RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (FERTILIZER
STORAGE, MIXING, BLENDING, AND SALES FACILITY) IN THE A
(AGRICULTURAL) ZONE DISTRICT - PARK FLORAL COMPANY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 1st day of February, 1989 , at the hour of 10 : 00
a.m. , in the Chambers of the Board for the purpose of hearing the
application of Park Floral Company, 11610 Weld County Road 14} ,
Fort Lupton, Colorado 80621 , for a Site Specific Development Plan
and Special Review Permit for an agricultural service
establishment (fertilizer storage , mixing, blending, and sales
facility) in the A (Agricultural) Zone District on the following
described real estate , to-wit:
Part of the SE} , Section 36 , Township 2 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, said applicant was represented by Kirk Douglas,
Attorney, and
WHEREAS , Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.

2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is located within the Urban Growth
Boundary Area of the Town of Fort Lupton and is
consistent with the Weld County Comprehensive
Plan' s Urban Growth Boundary Goals and Policies.
Representatives of the Town of Fort Lupton, in its
referral response dated December 22 , 1988,
indicated the proposal was outside its Master Plan
Area, and there were no objections to this
proposal.
b. The proposal is consistent with the intent of the
Agricultural Zone District. The proposed use is an
agricultural service establishment and is provided
for as a Use by Special Review in the Agricultural
Zone District.
c. The uses permitted will be compatible with the
existing surrounding land uses which include
greenhouses , agricultural production, and rural
residences . The use will be compatible with the
future development of the surrounding area as
permitted by the Agricultural Zone District. No
objections have been received from surrounding
property owners.
d. The proposed use is located in the Flood Hazard
Overlay District. Condition of approval #3
addresses this issue. No other overlay districts
affect the site .
e. The applicant has demonstrated an effort has been
made to conserve productive agricultural land in
the locational decision for the proposed use.
f. Special Review Development Standards will provide
adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for an
agricultural service establishment (fertilizer storage, mixing,
blending, and sales facility) on the hereinabove described parcel
of land be, and hereby is, granted subject to the following
conditions:

1 . The attached Development Standards for the Special
Review Permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall
be delivered to the Department of Planning Services and
be ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3 . A Flood Hazard Development Permit shall be applied for
by the applicant or property owner and approved by the
Department of Planning Services ' staff prior to
construction of any structures or the substantial
improvements of any structure in the flood plain.
4 . Prior to recording the Special Review plat:
a. The applicant shall submit a windbreak barrier plan
to the Department of Planning Services ' staff for
consideration and approval. The approved barrier
shall be shown on the Special Review Permit plat;
and
b. The applicant shall amend the Special Review plat
to show heavy traffic areas to be gravelled, stock
pile areas, and areas to be seeded to control
erosion.
5 . Within 30 days after final approval by the Board of
County Commissioners the applicant shall submit evidence
to the Department of Planning Services ' staff that the
sign on the property is in compliance with Section 42. 2
of the Weld County Zoning Ordinance.

DEVELOPMENT STANDARDS
PARK FLORAL COMPANY

1 . The Site Specific Development Plan and Special Review Permit
is for an agricultural service establishment (fertilizer
storage, mixing, blending, and sales facility) in the
Agricultural Zone District as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . The windbreak barrier shall be maintained on the property.
4 . All heavy traffic areas on the site shall be graveled. Areas
not used for stockpiling or farming shall be seeded to
control erosion.
5 . The applicant shall handle and stockpile manure in the
fertilizer grinding area in a manner that will prevent
nuisance conditions. The manure piles shall not be allowed
-to exist or deteriorate to a condition that facilitates
excessive odors, flies or insect pests , or pollutant runoff.
The manure storage site shall have a watertight surface which
does not permit seepage or percolation of manure pollutants
into the ground.
6 . All liquid and solid wastes shall be stored and removed for
final disposal in a manner that protects against surface and
groundwater contamination.
7 . No permanent disposal of wastes shall be permitted at this
site.
8 . Soil , fertilizer, wood shavings, sawdust, and waste materials
shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential
nuisance conditions.
9 . Fugitive dust must be confined on this site.
10 . The maximum permissible noise level shall not exceed the
industrial limit of 80dB (A) , as measured according to
25-12-102 , Colorado Revised Statutes .

