Morrison Director of Planning Services, Chuck Cunliffe The following business was transacted: I hereby certify that pursuant to a notice dated December 16, 1985, and duly published December 19, 1985, in the Johnstown Breeze, a public hearing was conducted to consider increased fee schedules concerning fees charged by the Weld County Department of Planning Services for Land-Use Permit Applications for 1986. Lee Morrison, Assistant County Attorney, made this matter of record. Chuck Cunliffe, Director of Planning Services, read the favorable recommendation of the Planning Commission into the record. Mr. Cunliffe stated that the recommended fee schedule reflects an increase of approximately ten percent. No public comment was received concerning this matter. Commissioner Lacy moved to approve the increased fee schedules as proposed. Commissioner Kirby seconded the motion which carried unanimously. He reviewed costs and expenses associated with regulating and administering planning functions in the County. The proposed fees would be reasonable, but would not recoup total costs. The projected revenue collected would offset approximately 23% of the Department's 1986 budget. Motion seconded by Don Johnson. The Chairman called for discussion from the members of the Planning Commission. Discussion followed whether the proposed increase was enough, and whether or not land-use applicants should pay the total costs of processing a request. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Lydia Dunbar - yes; Doug Graff - no; Lynn Brown - yes; Don Johnson - yes; Louis Rademacher - no; Ann Garrison - yes; Paulette Weaver - yes; Jack Holman - yes. Motion carried with six voting for the motion and two voting against the motion. f l Offer comments on proposed revisions to the building permit fee schedule. Chuck Cunliffe, Director, reviewed the proposed Building Inspection Fees for 1986. The County is in the process of adopting the 1985 uniform construction codes. The fee schedules within the construction codes indicates a fifty percent increase. Weld County is proposing to adopt a 33% increase. The fee structure is targeted to recover the full costs of the activities being performed and not subsidized by property taxes since the applicant generates the need for the inspections costs. G; z2e/6' Summary of the Weld County Planning Commission December 3, 1985 Page 10 MOTION: Paulette Weaver moved the proposed Building Inspection Fees for 1986 be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the recommendation of the Department of Planning Services. Motion seconded by Ann Garrison. The Chairman called for discussion from the members of the Planning Commission. Discussion followed as to whether or not a 35% increase in lees was enough to cover all department expenses, and whether a fee increase should be considered at all considering the depressed economic conditions. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Lydia Dunbar - no; Doug Graff - No, and he would like to particularly say, especially to the Weld County Building Department and the people who work there, that he holds them in very high regard. He feels they do an outstanding job compared to other areas where he has worked and he wants them to know that be supports them in that -manner. He is not voting against them, he is voting against an increase in fees in general at this point in time. Lynn Brown — yes; Don Johnson - No, for the same reasons given by Doug Graff. Louis Rademacher - no; Ann Garrison - yes; Paulette Weaver - yes; Jack Holman - yes. Motion is a tie vote which constitutes denial of the motion for approval. CORRESPONDENCE: The Chairman read a letter of resignation from Bill McMurray, representative from District 6. NEW BUSINESS: Chuck Cunliffe reported there are no items scheduled for the December 17, 1985, Planning Commission Meeting. MOTION: Don Johnson moved the Planning Commission's next meeting date be set for January 7, 1986, and that no further meetings be held in 1985. Motion seconded by Doug Graff. The Chairman called for discussion from the members of the Planning Commission. There was none. The overall concept is to attempt to recoup many of the costs associated with regulating and administering planning functions in the County, but yet keep the fees reasonable. The fees are not recouping total costs based on the latest available figures used to project the administrative and indirect costs we are experiencing in the department. The fees collected go toward supporting costs of the Planning Department. The projected revenue collected will offset approximately 23% of the Department's 1986 budget. This figure is taken from the cost allocation plan prepared by the Director of Finance and Administration in accordance with the policies and procedures contained in Federal Management Circular FMC 74-4.
