RE : DENIAL OF RECORDED EXEMPTION NO. 1030 - GEORGE H. AND
JENNYRAE OTTENHOFF
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did, at
a public meeting held on July 8 , 1987 , in the Chambers of the
Board, consider the request of George H. and Jennyrae Ottenhoff
for Recorded Exemption No. 1030 , regarding property which is
located in the Ni of the NE* of Section 29 , Township 5 North,
Range 64 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS , the request was to divide the property into parcels
estimated to be approximately 10 acres and 70 acres, and
WHEREAS , after hearing the testimony presented and reviewing
the recommendation of the Planning staff, a motion was made and
seconded to approve said request for Recorded Exemption No. 1030 ,
and
WHEREAS , on a roll call vote, the motion to approve said
request resulted in a tie vote , with Commissioners Brantner and
Kirby voting aye, and Commissioners Lacy and Yamaguchi voting nay,
and
WHEREAS , pursuant to the policy regarding land use matters ,
it was determined that Commissioner Johnson, who was excused from
the meeting of July 8 , would review the record and listen to that
portion of the tape concerning this matter, then cast her vote at
a later Board meeting, and
WHEREAS , at the Board meeting of July 20 , Commissioner
Johnson, after reviewing the record and listening to said tape,
voted nay on the motion to approve the request, therefore , the
motion fails , resulting in a denial of Recorded Exemption No.
1030 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the request of George
H. and Jennyrae Ottenhoff for Recorded Exemption No. 1030 on the
hereinabove described parcel of land be , and hereby is , denied .

Re: Recorded Exemption #1030
Dear Commissioners:
This request for a Recorded Exemption is submitted by George H. Ottenhoff
and Jennfltae Ottenhoff. The parcel of land on which this request is being
made is described as the Ni of the NEk of Section 29, T5N, R64W of the 6th
P.M. , Weld County, Colorado. The property is located approximately 1/2 mile
south of Kersey on the west side of Weld County Road 53. The parcel of land
under consideration is the total contiguous land holdings of the applicant.
The request is to divide the property into parcels of 10 acres and 70 acres,
more or less. It is the opinion of the Department of Planning Services'
Staff that sufficient justification has not been given to warrant exemption
of a lot at this time, and that in the immediate vicinity development has
reached a level where continued divisions of parcels would evade the intent
of the Weld County Subdivision Regulations. In this section, seven Recorded
Exemptions have been approved and an additional 18 Recorded Exemptions have
been approved in adjoining sections, creating laud splits and residential
building sites. The Department of Planning Services Staff has concerns
about the amount of development in the immediate vicinity and the potential
for continued divisions of parcels which will increase the residential
density in the area.
The Agricultural Zone District was established to maintain and promote
agriculture as an essential feature of Weld County. It is intended to
provide areas for the conduct of agricultural activities with out the
interference and encroachment of other more intensive land uses. The
request, if approved, will allow for the potential of an additional
residence not currently allowed under the existing land use regulations.

Scattered residential development in rural areas, at some point in time,
requires an increase in public services, additional demands of expenditures
for road maintenance, police protection, fire protection, and educational
services. Additionally, rural residential development reaches a level where
it begins to interfere with and encroach upon the agricultural activities in
the area. The time to realize the significance of such possibilities is
now, and should be considered by the Board as it reaches a decision on this
request.
The staff requests that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2E (1) (a) through
(m) have been met.

Dear Mr. Schuett:
This letter is intended to supplement our application for
recorded exemption in response to the specific questions which
you posed to me by telephone :
Item 6 . The proposal is consistent with the intent of the
zoned district because the use of the land will not change . As
indicated in the application , the land is not irrigated and has
only sparse vegetation. It is presently suitable , therefore , for
only very limited grazing . Lot A will continue to be used for
the same purposes. The intent behind the recorded exemption is
to allow someone to live in the country on a ten-acre tract and
to raise one or two horses , cattle or sheep. The tract is likely
to be most desirable to a family with children interested in
participating in 4-H activities . There are many excellent 4-H
clubs in the community , and our children as well as the children
of a number of the neighbors are actively involved in 4-H clubs .
The intent of the A District is to preserve agriculture as a
valuable resource , and the limited agricultural use of the land
will be preserved . Residential use of Lot B will be limited to
one single-family residence , and such a dwelling will not reduce
the agricultural use of the land.
Item 7 . As indicated , the uses that will be permitted are
residential use by a single family , and limited agricultural
activities . These are the same uses of all other land in the
section , and of all other land adjacent to the subject land .
There is no land in the E1 /2 of Section 29 or in the W1 /2 of
Section 28 immediately east of the subject land which is crop
land . It is all used for residential and very limited grazing
purposes .
Item 9 . This application is not inconsistent with the
efficient and orderly development because both Weld County and
the Town of Kersey project future more intensive residential use
of the area . This proposal is consistent with the limited

development which the county has allowed by approving three or
four recorded exemptions in recent years within one-half mile to
the south of the subject property . The rate of development is
controlled by the County 's limitation on the number of recorded
exemptions that can be granted for a single parcel in a five-year
period, and also by the review process itself. The proposal is
consistent with efficient development because it makes use of
existing services , and requires no new roads or utility
extensions . Road 53 on the east of the subject property has just
been resurfaced to accommodate traffic , and electric , water and
telephone lines are all in place in the County road right-of-way .
As you requested , I am enclosing a revised map showing
existing improvements, the gas pipeline right-of-way , and widths
of rights-of way.

The purpose of the request is to divide an existing acreage
into two parcels , the smaller of which will be used primarily for
residential purposes , and the other for residential and limited
agricultural purposes. The rationale for the request is that the
highest and best use of the land is for residential purposes , as
the land is not irrigated and, because of sparse vegetation , has
very little value for pasture.
This request is consistent with the policies and
Comprehensive Plan of Weld County, since the property is included
within an urban growth boundary of the Comprehensive Plan . The
property lies approximately one mile south of Kersey , and is in
the Phase II Residential Low Zone of the Kersey Comprehensive
Plan . The use is compatible with the residential and limited
agricultural uses in the surrounding area as a number of recorded
exemptions have been granted in the immediate vicinity.

To the best of our knowledge this property is not located
within a flood plain , geologic hazard area or any overlay
district . Domestic water is presently provided by the Central
Weld County Water District , which can furnish water service to
the new parcel . Sewage disposal will be by on-site septic tank
and leach line.

Dear Mr. and Mrs. Ottenhoff:
Your recorded exemption application has been submitted to the Department of
Planning Services and will be processed by our office on or before July 10,
1987. If it is determined that the application meets the approval criteria
of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision
Regulations, you will be notified that the recorded exemption is approved.
If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of
County Commissioners at a public hearing. You will be informed of the
hearing date at least a week prior to the hearing. The Board of County
