacinity map is a proposed building site. The request area is made up of two soil types. One is map unit 38-Nelson fine sandy loam, 3-9% slopes and map unit 73-Vona loamy sand, 3-5% slopes. Both soils are compatible for planned recreational use except for the Vona soil having a moderate rating for camp areas, play grounds, path and trails due to being sandy and dusty. For septic tank absorption fields, the Nelson soil has a severe rat- ing because of depth to rock, in this case sandstone. Soft sandstone may be found at 28 inches below surface. I recommend that an on site percolation test be made at potential septic tank leach field locations to determine if it will function properly. Moderate to severe rating is given to dwellings without base- ments and dwellings with basements respectively due to sandstone influence. Usually, the sandstone is soft enough it can be dug with adequate machinery but may increase the cost of construction. No mention was made as to the type of dwelling being considered. An identification sign shall be placed at the entrance to the subject site. The sign shall be made of wood. It shall not exceed sixteen (16) square feet in area. It is a First Class type operation run by people of high moral values. The large land area permits riders to enjoy horses in a safe area rather than along the county roads as we so frequently find people doing in other areas. Having the ability to rent a horse to ride permits many young people to enjoy a horse without having to buy a horse and keep it in an area of greater population density. Horses in high population areas are sometimes objectionable because of fly problems at nearby homes. Many church groups and other organized and/or unorganized groups of people have hay rides, barbecues, and parties away from the cities of the county. The laughter and joy of such groups surely would not be greater than that of a ball game at a City Park. I toured these facilities and found a very pleasant country atmosphere that was clean and in good repair. The evening I was there a church youth group was having a social gathering. The teenagers were well chaperoned and while lively were not "rowdy". Hopefully the issues between the planning commission, owners and the neighbors of the Horse Around Stables can come together so we may still be allowed the priviledge of the use of these fine facilities. As the director of Pencil Fence Preschool, I feel that Forse Around Stables should be allowed to operate in Greeley with the approval of the county, as it is a definite asset to the community. We have taken our children to the stables on many, many occasions. During the summer of 1984, our children went to Horse Around Stables once a week. They have always had a good time, with whole- some activities provided by the proprietors at a very reasonable cost. Our children have been taken on a hay ride several times, and this ride was operated in a safe manner, with a properly equipped haywagon, and safe gentle horses. We feel that this type of facility is beneficial and necessary in a community such as Greeley, which, because of its size has limited Places of amusement which are wholesome and safe enough for children such as ours. PETITION AGAINST AGRICULTURAL RECREATIONAL FACILITY We, the people who reside in the close proximity to James and Norma Chittendens' proposed agricultural recreational facility, object to their use by special review as set forth in the operation standards of the Weld County Planning Commission USR-663:85:1, or from them operating their agricultural recreational facility at all on their property located in the Southeast Quarter (SE 1/4) of Section Thirty-Two (32), Township Five (5) North, Range Sixty-Four (64) West of the 6th P.M., Weld County, Colorado, approximately 2.5 miles southwest of Kersey, Colorado and north of Weld County Road 50 and east of Weld County Road 51 for the following reasons: 1. The easement that was created to allow James and Norma Chittenden, and their predecessors in interest, to get to their property will be unreasonably expanded and interfere with the peaceful and quiet enjoyment of our own property. 2. The expanded use of this easement will greatly deteri- orate the road and will cause blowing dust problems for all surrounding neighbors. 3. The manner in which the easement has been used and will be used in the future by the above proposed agricultural recreational facility will pose a danger to all neighbors and their relatives because of the many vehicles that will use this easement and because some vehicles travel at unsafe speeds. 4. Some functions held at the agricultural recreational facility involve the consumption of alcoholic beverages and we are opposed to the use of such alcoholic beverages by so many people on property that is so close to our properties. 5. The above agricultural recreational facility often has loud music playing at later hours in the evening which disturbs our peaceful and quiet enjoyment of o4r properties. 6. The hay wagons that are used along the easement to the Chittendens' property and along the Weld County road in the close proximity to the Chittendens' property, causes us concern because the hay wagons have been poorly lighted or the lighting has been covered up by passengers on said wagons and this has caused many of us to almost run into the hay wagons. 7. The increased use of the easement to the business property causes litter problems all along said easement and along our properties. 8. Many of the horse riders are novice riders and create a safety problem for the riders and those in the neighborhood. • 9. The horse riders have in the past shown a lack of respect for the private property of others. 10. The proprietors of the above business have heard these concerns and have chosen not to address these concerns as legitimate. We feel that future concerns will be received in a similar manner. 11. Many of the undersigned petitioners moved to this area because it is a peaceful and quiet area and the proposed agricultural recreational facility of James and Norma Chittenden will have an adverse impact on our peaceful and quiet enjoyment of our properties so that if such facility is approved many of us may be forced to move from the area. 11. We are also concerned that the Chittendens` proposed use of their property will adversely affect our property values. Last summer 1984, Norma gave me a chance to work with their horses. Horse Around Stables is the only establishment which gives people the opportunity to come out to the country and ride horses, go on hay rides, and furnish a heated barn for others to enjoy. After any party they have always seen that any mess was cleaned up immediately. I've never seen any trash on the lane up to the Chittendens house or around the barn area or stalls. Horse Around. Stables isn't just another place where eneole come out to ride. When they leave they always have a smile on_ their face. I hope you'll take into considera- tion all the love and care the Chittendens have put into the Horse Around Stables. This is a place where people of all ages can go to have a good time. For me its become a home away from home and Im sure there are others who feel the same as I do. I feel that it is a shame that anyone would want to see the Horse Around Stables closed. It is one of the very few places around that a family can go to have fun altogether. I have always found the atmosphere to be friendly, clean, neat, and above all safe. Being a horse lover, I have rented horses to ride out there several times. Even though I go there often and know of the rules, they are considerate enough of their neighbors to each and every time stress the importance of staying off others property. I, and I know of others who go there, under— stand that this is Jim and Norma's home and neighbors. With that respect we are careful not to disrupt that. Jim and Norma Chittenden not only run a family stable, but they also con— tribute a great deal to the community. Such as fund raising, Cub Scotts, ect. I don't know of too many people who would open up their home for the purpose of helping others. But to Jim and Norma it is only giving back to the community they very much care about. I hope you realize that it would be a great injustice to close such a nice and respectable place as the Horse Around Stables. And it would be a great dissappointment to see one of the last places, a family can go to have fun together, close.'
