RESOLUTION RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, CONCERNING THE REVISION TO AN APPROVED SITE APPLICATION OF ARA DEV CON, INC. , DBA COUNTRY VIEW CARE CENTER, AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Regulations for Site Applications for Wastewater Treatment Facilities require review of the Site Application by the Board of County Commissioners prior to commencing construction and; further, that various local and State agencies be given the opportunity to review and comment on said Site Application, and WHEREAS, on April 15 , 1987 , the Board of County Commissioners of Weld County, Colorado, reviewed a Site Application submitted by ARA Dev Con, Inc. , dba Country View Care Center, and WHEREAS, the Board did submit a favorable recommendation to the Colorado Department of Health for said Site Application, and WHEREAS , on May 25 , 1988 , the Board was presented with a revision to a Site Application which had been approved by the Colorado Department of Health, and WHEREAS, after study and review, the Board finds that said revision to the approved Site Application is compatible with the Weld County Comprehensive Plan and that it is in the best interest of Weld County to recommend approval of said revision, subject to the following conditions: 1) A six-foot tall solid wood fence shall be constructed and maintained on the south and west boundary of the aeration lagoon . The fence shall be constructed immediately adjacent to the pond berm; and 2) The three existing evaporation ponds shall be reclaimed to a natural state with existing soil and the area planted with a native vegetation of grass approved by the Longmont Soil Conservation District. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the revision to the approved Site Application of ARA Dev Con, Inc . , dba Country View Care Center, be, and hereby is, recommended favorably to the Colorado Department of Health as being compatible with the Weld County Comprehensive Plan, subject to the above listed conditions. The proposed revision will not be a duplication of services and will allow for efficient, cost-effective delivery of sewer service. The wastewater treatment facility has the capacity to serve the care facility, is not located in the flood plain, and it does not appear to have an adverse affect on water quality of the area. This proposed revision does not appear to have any negative impacts on the general health, safety, and welfare of the present and future residents of Weld County. The Weld County Health Department and the North Front Range Water Quality Association have reviewed this request and have set forth no objections. LEGAL DESCRIPTION: Part of the of Section 13, T3N, R68W of the 6th P.M. , Weld County, Colorado LOCATION: North of Weld County Road 32 and west of Weld County Road 13. APPEARANCE: Jeff LeDoux, P.E. , Nelson Engineers, represented the applicant. About a year ago, the original requests were reviewed and approved. Since that time, the surrounding property owners filed a legal action to stop the use of the evaporative ponds. This request is to amend the approved plan, to abandon the three evaporative ponds, and to release the treated effluent directly into Thomas Lake. The Chairman called for discussion from the members of the audience. 880414 Summary of the Weld County Planning Commission Meeting May 17, 1988 Page 6 Ken Lind, Attorney, represented adjacent residents to this site. His clients, whose properties look down on the ponds, do not appreciate this view. He distributed three pictures. These were retained for the file. He recommended a six foot wooden fence be place on the south and west boundaries of the areation lagoon. He also recommended the three evaporative ponds that are to be abandoned be filled to grade and restored with native grasses. NOTICE: 2:40 p.m. LeAnn Reid is excused from the remainer of the meeting. Tape 321 - Side 2 Lee Morrison explained that this is not a County permit. It is just a recommendation to the State on a site application and the County would not be involved in the actual granting of a site plan. The Planning Commission can, however, recommend conditions to bring the application into conformance with our land-use policies which the state may consider when granting the permit. AMENDMENT: Lynn Brown moved that two Conditions of approval be added. These conditions should read as follows: 1. The County Planning Agency is requested to comment upon the relationship of the sewage treatment facilities to the local long—range comprehensive plan and any other plans for the area, including the 208 Water Quality Management Plan. Those property owners are identified as follows : Mr. and Mrs . Ray Edmiston , Mr . and Mrs . Nick Sekich , and Mr. and Mrs . Martin Graham. Specifically, these three property owners own property and personal residences located within 1 , 000 feet of the Country View Care Center property. The purpose of this letter is to express our concerns with the proposed amended site application and to request certain mitigating factors . It should be noted that the original site application which was approved by Weld County and the State of Colorado inaccurately located the three residences of our clients which resulted in construction of evaporation ponds 575 feet from the Edmiston residence and, incredibly, only 115 feet from the Graham and Sekich residences . Substantial legal action on behalf of our clients along with cooperation from ARA and the State Department of Health has resulted in the amended site application being presented . We would like to add that our clients did not participate in the original site application review due to improper notice , however , that defect has now been remedied and our clients are interested in participating to mitigate certain health and environmental problems . Our clients generally support the proposed amended site application but they support this proposal only with three mitigating factors . The requested mitigating factors are insignificant as to operations of the amended application but have substantial benefit to Weld County citizens , both from an 880414 Weld County Department of Planning Services May 10 , 1988 Page 2 environmental and economic standpoint . Our requests are to require the installation of a 6 foot tall solid wood fence on the west boundary of the evaporation pond which surrounds the aeration lagoon . It is requested that this fence be constructed immediately adjacent to the pond berm ( dike ) on the west side which will effectively screen the evaporation pond and lagoon from the public view as well as inhibit any aerosol drift. Our second request is to require landscaping south of the