RE: ASSESSMENT OF COSTS FOR
GRANDE/ENCHANTED HILLS LOCAL IMPROVEMENT DISTRICT NO. 1989-2

WHEREAS, the Board of County Commissioners of Weld County,Home
Colorado, pursuant to Colorado statute and the Weld County 2z
Rule Charter, is vested with the authority of administering the No No

WHEREAS, in accordance with C.R.S. , Section 30-20-607 , as X n
amended, a statement of expenses and apportionment has been filed o

WHEREAS, there have been complaints and objections to the H N
assessment, specifically that of John and Myrna Folsom, regarding z
Lots 5, 6 , and 7 , of Block 2 , Casa Grande Estates Subdivision;

and Rose Hanke, owners of Lot A of Recorded Exemption 498; t
Rosa Davis, regarding property located in the SW} of Section 18 , r..,
Township 2 North, Range 67 West of the 6th P.M. ; Bernard E. Teets,
regarding property located in Section 20 , Township 2 North, Range
67 West of the 6th P.M. ; and Joseph and Sandra Lewis, regarding th
property located in the SW} of Section 18 , Township 2 North, Range 2
67 West of the 6th P.M. ; and the Board has determined not to make
any modifications in the first apportionment and further t4.4
determined that the first apportionment is equitable, just, proper
and correct, and therefore the Statement of Apportionment filed oo
herein and attached hereto and incorporated by this reference as

Recorder; parcel #131118000043 of the records of the Weld County
Assessor, recorded at Book 1001 , Reception #01932266 of the

benefitted from the proposed improvements for the following
reasons:
a. The market value of the property will increase;

WHEREAS, the Resolution shall be prima facie evidence of the x

and Recorder are assessed at the sum of $150,473.06
to be divided among all lots and parcels for an

included within the district are the right-of-ways
for Weld County Road 20 , from Weld County Road 13
east 1 .59 miles, and Weld County Road 15, between

b. That a local improvement district for the g n
construction and installation of street
improvements was created by Resolution of this co
Board on July 12, 1989. Said local improvement z

district has been designated as "Weld County Casa z
Grande/Enchanted Hills Local Improvement District Pi rn
No. 1989-2" and all proceedings heretofore taken by C
the Board of County Commissioners and the County
staff and adopted in connection with the District H
are hereby ratified, approved, and confirmed. t�

c. That the Statement of Expenses and Apportionment co
has been submitted based upon the fact that there t vo
has been completion of the entire local improvement �y
as previously authorized.

d. The total cost of the improvements included within 7o -4
the District has been determined to be $150,473 .06,
not including the cost borne by the County for o
improvements to the gravel road, engineering, and
administrative fees, as well as the cost of paving o
on Weld County Road 22 , which was not included
within the District. The Statement of Expenses and EO
Apportionment advises , and this Board ratifies the o
finding that each of the lots or parcels described
belonging within the Local Improvement District has 0 L
been specifically benefitted and each lot or parcel
shall be assessed equally on a per lot or parcel 0 o
basis the cost for materials and labor in the O O1
amount of $977. 10 .
e. The assessment being levied for the improvements
shall be due and payable within thirty (30) days
after the effective date of this assessing
Resolution. However, all such assessments may be
paid at the election of the owner in ten (10)
equal, annual installments of principal, with
installments of interest on unpaid installments, at
an interest rate of ten percent (10%) simple
interest per annum. The first of said installments

of assessment shall be due and payable prior to May
1 , 1990, and the remainder of the annual
installments or assessments in annual payments of
interest shall be due and payable successively on
the same day each year thereafter until all are

assessment roll, in cooperation with the Weld w
County Treasurer and Accounting Department, in a xl
form showing in suitable columns, each parcel of m
land assessed, the total amount of assessment, the k
amount of each installment of principal and > t.)
interest if, in pursuance of Part 6 of Article 20 z
of Title 30 , Colorado Revised Statutes, the same is 0°
payable in installments, and the date when each t4

installment will become due, with suitable columns
for use in case of payment of the whole amount or
of any installment or penalty, and shall deliver
the same, duly certified, under the County seal, to H
the County Treasurer for collection. Z1a

g. Failure to pay the whole assessment prior to ry �°
January 1, 1990 , shall be a conclusive
determination and held to be an election on the z rn
part of all persons interested, whether under
disability or otherwise, to pay in such M
installments. All persons so electing to pay in n
installments shall be conclusively held and
considered as consenting to said improvements. 6
Said election shall be conclusively held and x
considered as a waiver of any right to question the E o
power or jurisdiction of the County to construct o
the improvements, the quality of the work, the d
regularity or sufficiency of the proceedings, the
validity or correctness of the assessments, or the o a
validity of the lien thereof.

h. That all Resolutions or parts thereof in conflict
with this Resolution are hereby repealed.
i. Failure to pay any installment, whether principal
or interest, when due shall cause the whole of the
unpaid principal to become due and collectible
immediately, and the whole amount of the unpaid
principal and accrued interest shall thereafter
draw penalty interests at the rate of one percent
per month from the first day of May until the day
of payment, or until the day of sale. In computing

the amount of penalty interest due under this
section, portions of months shall be counted as
whole months.

