RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY ANTELOPE
HILLS LOCAL IMPROVEMENT DISTRICT NO. 1986-1
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , in accordance with CRS, §30-20-607 , as amended , a
Statement of Expenses and Apportionment has been filed with the
Weld County Clerk and Recorder by the Weld County Engineer, and
WHEREAS, pursuant to CRS, §30-20-608 , there has been proper
notice of this hearing and of the costs of the improvements , the
portion to be paid by Weld County, and the share to be assessed to
each lot, and
WHEREAS, there are no complaints or objections, and there
appears to be no reason to make modifications to the Statement of
Apportionment filed herein and attached hereto and incorporated by
this reference as Exhibit "A, " and
WHEREAS, the Board finds that the property described herein
as Lots 1 through 9 , Antelope Hills Subdivision , First Filing, and
Lots 10 through 26 of Antelope Hills Subdivision, Second Filing,
have specifically benefitted from the proposed improvements for
the following reasons:
a. The market value of the property will increase;
b. The improvements have adapted the property for a more
profitable use; and
c. The proposed improvements will facilitate access to each
of the properties and thereby increase the convenience
of use of said property, and
WHEREAS, this Resolution shall be prima facie evidence of the
fact that the property assessed is benefitted, the amount of the
assessment, and that the assessment has been lawfully levied.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado: That the owners of the
property described as Lots 1 through 9 in Antelope Hills
Subdivision , First Filing, recorded at Book 648 , Reception No.
157391; and Antelope Hills Subdivision , Second Filing, Lots 10
through 26, recorded at Book 648, Reception No. 157392 on June 24,
1971 , in the Records of the Weld County Clerk and Recorder, being
a subdivision in the Northwest Quarter of Section 13 , Township 6
North , Range 67 West of the 6th Principal Meridian, Weld County,
Colorado, are hereby assessed the sum of $27 ,029. 68 divided by 26
equal portions for each Lot to equal $1 , 039 . 60 per Lot, which
shall be the cost of the improvements and expenses less the
contribution of Weld County in the sum of $15 ,000. 00 and less the
money held in escrow by Weld County from monies previously
collected from the developer for this purpose in the amount of
$15 ,473. 55.
BE IT FURTHER RESOLVED that the assessments will be due and
payable without demand within thirty (30) days after the effective
date of this Resolution, but in the event the owner of the real
property shall fail to pay the whole of such assessment against
his or her property within said thirty (30) days , then the whole
cost of the improvements so assessed against each property shall
be payable in not more than ten (10) equal annual installments of
principal with interest on the unpaid installments at an interest
rate of ten percent (10%) simple interest per annum. The first of
such installments shall be due and payable prior to May 1 , 1987 ,
and the remainder of said installments shall be due and payable
successively on the same day and each year thereafter, unless
otherwise determined by the Board of County Commissioners, until
the assessment is paid in full.
BE IT FURTHER RESOLVED that the property to be assessed for
said improvements shall be the property that is specifically
benefitted by said improvements and more particularly described
herein.
BE IT FURTHER RESOLVED that all assessments made pursuant to
this Resolution, together with all interests thereon and penalties
for default and payment thereof and all costs in collecting the
same shall constitute, from the effective date of this Resolution ,
a perpetual lien in the amount assessed against each Lot and shall
have priority over all other liens excepting general tax liens.
No delays, mistakes , errors, or irregularities in any act or
proceeding authorized by CRS, Section 30-20 , Part 6 , shall
prejudice or invalidate this final assessment, but the same may be