11 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
12 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
13 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 . 6 of the
Weld County Zoning Ordinance.
14 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
15 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services .
16 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards .
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated January 9, 1989, and
duly published January 18, 1989, in the Platteville Herald, a public
hearing was conducted to consider the request of Park Floral Company
for a Site Specific Development Plan and Special Review Permit for an
agricultural service establishment (fertilizer storage, mixing,
blending, and sales facility) in the A (Agricultural) Zone District.
Lee Morrison, Assistant County Attorney, made this matter of record.
Keith Schuett, representing the Planning Department, entered the
favorable recommendation of the Planning Commission into the record.
Kirk Douglas, authorized agent for Park Floral Company, came forward to
represent the applicant. He stated that this is an expansion of an
existing use. Mr. Douglas said they have no objection to any of the
proposed Development Standards, but they object to the last paragraph
of Condition 5, which requires an agreement for dust control on Weld
County Road 23. Mr. Douglas stated that most traffic uses Weld County
Road 141 , which is paved, and only about 107 of the truck traffic to
and from this business uses Weld County Road 23. The application shows
a total maximum of 20 vehicles per day, with the average being only 8.
No public comment was received concerning this request. (Tape Change
#89-6) After further discussion concerning the need for such an
agreement, Commissioner Brantner moved to approve the request of Park
Floral Company for a Site Specific Development Plan and Special Review
permit, subject to the recommended Conditions and Development
Standards, with the last paragraph of Condition 5 to be deleted. The
motion was seconded by Commissioner Kennedy, and it carried
unanimously.

The Chairman asked the applicant if he had reviewed the recommendation,
conditions, and _Development Standards set _forth by the Department of
Planning Services' staff. The applicant stated he had and was taking
exception to Condition r'5 because the Health Department had told them they
would be given a waiver because this is a family owned and operated
business.
Brian Bingle reported that written verification of this variance has not
been received from the Weld County Health Department. If verification is
received prior to this request being heard by the Board _of County
Commissioners, the -Board may take appropriate action.
The Chairman asked that the staff's recommendation, conditions, and
Development Standards be filed -with the summary as a permanent record of the
proceedings.

Jerry Burnett moved Case Number USR-869 for Pauline and Daniel Davis for a
Site Specific Development Plan srd a Special Review permit for a home

APPEARANCE:
Kirk Douglas, Agent for Park Floral represented the applicant. They have
reviewed the staff's recommendation, conditions, and Development Standards
and are taking exception to the requirement for a windbreak. The operation
is in a draw and the greenhouse is 450 feet long and acts as a windbreak.
They are objecting to amending the plat to accurately show the changes which
will be taking place. They move the soil and fertilizer stockpiles to
wherever they are working. This is no more than they have ever done except
before all soils and fertilizers were hauled off in planted pots, and they
now want to bag some of this for retail sales. None of their products are
sold to individuals. They are also objecting to the use of roads
recommended by the Weld County Engineering Department, and to a dust
abatement plan for those roads which are used by them.
Brian Bingle stated the applicants have not submitted any concrete evidence
to substantiate these changes. If evidence is submitted prior to this
request being heard by the Board of County Commissioners, the Board may take
the new evidence into consideration when making its decision.
The Chairman called for discussion from the audience. There was none.
The Chairman asked that the recommendation, conditions, and Development
Standards as presented by the Department of Planning Services staff be filed
with the summary as a permanent record to these proceedings.

2. It is the opinion of the Weld County Planning Commission that the
applicant has shown compliance with Section 24.3 of the Weld
County Zoning Ordinance as follows:
- The proposal is located within the urban growth boundary area
of the Town of Fort Lupton and is consistent with the Weld
County Comprehensive Plan's Urban Growth Boundary Goals and
Policies. Representatives of the Town of Fort Lupton, in its
referral response dated December 22, 1988, indicated the
proposal was outside its Master Flan Area and there were no
objections to this proposal.
- The proposal is consistent with the intent of the

- The applicant has demonstrated an effort has been made to
conserve productive agricultural land in the locational
decision for the proposed use.
- Special Review Development Standards will provide adequate
protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and the responses of the referral entities which have reviewed this
request.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County

consideration and approval. The approved barrier shall
be shown on the Special Review permit plat.

Health Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. The applicant shall handle, and stockpile manure in the fertilizer
grinding area in a manner that will prevent nuisance conditions.
The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, or insect pests,
or pollutant runoff. The manure storage site shall have a
water-tight surface which does not permit seepage or percolation of
manure pollutants into the ground.
2. All liquid and solid wastes, shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site.
4. Soil, fertilizer, wood shavings, saw dust, and waste materials shall
be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
5. Fugitive dust must be confined on this site.
6. Maximum permissible noise level shall not exceed the industrial
limit of 80db(A) , as measured according to 25-12-102, Colorado
Revised Statues.

Dear Mr . Schuett :
The Park Floral Company ' s request to grind , store and
stockpile organic fertilizer and other landscape materials
happen to be on Nunn clay loam soil which is prime farmland
according to the important farmland map for Weld County ,
Colorado .
Based on the belief that the _ground organic fertilizer and
other _ground materials are susceptible to blowing , we
believe a windbreak barrier should be constructed on the
north and west side of the stockpile area to control
potential wind erosion on and around the material .
Nunn soil type does not perform well under heavy traffic
because of its high clay content and low soil strength when
wet . We suggest graveling the heavy traffic areas. Also
any areas that are not used in the stockpile area or farmed
should be planted to an adaptable grass species to control
erosion on this area.
Last of all when the property is reclaimed for agricultural
production , the area should be subsoiled before being
returned to agricultural uses .

