RE: PRELIMINARY HEARING FOR CREATION OF A LOCAL IMPROVEMENT DISTRICT - ANTELOPE
HILLS SUBDIVISION, FIRST & SECOND FILINGS
A public hearing was conducted on April 9, 1986, at 7:00 P.M. , with the following
present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 24, 1986, and duly published
March 27, 1986, in the Johnstown Breeze, with individual letters being mailed to
owners of record, a public hearing was conducted to consider declaring the
intention of the Board of County Commissioners of Weld County, Colorado, to create
a Local Improvement District within the County to be designated as Weld County
Antelope Hills Local Improvement District 01986-1; adopting details and
specifications therefore; ordering publication and mailing of notice of hearing to
the owners of the property in said District; and providing for notice to
contractors. Lee Morrison, Assistant County Attorney, made this matter of record.
Mr. Morrison explained the law regarding the creation of an Improvement District.
Drew Scheltinga, Director of Engineering, gave a slide presentation showing
Antelope Hills District and where the ditches and culverts are proposed to be
placed. He also presented the preliminary estimates, saying the estimated total
construction cost is $64,493.00, with the County contribution being $15,000.00, and
the escrow being $15,000.00, making the estimated cost to the landowners
$34,493.00, with the estimated cost per lot $1,326.65. (TAPE CHANGE #86-26)
Following Mr. Scheltinga's presentation, those members of the audience coming
forward for clarification of several items were: Jeff Manuel, Henry Foos, Jerry
Brodzinski, Paul Felte, Dick Hergert, and Geraldine Brodzinski. Don Warden,
Director of Finance and Administration, explained the payment plan to the
homeowners who were present. There were concerns regarding the costs and questions
as to how these costs can be reduced. Mr. Morrison responded to the questions and
explained that a detailed notice will be published and mailed to the homeowners
setting forth the costs and, before the work is authorized, a second hearing will
be held concerning the improvements. He said if there are to be major changes, an
amended petition must be circulated and this hearing would have to be continued.
(TAPE CHANGE #86-27) Following discussion, Chairman Johnson reviewed the steps to
be taken by the Board to create the district. Chairman Johnson called for a short
recess to allow the members of the audience to complete a questionnaire asking the
desires of the residents of the area concerning the proposed district. (Let the
record reflect that there was a short recess at this time.) Upon reconvening, Mr.
Morrison tallied the questionnaires which indicated that the homeowners are
interested in the proposed district, with most suggesting that they would like to
see the costs reduced. Mr. Morrison said provisions of the petition provide for
exclusion of paving private driveways. Chairman Johnson said the comments
regarding narrowing the width of the roads seem sufficient to warrant continuing
this hearing in order to amend the petition. Mr. Morrison asked Mr. Hergert if he
is willing to circulate an amended petition. Mr. Hergert requested that the Board
allow him to meet with the homeowners present at this hearing. Mr. Scheltinga

suggested that they consider eliminating the paving of the cul-de-sac, stating that
this would be a savings of $2,000.00. (Let the record reflect that a short recess
was called at this time.) When the Board reconvened, Mr. Hergert informed the
Board that the desire of the homeowners present is to proceed with the petition as
it was submitted, with the paving of the cul-de-sac being eliminated. Mr. Hergert
stated other ways in which they might have further savings. Mr. Morrison said the
Board can proceed on the assumption that the cul-de-sac will not be paved, but if
there are persons interested in having the cul-de-sac paved, then the Board may
choose to include it in the final plans. Mr. Hergert said they would inform the
owners on this portion of the change and will advise the Board as to any objections
or comments they might have. Mr. Scheltinga then read the adjusted figures into
the record. He said the reduction will amount to a savings of approximately
$2,000.00. Mr. Morrison recommended that the motion be as follows: To approve the
Resolution in form, with the preliminary estimates presented by the Engineering
Department, as adjusted by deleting the $2,016 of bituminous pavement, and noting
that the internal roads exclude the cul-de--sac. Commissioner Kirby moved to
approve the motion as outlined by Mr. Morrison. The motion was seconded by
Commissioner Brantner and carried unanimously. The Board determined that the next
hearing will be held on May 28, 1986, at 2:00 P.M. as stated in the Resolution.
There was no objection from any member of the audience.
This Certification was approved on the 16th day of April, 1986.