remedied by subsequent amending acts or proceedings, as the case
may require. When so remedied, the same shall take effect as of
the date of the original act or proceeding.
BE IT FURTHER RESOLVED that the County Clerk and Recorder is
directed to prepare a local assessment roll, in book form,
showing, in suitable columns, each piece of land assessed, the
total amount of assessment, the amount of each installment of
principal and interest, if, the same is due and payable in
installments , and the date when each installment will become due,
with suitable columns for use in case payment of the whole amount
or of any installment or penalty, and deliver the same , duly
certified under the County seal, to the County Treasurer for
collection for the period of time following thirty (30) days after
the effective date of this Resolution. Said roll may be prepared
with the assistance of the Department of Finance for Weld County.
BE IT FURTHER RESOLVED that a payment may be made to the
County Treasurer at any time within thirty (30) days after the
effective date of the assessment under this Resolution. At the
expiration of said thirty (30) day period, the County Treasurer
shall return the local assessment roll to the County Clerk and
Recorder, therein showing all payments made thereon, with the date
of each payment. Said roll shall be certified by the County Clerk
and Recorder under the seal of the County and thereby delivered by
the County Treasurer, with its warrant for the collection of the
same. The County Treasurer shall receipt for the same, and all
such rolls shall be numbered for convenient reference.
BE IT FURTHER RESOLVED that failure to pay any installment,
whether principal or interest, when due, shall cause the whole of
the unpaid principal to become due and collectible immediately,
and the whole amount of the unpaid principal and accrued interest
shall thereafter draw interest at the rate established pursuant to
CRS, §5-12-106 (2) and (3) , until the day of sale; but at any time
prior to the day of sale, the owner may pay the amount of all
unpaid installments, with the interest at the penalty rate set by
the assessing Resolution , and all costs of collection accrued and
shall thereupon be restored to the right thereafter to pay in
installments in the same manner as if default had not been
suffered. The owner of any property not in default as to any
installments or payment may, at any time, pay the whole of the
unpaid principal with the interest accruing to the maturity of the
next installment of interest or principal.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
December, A.D. , 1986.

Following is a copy of the letter concerning Local Improvement
District #1986-•1 which was mailed to the landowners of property in
Antelope Hills on December 15 , 1986:
The Weld County Board of County Commissioners approved tbe,
attached Resolution on December. 10 , 1986 , assessing $1 , 039. 60
against each lot in Antelope Hills Subdivision , 1st and 2r.d
Filing. Your attention is called to the provisions which allow
you to pay that amount to the Weld County Treasurer prior to tic
close of business on January 9 , 1987 . You should advise the.
Treasurer that payment is being made of your assessment for the
Antelope Hills Local Improvement District.
Should you choose not to pay in full by January 9 , 1987 , you will
pay in ten (10) equal annual installments at simple interest zate
of ten percent ( 10%) per annum, with the first payment due on Me ;

Docket No. 86-71
All owners of real estate and property hereinafter described and all persons
generally are hereby notified that the Board of County Commissioners of Weld
County, Colorado, will conduct a hearing regarding the final apportionment
on the Antelope Hills Local Improvement District. Said hearing will be on
Wednesday, December 10, 1986, at 2:00 P.M. in the Chambers of the Boaxd,
First Floor, Centennial Center, 915 Tenth Street, Greeley, Colorado 806`_1 .
Paving and drainage improvements have been completed on Siasconset Road,
Madaket Road and Cliff Road, all located in Antelope Hills First Filing,
Lots 1 through 9, and Antelope Hills Second Filing, Lots 10 through 26. The
total cost of construction was $57,503.23. There will be no charges to the
Improvement District for bonds, inspection, collection or administration.
The only expense to the Improvement District is the construction cost cited
above.
Assessment to the 26 lots within the Improvement District is calculated as
follows:
Total Construction S57,503.23
Weld County Contribution - 15,000.00
Antelope Hills Trust Fund - 15,473.55
Improvement District Expense $27,029.68
$27,029.68 = S 1,039.60 per Lot

Any complaints or objections which may be made in writing by the owners to
the Board of County Commissioners and filed in the Office of the Clerk to
the Board no later than December 3, 1986, will be heard and determined by
the Board before the passage of any Resolution assessing the cost of said
improvements. Any interested party may appear at said hearing and present
oral complaints or objections.

