RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR GREYHOUND DOG KENNEL (200 DOG MAXIMUM) - GENE AND DIANNE GURLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of December, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Gene and Dianne Gurley, 7256 Maple Street, Longmont, Colorado 80501 , for a Use by Special Review for a greyhound dog kennel (200 dog maximum) on the following described real estate, to-wit: Part of the S NEz, Section 15 , Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the location of the proposed use minimizes the impact on the surrounding farmland. b. The Agricultural District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses. The proposal is intended to provide for a greyhound kennel with the remainder of the property to stay in alfalfa production. d. No overlay districts affect the site. e. The Use by Special Review Development Standards will provide adequate protection of the health , safety and welfare of the neighborhood and County. NOW, THEREFORE , BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a greyhound dog kennel (200 dog maximum) on the hereinabove described parcel of land be , and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Within thirty days of final approval by the Board of County Commissioners , the applicant shall submit a soil erosion plan to the Longmont Soil Conservation District for review and approval. A copy of the approved plans shall be submitted to the Department of Planning Services staff. The Use by Special Review permit is for a greyhound dog kennel as submitted in the application materials on file in the Department. of Planning Services and subject to the Development Standards stated hereon. The maximum number of greyhound dogs allowed is two hundred (200) . 2 . The applicant or operator shall develop and maintain a soil erosion plan for the property per recommendation from the Longmont Soil Conservation District. 3 . A one hundred foot (100 ' ) grass buffer strip shall be developed and maintained between the kennel area and the Coal Ridge Ditch per recommendation from the Longmont Soil Conservation District. 4 . The greyhound kennel facility shall comply with the Colorado Racing Commission ' s Rules and Regulations pertaining to greyhound kennels. 5 . If any plumbing facilities are planned or required for the kennel , a separate septic system shall be installed for the kennel facility in accordance with the requirements and regulations of the Weld County Health Department. 6 . Buildings and grounds shall be kept clean, in good repair and free of trash. Animal waste shall be removed daily from the kennel area and stored in an enclosed container. The waste shall be removed on a weekly basis. 7 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 9 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. Page 2 DEVELOPMENT STANDARDS - GURLEY 10 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 11 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld' County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted . Any other changes shall be filed in the office of the Department of Planning Services. 12 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated November 27, 1985, and duly published December 5, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of Gene and Dianne Gurley for a Use by Special Review for a greyhound dog kennel (200 dog maximum) . Lee Morrison, Assistant County Attorney, made this matter of record. Debbie de Besche, Planning Department representative, read the favorable recommendation of the Planning Commission into the record, stating that twelve Development Standards are recommended for this proposed operation. John Baney, Attorney, and Gene Gurley, applicant, came forward to answer questions of the Board. Cherry Sauers spoke in favor of the request, stating that the applicants' present, smaller, operation is a good operation. Commissioner Lacy moved to approve the request of Gene and Dianne Gurley for a Use by Special Review, based upon the recommendation of the Planning Commission and subject to the recommended conditions and Development Standards. Commissioner Kirby seconded the motion and noted, for the record, that several letters had been received concerning this request. The motion carried unanimously. The Department of Planning Services has received one phone call in opposition to this request. Summary of th.e Weld County Planning Commission Meeting November 19, 1985 Page 4 The Chairman asked that reading of the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff be dispensed with and that they be filed with the summary as a permanent record of these proceedings. MOTION: Doug Graff moved Case Number USR-709:85:54 for Darrel and Tamara Lockman for a Use by Special Review permit to process and sell forestry products in the Agricultural Zone district be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendation, conditions, and Development Standards as outlined and amended by the Department of Planning Services staff to include a new #2 with all following standards to be renumbered consecutively. Motion carried unanimously. jVVV CASE NUMBER: USR-710:85:55 APPLICANT: Gene and Dianne Gurley REQUEST: A Use by Special Review permit for a greyhound dog kennel (200 dog maximum) LEGAL DESCRIPTION: The Si NEi , Section 15, T2N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3 miles northeast of Firestone; south of Weld County Road 22 and east of Weld County Road 19 APPEARANCE: Jim Doherty, Attorney, stated he represents the applicant. Gene Gurley, applicant, reported they have an existing permit for a Use by Special Review which allows for fifty dogs on another property. Their business has grown considerably, therefore, they want to expand on this property. They would raise dog on this property. The only dogs on the property would be under one year old, injured dogs, and old dogs that do not race any more. There would be no training at this site. He explained the physical lay-out planned for the kennel operation. Hired help will live in a mobile hone on this property. The land around the kennel area is in b x/tte 7 e Summary of the Weld County Planning Commission Meeting November 19, 1985 Page 5 alfalfa and they do not intend to disturb this. The land is very sandy, but this is an asset because they prefer loose, soft soil so the pads on the dogs feet are not injured. There is very little traffic associated with their kennel operation. The Chairman asked Mr. Gurley if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. He stated he had and has no objections to them. The Chairman called for discussion from the members of the audience. Earl Anderson who also raises and trains greyhounds stated he knows the Gurleys' personally and he has great respect for them and the operation they run. Mike Pierro, surrounding property owner, reported he lives less than 500 feet from the. Gurleys' current kennel operation. He did not even know they raised dogs the first two years he lived there. The dogs are quiet and they run a clean and neat operation. Sherry Sauers, surrounding property owner, reported the dogs are very quiet and their property is very neat and clean. John Watson, Farm Manager, Parker Trust, Greeley National Bank Trust Department, stated they are opposed to this request because the ingress and egress is very limited and the property is very sandy. Also, the property is lower than other properties in the area and drainage could be a problem. Stacy Collins reported she also raises dogs and she sees no problem with the sandy soil at all. She has forty dogs on similar soil and has no problems with erosion. A one hundred foot (100') grass buffer strip shall be developed and maintained between the kennel area and the Coal Ridge Ditch per recommendation from the Longmont Soil Conservation District. 4. The greyhound kennel facility shall comply with the Colorado Racing Commission's Rules and Regulations pertaining to greyhound kennels. 5. If any plumbing facilities are planned or required for the kennel, a separate septic system shall be installed for the kennel facility in accordance with the requirements and regulations of the Weld County Health Department. 6. Buildings and grounds shall be kept clean, in good repair and free of trash. Animal waste shall be removed daily from the kennel area and stored in an enclosed container. The waste shall be removed on a weekly basis. 7. All Construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 9. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 10. The employee will be working about 4 hours a day, 7 days a week . Our source of water will come from Weld County Central Water Dist. . Lupton Fire Chief and I am in their fire district. I also will have adequate fire extinguishers in my kennel building. I am requisting a 200 dog permit. I will need somewhere between 50 to 200 dogs to supply my 2 race kennels . I will have a dumpster that will be picked up weekly by Tri-Area Rubbish.
