RESOLUTION
RE: APPROVE SUPPLEMENTAL CONTRACT WITH THE STATE DEPARTMENT OF
HIGHWAYS, DIVISION OF HIGHWAYS, FOR BRIDGE REPLACEMENT OVER
LATHAM DITCH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on October 5 , 1983 , a Contract was entered into
between Weld County and the State Department of Highways, Division
of Highways, for replacement of a bridge on Weld County Road 54
over the Latham Ditch, and
WHEREAS, the Board has been presented with a Supplemental
Contract for said bridge replacement, and
WHEREAS, the terms and conditions are as stated in said
Supplemental Contract, a copy of which is attached hereto and
incorporated herein by reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Supplemental Contract.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Supplemental
Contract between Weld County and the State Department of Highways,
Division of Highways, for replacement of a bridge on Weld County
Road 54 over the Latham Ditch, be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
August, A.D. , 1985 .

CONTRACT
THIS 1ST SUPPLEMENTAL CONTRACT, made this 2O/A day of
Ars/ , 1985 , by and between the State of Colorado for the
use and benefit of THE STATE DEPARTMENT OF HIGHWAYS, DIVISION OF
HIGHWAYS, hereinafter referred to as the State, and COUNTY OF WELD,
STATE OF COLORADO, hereinafter referred to as the contractor or Local
Agency.
WHEREAS, authority exists in the Law and Funds have been budgeted.
appropriated and otherwise made available and a sufficient
unencumbered balance thereof remains available for payment in Fund
Number 2001, G/L Account Number 52046, Contract Encumbrance Number
83280; and
WHEREAS, required approval, clearance and coordination has been
accomplished from and with appropriate agencies; and
WHEREAS, the State and Local Agency have heretofore entered into a
project contract dated October 5, 1983, hereinafter referred to as the
basic contract, made a part hereof by reference, which provided
funding for preliminary engineering, utilities, right of way and
construction for replacement of a bridge on Co. Rd. 54 over the Latham
Ditch in Weld County, Colorado; and
WHEREAS, the parties hereto in conjunction with the Federal
Highway Administration have agreed that revisions to the funding are
necessary and the basic contract shall be modified accordingly by a
supplemental contract.
NOW. THEREFORE, it is hereby agreed that:
1. The basic contract, unless specifically revised or amended
herein, shall be and remain in full force and effect with
respect to the contractual relationship between the parties
hereto.

2. The sixth WHEREAS clause of the basic contract shall be
amended by deleting the figure "$73, 600" and substituting
•
therefor the figure "$147,200" .
3. Paragraph A. of the Project Provisions is hereby amended by
deleting the figures "$94,000" . "$18,400" and "$2,000" and
substituting therefor the figures "$188,000" , "$36,800" and
"$4,000", respectively.

IN WITNESS WHEREOF, the parties hereto have executed this contract
the day and year first above written.

Weld County and the Department of Highways for Project BRO 0003(2), Co. Rd. 54,
Latham Ditch. The supplemental contract reflects the corrected budget amount'
for the project.
Please sign three copies and return them to this office for further pro-
cessing. The fourth copy should be retained for your files until a final
executed copy is received. Please do not date the first page of the contract.
