E ill S} f`la 1 Iii- 1 71 1, A4 1' :E RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR A CHURCH IN THE A (AGRICULTURAL) ZONE DISTRICT - GALETON COMMUNITY CHURCH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of July, 1987, at the hour of 9 :00 a.m. in the Chambers of the Board for the purpose of hearing the application of Galeton Community Church, 24767 Grandview Avenue, Galeton, Colorado 80622 , for a Use by Special Review for a church in the A (Agricultural) Zone District on the following described real estate, to-wit: Lots 7 and 8 , Block 18 , Galeton, Weld County, Colorado WHEREAS , said applicant was represented by Marion Richter, board president of the Galeton Community Church, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons : 1 . She Use by Special Review permit is for an expansion of an existing church as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . All construction an the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 3 . Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner Commissioner Jacqueline Johnson - Excused Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff County Attorney, Thomas 0. tavid Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated June 15, 1987, and duly published June 18, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of the Galeton Community Church for a Use -by _Special Review for a church in the A-Agricultural Zone District. It was noted that this matter was continued from July 1 because a sign tad not been posted the required ten days prior to the hearing. _.anell Swanson, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. This recommendation is based upon three Conditions and seven _Development Standards. Marion Richter, board president of the Galeton Community Church, came forward to represent the applicant. He said that the only problem is with Condition #3, which states that the church must be connected to a septic system unless the Galeton sewer system achieves compliance with the State -Health Department regulations. Mr. Richter said the existing church is on the Galeton sewer system and they would prefer to stay on that system. After discussion, Commissioner Kirby moved to approve the request for a Use by Special Review, amending -Condition #3 to provide that adequate sewage facilities will be provided to meet -Health Department standards, and subject to all other Conditions and Development Standards as recommended by the Planning Commission. The motion was seconded by Commissioner Rrantner. No public -comment was offered concerning this request. Prior to the vote, Chairman Lacy stated that, with only four Commissioners present at this hearing, if the matter should result in a tie vote, the absent Commissioner would review the record and listen to the tape prior to casting the deciding vote. They want to add 2,400 square feet to the church for classrooms and to enlarge their social area in the basement. The church is presently connected to the Galeton. Sewage Disposal System. They have seating for 125 persons, but this request is not for enlargement of the sanctuary. The addition will be connected to the present church on the east side. The Chairman asked Mr. Richter if he had reviewed the recommendation, conditions, and development standards as outlined by the Department of Planning Services staff. He stated he has trouble with Condition #3. They are on the Galeton Sewage Sewage Treatment System, but the staff is asking them to put in a septic system and then hook up to the Galeton Sewer System. This would be very expensive. They would like to go onto the present system and just not connect the restrooms until the public system is repaired or enlarged. They are putting in four new bathrooms, but when these are operable they will no longer be using the existing restroom if they are allowed to stay on the present system. They will -continue to use the old restroom _until they have completed building the addition, which may be two years. They -will need two sewer taps because the parsonage -is on one tap and the church would be on another. The sewage treatment plant is currently in violation of state statutes. An individual septic treatment system that is properly installed and taken mare of can last indefinitely. He asked that -if an -individual septic system is installed they -be allowed to use it long enough to make the expense worthwhile. An engineered system would cost ten to twelve thousand dollars because it would be based on the seating capacity of the -church and not on actual use. Lee Morrison explained the Galeton Sewage Treatment System has several problems. It is currently run as a private system. The city can make this into a public sewer system. It has currently been condemned by the Health Department and no new taps can be issued until these problems -are corrected. 