1989-2. Pursuant to the attached Resolution, each lot or parcel in the
District has been assessed $977. 10. You may pay this amount to the Weld
County Treasurer prior to January 1, 1990. When making your payment, please
advise the Treasurer's Office that the payment is for the assessment
concerning the Casa Grande/Enchanted Hills Local Improvement District.
Should you choose not to pay in full by January 1, 1990, you will pay in ten
(10) equal annual installments at a simple interest rate of ten percent
(107) per annum, with the first payment being due on or before April 30,
1990. This amount will be separately billed to you after January 1 , 1990.

CASA GRANDE/ENCHANTED HILLS LOCAL IMPROVEMENT DISTRICT NO. 1989-2
STATEMENT OF COST; AND PORTION TO BE ASSESSED UPON EACH LOT

All owners of real estate and property hereinafter described and all persons
generally, are hereby notified that the Board of County Commissioners of
Weld County, Colorado, has received a Notice of Completion, Statement of
Expenses, and Apportionment regarding the Local Improvement District within
unincorporated Weld County, Colorado, designated as Weld County Casa
Grande/Enchanted Hills Local Improvement District No. 1989-2, all in
accordance with the laws of the State of Colorado. The property within the
Local Improvement District is described as follows:
All lots and tracts within Casa Grande estates; all lots in Casa Grande
Estates, First Addition, and including that parcel adjacent to Del
Camino Lane known as Lot A of Recorded Exemption 498; and all lots and
parcels subdivided from lots in Enchanted Hills Subdivision, as well as
each individual parcel of land adjoining Weld County Road 20, from Weld
County Road 13 heading east a distance of 1.59 miles; and Weld County
Road 15, between Weld County Road 20 and Weld County Road 24, and
including those properties shown by the Weld County Assessor as parcel
#131118000054, and as recorded at Book 1181, Reception #02126159 of the
Records of the Weld County Clerk and Recorder; and parcel #131118000043
of the records of the Weld County Assessor, recorded at Book 1001,
Reception #01932266 of the Records of the Weld County Clerk and
Recorder. Also included within the district are the right-of-ways for
Weld County Road 20, from Weld County Road 13 east 1.59 miles, and Weld
County Road 15, between Weld County Roads 20 and 24.
1. All persons are further notified that the whole cost of the
improvements as has been completed is to be $150,473.06, which includes
any costs which have been assumed by the County in terms of
improvements to the gravel roads, engineering, and administrative fees.
The costs to be apportioned to the landowners are the costs of the
labor and materials for installation of the hot bituminous pavement and
base preparation and installation of traffic control devices, which is
to be apportioned equally among the 154 lots and tracts in an
apportionment of $977.10 per lot or tract.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners, 915
Tenth Street, P.O. Box 758, Greeley, Colorado 80632, which objection
must be filed within twenty (20) days from the publication date of this
notice. Any complaint or objection properly made will be heard and
determined by the Board of County Commissioners before the passage of
any Resolution assessing the costs of the improvements.
3. The hearing where such complaints or objections will be heard will be
on the 20th day of November, 1989, at or about 9:00 a.m. , in the First
Floor Meeting Room of the Centennial Center, 915 Tenth Street, Greeley,
Colorado.

The construction for the Casa Grande/Enchanted Hills Local Improvement
District has been completed. The cost for paving on Weld County Roads 20
and 15 was $150,473.06. That does not include the cost of paving on Road
22 which was not included in the district.
There are 154 parcels in the improvement district that should equally
share the paving cost of $150,473.06. The assessment for each parcel
should be $977.10.
Please make the appropriate advertisement for the local improvement

Dear Commissioners :
This letter is in objection to the Casa
Grande/ Enchanted Hills Local Improvement District
No. 1989-2 . We were told that this special District
would be formed only if a majority of the owners
affected voted in favor of it . There has never
been a vote. We believe that there should be
enough tax dollars already generated in this area ,
through high property taxes , high gasoline taxes ,
sales taxes , etc. to more than pay for some road
improvements when the need for them become evident
and necessary. How many times and ways do we
have to pay?
Also , we have received notices about this
in our name and in I .C . & Pauline Arwood ' s . We
own Lot 1 in Enchanted Hills . It is one lot not
two. We hope we are not being set up for another
double taxation.