Paving and drainage improvements have been completed on Siasconset Road,
Madaket Road and Cliff Road, all located in Antelope Hills First Filing,
Lots 1 thru 9 and Antelope Hills Second Filing, Lots 10 thru 26. The
total cost of construction was $57,503.23. A copy of the Final Receipt
and Guarantee by Flatiron Paving Company and a copy of the Final Periodic
Estimate for Partial Payment are attached.
There will be no charges to the improvement district for bonds , inspections ,
collection or administration. The only expense to the improvement district
is the construction cost cited above.
Assessment to the 26 lots within the improvement district is calculated
as follows :

Weld County Contribution - 15,000.00
Antelope Hills Trust Fund - 15,473.55

cost of improvements provided for in the Contract executed by
F]ftiron Paving Co and Payee on or about October 17 . 1986 ,
together with all amendments , change orders, and additions thereto, the sum of
Fifty-seven Thousand five hundred three and 23/100 _—
Dollars (b 57,503.23 ) ,
by checking, being the remainder of the full amount accruing to the undersigned ly
virtue if said Contract and extra work performed thereunder, said payment coverirg
and including full payment and covering and including full payment for the cost cf
all extra work and material furnished by the undersigned in the construction of
said improvements , and all incidentals thereto, for the additional consideration of
One (1.00) Dollar for the execution hereof, and the undersigned hereby releases
WELD COUNTY
from any and all claims whatsoever resulting from said Contract and all work
performed thereunder.
The undersigned by these presents certifies that all persons doing work upon or
furnishing materials for said improvements under the foregoing Contract and all
additions thereto have been paid in full , and the undersigned further cert fies
tna;, all work has been completed in a workmanlike manner in conformity with the
Plans and Specifications of the pertinent thereto. That should any
portion of said work or material prove defective within one (1) year from the
date of final acceptance of the entire project by the Owner, the undersigned she 1
replace any such defective material and remedy any such defective work to the sa -
isfzction of THE BOARD OF WELD COUNTY COMMISSIONERS and shall defend , indemnify , and
save harmless THE BOARD OF WELD COUNTY COMMISSIONERS from all damages, clans ,
demz.nds, expenses, and charge of every kind which may arise as a result of any' s var
defective material and workmanship during said period. The Performance Bond for
this Contract shall remain in effect for the period of the Guarantee.

Please find attached a draft of a Resolution to be used in the:
event there is no objection presented with respect to the fne.]
apportionment hearing on the Antelope Hills Local Improvement
District. Prior to such hearing, there is required to be a
twenty-day notice which would specify that the total cost of the
improvement was $57 , 503 . 23 ; that Weld County contributed
$15 , 000 . 00; and $15 ,473 . 55 came from funds escrowed for the
purpose of construction previously collected from the developer- c-f
the Subdivision , with a total expense of $27 ,02.9 . 6 , to the
property owners . The result is a cost of $1 , 339 . 60 to be assessed
against each of Lots 1 through 9 , Antelope Hills Subdivis:.or ,
First Filing , and Lots 10 through 26 of Antelope P:il' e
Subdivision, Second Filing , in the Northwest Quarter of Sec-Act
13 , Township 6 North , Range 67 West of the 6th Principal Me:ri.diar ,
Weld County, Colorado. The notice should also provide that ary
complaints or objections which may be made in writing by Oa
owners to the Board of County Commissioners and filed in ttc
Office of the Clerk to the Board within twenty days of puhlic:aticn

RE: Antelope Hills Improvement District
Dear Mr. and Mrs . Poos :
Antelope Hills Improvement District was bid on July 1 , 1966 . The
low bidder was Flatiron Paving Company of Greeley at $55 , 659 . 76 .
This bid is $8 , 947 . 64 below the estimate presented at the public
hearing. The awarding of the bid will take place July 16 , 1986 ,
at 9 : 00 a.m. in the Commissioners hearing room.
The approximate cost for the improvement district, if the low bid
is accepted, will be as follows:
Total construction $55 , 659 . 76
County contribution -15 , 000 . 00
Escrow -15 , 473 . 55
Improvement District $25 , 186 . 21
$25 , 186 . 21 = 26 lots = $968 . 70 per lot
The final cost will be based on actual quantities of materials
used and will be presented at the final assessment hearing. The
construction is planned to begin the first week of August, 1986 .
