RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A HOME BUSINESS (SATELLITE DISH AND LEATHER GOODS RETAIL STORE) IN THE A (AGRICULTURAL) ZONE DISTRICT - TERRY NOWICKI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of July, 1988 , at the hour of 2 : 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Terry Nowicki, 5380 Easley Road, Golden, Colorado 80403 , for a Site Specific Development Plan and Special Review Permit for a home business (satellite dish and leather goods retail store) in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot A of RE-960 located in part of the SEi SE} , Section 10 , Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of Weld County Comprehensive Plan Agricultural Goals in that the proposal will not remove productive agricultural land from production. The uses permitted will be compatible with the existing surrounding land uses and with future development of the surrounding area as permitted by the Agricultural Zone District. The surrounding area is used for agricultural production. No objections have been received from surrounding property owners. d. No overlay districts affect the site. e . The Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review -Permit for a home business (satellite dish and leather goods retail store) in the A (Agricultural) Zone District on the hereinabove described parcel of land be , and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Special Review Permit be adopted and placed on the Special Review plat prior to recording the plat. 2. An ISDS Evaluation on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 3 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 4 . The Special Review Permit is for a home business (satellite dish and bather goods retail store) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to -Article 68 of Title 24 , C.R.S. , as amended. 3 . Waste oil, waste paints, stains, treatments, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surf-ace and groundwater contamination. 4 . Outside storage of satellite dishes shall be limited to a total of 20 operable satellite dishes and shall be located within the designated area as shown on the Special Review plat. 5 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 6 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 7 . The property owner or operator shall te responsible for complying with the Operation Standards of -Section 24 .6 of the Weld County Zoning Ordinance. 8 . Personnel from the Weld County Health Department, Ault Fire District, and the Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 9. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any -material deviations from the plans or Standards -as shown or stated shall require the approval of an amendment of the Permit by the Weld County 880690 Page 2 DEVELOPMENT STANDARDS - NOWICKI Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are the Department of Planning Services. 10 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Terry Nowicki, the applicant, asked that Development Standards #4 and #5 be deleted. Mr. Bangle stated that Development Standard 115, limiting the number of satellite dishes which may be displayed, was added by the Planning Commission. No public testimony was offered concerning this request. During the ensuing discussion, Mr. Nowicki explained that satellite dishes must be installed for inspection by customers, and he felt that a maximum of 20 operational satellite dishes would te acceptable. Mr. Bingle read into the record an additional Condition stating that the plat must be amended to show the designated area used for displaying satellite dishes and a new Development Standard addressing the maximum number of dishes to be displayed. Commissioner Lacy moved to approve the request of Terry Nowicki, subject to the Conditions as proposed by the Planning Commission and Mr. Bingle, and subject to the Development Standards, amended by the deletion of #4 and #5 and the addition of the Standard read into the record by Mr. Bingle. Based upon additional information and review, we add the following comments to our previous letter. This 5-acre property was created by the Heckman Exemption which was reviewed by this office in a November 21, 1986 letter to your office. Our letter addressed two issues including; the need for a 150-foot total highway sight of way, 75 feet each side of the highway centerline, and that access to both lots created by the exemption could be obtained through existing driveways to State Highway 14. No additional access to S.H. 14 would be permitted. ,7t It is our understanding that a 25-foot right of way reservation was obtained through the Heckman Exemption. This should be noted on the site plan. 1n addition to the fact that we had previously commented on access to this property, we have learned that two residences west of this property obtain their access to S.H. 14 through one of the two Nowicki property driveways.