870597 �XHl8IT a Summary of the Weld County Planning Commission Meeting June 2, 1987 Page 5 AMENDMENT: Paulette Weaver moved Condition 113 be amended to read as follows: 3. If compliance of the Galeton Sewer System, is not obtained upon -the applicant'-s ability to -occupy the Use by Special Review the applicant shall provide a septic system designed by a Colorado Registered Professional Engineer according to the Weld County Individual Disposal Regulations. CASE NUMBER: USR-793:87: 19 APPLICANT: John and Carolyn Fitch REQUEST: Use by Special Review permit for a Kennel Operation LEGAL DESCRIPTION: Lots 1 and 2, Block 46, Aristocrat Ranchettes Subdivision LOCATION: Approximately .5 miles east and .5 miles north of Fort Lupton: 7341 Hart Street APPEARANCE: Carolyn Fitch, property owner and applicant, stated that about four years ago, while living in Indiana, her husband got the greyhound bug. Colorado and Arizona are the only two states small greyhound kennels are allowed. They sold their property in Indiana and tame to Colorado where they obtained a job working for a kennel and where they could also raise some of their own dogs. This operation ran into financial difficulty so they found their property in Aristocrat Ranchettes Subdivision. They have been inspected by the Health Department, the Humane Society, and the Racing Commission. If this request is approved they will make arrangements to keep their dogs in at night. Greyhound racing provides a -boost to the Colorado economy. Tape 285 — Side 1 They currently have fourteen dogs. The dogs are let out in runs six times a day. They pick up after the dogs each time _they have been out. If this request is approved, they would put_tin additional screening. Their request is for thirty—five dogs, but they would agree to less than that. The mobile home being used for a kennel is not hooked up to any utilities. This is an agricultural area. There are a lot of animals in this area in addition to three other kennels in Aristocrat. There are five additional greyhound farms in the immediate area. They would be willing to meet with almost any concessions in order to stay here. On Sunday mornings people begin to arrive at 9:30 a.m. , Sunday school services are over at 11 :00 a.m. and church services begin then. Church services are over at 12:00 p.m. with all vehicles gone by 12 :30 p.m. There are usually no more than 30 to 35 vehicles present at any time. Every Thursday evening choir practice is held from 7:00 p.m. to 8:30 p.m. with about 5 vehicles involved. On the second and forth Thursday evenings we have Bible Study from 8:00 to 10:00 p.m. with about 15 cars involved. On the second Monday evening of each month the Galeton 4-11 club uses the basement for meetings beginning at 7:30 p.m. and usually over by 9:30 p.m. Parents drop their kids off and pick them up later. Some parents from outlying areas do remain with usually no more than10 to 15 vechicles there at one time. This traffic flow pattern does not take into account any unscheduled activities such as weddings, showers, funerals, and so on. These activities are scheduled probably less than 8 times throughout the year. Traffic flow depends on the size of the activity. Thank you: Marion L. The 1 ,200 square feet upstairs is currently being used as the sanctuary. The 1 ,200 square feet downstairs functions as our kitchen and fellowship hall. The new addition will contain 2,400 square feet. This additional footage will be used for Sunday school classrooms, a nursery, office space and expand the existing space used for the fellowship hall. All facilities will be used by the congregation for Sunday school classes, church services and func- tions. The Galeton 4-ll Club may on occasion use the fellowship hall for meetings. The church is used primarily on Sunday with occasional use on Thursday nights for Bible study. The church will require 31 parking spaces since it will seat 125 people when finished (Refer to parking, 1st map) . The parking places will be needed primarily on Sundays. The Galeton sewage system at this time is questionable. Therefore we are prepared to follow the recomendation of the planning committee. It is possible to bypass the existing system and have a new leach system engineered in the church's park. Or if the new Galetown sewage system is in the process of being built, the church could hook onto it. Our disposal of the trash is delegated to members of the congregation. On Sunday mornings people begin to arrive at 9:30 a.m. , Sunday school services are over at 11 :00 a.m. and church services begin then. Church services are over at 12:00 p.m. with all vehicles gone by 12 :30 p.m. There are usually no more than 30 to 35 vehicles present at any time. Every Thursday evening choir practice is held from 7 :00 p.m. to 8:30 p.m. with about 5 vehicles involved. On the second and forth Thursday evenings we have Bible Study from 8:00 to 10:00 p.m. with about 15 cars involved. On the second Monday evening of each month the Galeton 4-H club uses the basement for meetings beginning at 7 :30 p.m. and usually over by 9:30 p.m. Parents drop their kids off and pick them up later. Some parents from outlying areas do remain with usually no more thanl0 to 15 vechicles there at one time. This traffic flow pattern does not take into account any unscheduled activities such as weddings, showers, funerals, and so on.