evaporation pond along its entire length which will screen the facility from public view from Weld County Road 32. It would be our request that the landscape screening be alternating Russian Olive and Evergreen trees to be planted 3 or 4 feet apart and all trees to be not less than 4 feet in height at the time of planting . By use of these trees rather than a solid wood fence , it is our understanding that the facility will be screened and at the same time air and wind movement will still be permitted , thereby not affecting the operations of the wastewater facility. Our final request concerns the two existing evaporation ponds which were constructed during the fall of 1977 and are located to the west of the proposed facilities and east of the Graham and Sekich residences . Specifically, it is necessary that these ponds be filled with earth and planted in some type of native vegetation or grass . If these two ponds are not filled they will continue to be an eye-sore and during periods of rain , will result in a breeding ground for insects and other vermin . Once the ponds are filled , it will be necessary to plant those structures to avoid blowing dust and similar problems . With the addition of these three minor items , our clients can accept the facility and it is our belief that the economic and environmental impacts are minimized and mitigated . Thank you for your attention and cooperation in this matter and we would request that these requests be included as development and/or operation standards for the amended site application . The meeting was called to order at 7:00 p.m. by Vice-Chairman Rybus. Also present were Bill Kelly from ARIX; Victor Weidmann, Weidmann Engineering (Ptarmigan) ; and Vern Nelson, Nelson Engineers (ARA Country View Care). 2. The minutes of the January 21, 1988 meeting were reviewed. Mr. Gerstberger moved for approval of the minutes as submitted, Mr. Schemm seconded the motion, and it passed. 3. Mr. DuBois introduced the proposed plan amendment for the Town of Ault. This amendment would enlarge the Town's service area and allow for improvements to their wastewater treatment plant. Mr. Ken Henschke commented on the plan as it relates to the proposed construction of a prison in Ault, which would be owned by the Town. Questions were asked about the wells and use of groundwater in the area of the treatment plant, and Mr. Kelley of ARIX said monitoring wells would be provided to evaluate the impacts on groundwater. Soil and percolation tests have shown a high degree of variability in results. Other issues discussed included notification of adjacent property owners, plant site ownership, flow projections, and permit limits. Mr. Potter asked the Town to check on precise property ownership boundaries. North Weld Water District supplies water to Ault, and there would be adequate water available to serve additional development. The service area boundaries proposed correspond to the Town's comprehensive plan. The Town was asked to provide some additional information in writing to support the plan amendment Those items include justification of the service area boundaries, flow projections, alternatives considered, and projected impacts on groundwater and wells in the area. The Town agreed to provide water taps if a domestic well was affected. Mr. Gerstberger moved that the expansion of the service area be approved with the understanding that the treatment facility is not approved, and Mr. Johnson seconded the motion. Treatment facilities and impacts will be reviewed more closely during the site application process. The motion was approved unanimously. 880414 February 18, 1988 NFRWQPA Minutes Page 2 4. The Ptarmigan development lift station, which was previously approved, was the subject of a resubmitted site application to revise the design capacity of the facility from 1.04 mgd to 1.447 mgd. Mr. DuBois introduced the item, saying it was a requirement of the South Fort Collins Sanitation District that the capacity be increased, and recommended approval. Mr. Schemm moved that the site application be given an affirmative recommendation, Mr. Potter seconded the motion, and it passed unanimously. ( 5. )he revised site application for the Country View Care Center was introduced by Manager DuBois. The revised plan involves a proposed discharge to Thomas Reservoir rather than the previously approved facility with evaporation ponds and no discharge. The reason for the change was that the disposal ponds were located too close to two existing residences. A discharge permit will be required; and an agreement with the Public Service Company of Colorado, owner a—cce of Thomas Reservoir, needs to be finalized. Mr. DiTullio moved that the site application be recommended for approval with the conditions that the agreement with Public Service Company be finalized and that the facility be connected to a public sewer when one becomes available. Mr. Schemm seconded the motion and it passed unanimously. 6. The draft performance evaluation criteria were discussed, led by Ms. Burger, representing the committee that drafted the document. There were some concerns expressed that the criteria were too detailed and may not all be necessary, and whether it was in agreement with the manager's contract. Mr. Wagner moved that the item be tabled until the next meeting, and Mr. Carlson seconded it. It was suggested that the criteria be reviewed by the Executive Committee with the Manager. Mr. Wagner agreed to withdraw his motion. Mr. McCoy then made a motion to refer the matter to the Executive Committee for their decision, Mr. Johnson seconded it, and it passed unanimously. • 7. Manager DuBois gave an update on the WQCC hearings coming up including the Basic Standards hearing beginning March 7 and the hearing on biomonitoring regulations scheduled for April 4. For the Basic Standards hearing the first two days will deal with antidegredation and the third and fourth days will involve the other issues to be heard. Issues related to standards and detection levels for organic and radioactive pollutants will be continued to a July hearing. A committee to review the biomonitoring regulations was appointed and included Mr. McCoy, Mr. Scott, Ms. King, Terry Farrill from SFCSD, Keith Elmund - Fort Collins, and Mike Beck - Greeley. The implementation date for pretreatment regulations is to be decided in April, also. 8. The financial report for January was presented by Manager DuBois along with the report for the period of October 1 to December 31, 1987. Expenses with the City of Loveland began February 1, 1988. The City is now writing checks for the Association and investing the assets of the NFRWQPA along with city monies.