Explain Proposed Use
The applicant currently operates a 280 , 000 square foot
greenhouse production facility on the 100 acre property it
owns . As a specialized grower of retail potted plants, the
company imports soils and fertilizer which are ground,
mixed and used in the products sold from the greenhouse .
The applicant desires to relocate its soil grinding-organic
fertilizer operation -to a 4 acre parcel within the 100 acre
ownership of Park Floral -Company . The company will store,
stockpile, grind, mix, strain and separate soils, organic
fertilizers, rock and miscellaneous landscape aggregates .
No on-site materials , other than composted agricultural
byproducts, are used in the process .
Explain Need for Use
The applicant has been in the agricultural business for 53
years . It can accurately project the need for its
products , including soils, fertilizers and miscellaneous
aggregates . While a portion of the demand stems from the
unique aspect of a "potted plant" operation, the talance of
the need is general retail and wholesale product demand.
Potted plant growers sell their soil with each plant
exported. That soil must he continually replaced with the
new material mixed in the proposed operation. The
applicant currently imports most of its soil and -aggregate
from Douglas County, Colorado .
Explain the Types of Existing Uses on Surrounding Properties
All adjoining properties are agricultural uses on
agriculture zoning . The majority are irrigated group
production with some livestock uses .

The closest residential structure is about 900 feet to the

stored onsit-e . The stockpiles will be no taller than
approximately 12 feet, located as shown on the subject site

Park Floral Company
Consistency with the Weld County Comprehensive Plan
Although the proposed use By Special Review is clearly
agricultural in nature, the property falls within the three
mile Urban Growth Boundary of the City of Fort Lupton. As
such, the Urban Growth Boundary Policies of the Weld County
Comprehensive Plan are applicable .
-The applicant 's property is not included in the
comprehensive land use plan of the City of Fort Lupton . As
such, it neither conflicts or conforms to the plan. The
proposed use within the property is non-urban in nature . It
is compatible with the adjoining non-urban land uses which
surround the property.
The extension and improvement of infrastructure was paid
for -by Bark Floral Company when its original greenhouse
complex was constructed in 1986 and 1987 . Over $300 , 000 of
off-site infrastructure was paid for by the applicant . The
proposed land use places insignificant burdens on public
facilities and infrastructures . The applicant paid
approximately $16 , 000 in property taxes in 1987 . at paid
nearly $11 , 000 in school district taxes without
contributing one dwelling unit or student to the district 's
enrollment . It paid approximately $3 , 500 to Weld County in
property taxes . In total Park Floral already generates a
net profit to Weld County.
Park Fl-oral employs up to 70 people in the community with
an annual payroll in excess of -$1 , 000, 01)0 . The
perpetuation of economic benefits with minimum public
facility or service requirements is consistent with the
County ' s Comprehensive Plan .
Consistency with the A (Agricultural ) Zone -District
The stated purpose of the Agricultural Zone District is to
maintain and promote agriculture as an essential feature of
Weld County. Production greenhouses are a valuable part of
the agricultural composition of the County . To allow soil
grinding, -mixing and stockpiling is obviously compatible
with agricultural intents, and a necessity for certain
types of greenhouse operations .

Conservation of Pro-ductive Agricultural Lands
The applicant owns approximately 100 acres . Approxim-ately
90 acres are in production inclusive of greenhouse
production benches . No land is being taken out of
production for the propos-ed use .
Protection of the Health, Safety -and Welfare
Certainly, the economic well being of up to 70 people
depends in -part on P-ark Floral Company . The 3 additional
people will similarly benefit from the continued abilitie-s
of Park Floral to profitably operate .
The proposed land use presents no -new -health or safety
concerns to the neighborhood or t-he county as a whole . The
infrastructures and services already exist to insure
adequate provision of domestic water and sewage disposal .
No new sheriff or fire protection services will be
required. As a result, the -principal issue is the economic
welfare of the direct employees of Park T'loral, the new
employees ul the proposed land use, and the secondary
benefits which result from spin-off employment . Utilizing
information from the State of Colorado, 73 jobs in primary
production industry result in 175 jobs in the Region .
Certainly such an economic factor contributes to the
overall welfare of Weld County.
Compatibility with Surrounding Land Uses
The proposed land use is entirely surrounded by
agricultural profuction uses . The closest residential use
( a farm _dwelling) is 900 feet away . Soil grinding,
fertilizer -mixing, storage and stockpiling is -compatible
with irrigated corn and alfalfa production .
Compatibility with Fort Lupton ' s Adopted Master Plan
Fort lupton 's long-range Master -Plan does not include the
applicant ' s property. Fort Lupton and its Mayor were one
of Park Floral ' s largest supporters in its relocation from
Englewood to Weld County.
Special Zone District Regulations
Park Floral had its property raised out of the 100-year
floodplain in 1986 . It is not located in a geologic hazard
area or within the Weld County Airport area. No zoning
overlay districts affect the subject property.