Subject: Complaint and Objection to Assessment, Weld Co, Casa Grande/ Enchanted
Hills Improvement District No. 1989-2 (Hearing 20th day of November, 1989)
Gentlemen:
With reference to the above local improvement district, we own three contiguous
lots within the district on which is our residence, namely, lots 5, 6 and 7,
block 2 Casa Grande Estates Subdivision. It is our understanding that they will
be assessed $977. 10 for each lot totaling an assessment to us of $2931.30. The
assessment to the other property owners will be $977. 10
1. Complaint. As a matter of fairness we question whether it is just and
equitable to tax us 50 disproportionately. (a) We will receive no greater
benefit than other property owners from the road paving. (b) The value and area
of our three lots taken together is about the same as that of the average of
the individual lots in the district. (c) None of our lots has direct access
onto the roads that were paved. (d) Just the two of us live on these lots, so
that we will derive no more benefit of use than if we lived on one lot and less
benefit as compared to the average number of family members on other lots using
the district roads.
Please consider that there are other methods of allocating assessments that
have been used in this situation which, arguably, would have better reflected
benefits (use of and access to improvement, land value, front footage,
proximaty to improvement, analysis of relative benefit, etc. ) . The selection of
assesssment by lot and parcel is understandable in its simplicity of
application however inequitable it is to us in this case.
We would appreciate your considering our situation and giving us some relief so
the burden of assessment to us might be adjusted to be more in line with that
borne by the other property owners in the district.
2. Objection. If the consideration of fairness is not persuasive we hope the
Board might indulge us by considering that there are some points of law that
bear on the manner in which the assessment has been determined and applied.
(a) "The probable cost per front foot or other unit basis which, in the
iudgment of the board, reflects the benefits which accrue to the properties to
be assessed, as shown by the estimates of the engineer; " CRS3O-20-6036(f) . This
paragraph would indicate that there should be a proportionality in the
relationship between benefit and assessment. The unit basis by lot and parcel
does not allow for any consideration of this relationship.
(b) "Cost assessed in accordance with benefits. (1) The cost of improvements
constructed or acquired pursuant to this Part 6, or such part therof as may be
assessed on property without regard to lot or land lines on a frontage, zone or
other equitable basis in accordance with the benefits as same may be determined
by the board" CRS 30-20-604(1) . This section of the statute also indicates a

mandate for the assessment to be related to the benefits and the word equitable
used would indicate determination on an individual basis.
(c) As to what is a benefit to a particular assessed property the statute
continues,
"Determination of special benefits - factors considered . . . . Any increase in
the market value of the property; " CRS 30-20-606(1) (a) . The only sale of
property since the paving of the roads in the district was for a price less
than that listed before the paving. The price of properties listed for sale at
Northmoor Acres, included in a similar district of last year, were unaffected
after the paving.
"Any adaptabability of property to a superior or more profitable use; " CRS 30-
20-606(1) (c) . No benefit to property from this item because of zoning
restrictions and county policy.
"Any increase in convenience or reduction in inconvenience accruing to
particular property owners, including to facilitation of access to and travel
over streets, roads, and highways; " CRS :30-20-606(1) (f) . The difference between
travel on well maintained and graded roads and paved ones as pertaining to
convenience, inconvenience and access is negligible.
(These are the only parts of this section that are relevant to this type of
district) (All underlining above is mine) .
None of these benefits as defined by statute as being being necessary as a
basis for determining assesssemnt applies to our lots more than any other lots
and, indeed, they do not appear to apply in any significant manner relative to
the cost of the improvement to the other lots in the district.
Please note in addition the following statute and precedent references that
bear on this matter;
1. Assessment must be linked to relative benefit; ". . .assess the cost thereof
upon property especially benefited by such improvements. " CRS 30-20-601 in
part.Also see Town of Fort Lupton v UPRRCo. 156Colo352, Pomroy v Board of
Public Waterworks, City of Pueblo 55Colo476, Garcia v Falkenholm 198A2d660.
2. Benefit must equal or surpass the amount of the assessment. See Satter v
City of Littleton 185Colo9o, Reams v City of Grand Junction 676P2d1189.
3. Proportionality of assessment to benefit by lot or parcel . See 1st Div St.
Paul etc. v St. Paul 21Minn526, Slate v Board of Commisioners of Cascade Co.

4. Need for improvement was caused by persons outside the district. See
Johnson v City of Inkster 258NW2d401.
5. Re: no benefit, disbenefi•t, special benefit, use, due process. See Denver

be paved.
5. I am currently working in Fort Lupton so that to a great
extent I will not be using the roads to be paved.
6. Just the two of us live on these three lots so that we will
derive no more benefit of use than if we lived on one lot
and less benefit of use compared to the average number of
family members occupying the other lots in the district driving
on the roads to be' paved.
Even though the date for objections has passed we would

On August 21st I wrote a letter to you regarding the financial

To briefly recapitulate the contents of that letter, we own
three contiguous lots on which we live. As a result we will
be assessed approximately $3816.00 while the rest of the
land owners will be assessed $1272.00 despite the fact that
the combined value and size of our lots is about average of
the individual lots and parcels in the district.
I grant you that assessment by lot and parcel is the simplest
basis to administer by the county but please consider if it
is equitable. Is our benefit from the paving three times as
much as that to the other lot owners?
