RESOLUTION RE: GRANT MOBILE HOME PERMIT NO. 1423 - MARK SEXTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, on the 20th day of July, 1988 , considered the request of Mark Sexton for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows : Lot 2 , Block 21 , Aristocrat Ranchettes Subdivision, Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions: 1) The applicant shall apply for a building permit for the mobile home within thirty days from the date of approval by the Board of County Commissioners; 2) A septic permit shall be obtained and the site shall meet percolation test requirements prior to the issuance of a building permit; 3) Prior to the issuance of a building permit, the owner shall submit evidence that a potable source of water is adequate in quality, quantity and dependability for the proposed use; 4) Prior to the issuance of a building permit, the applicant shall bring Lot 2 , Block 21 , into compliance with the Weld County Zoning Regulations. The applicant shall have the opportunity either to remove the mobile home and derelict vehicles or to obtain the proper zoning permits and provide adequate screening; and 5) The mobile home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Mark Sexton for permission to place a mobile home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be , and hereby is, granted subject to the hereinabove listed conditions . X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X -Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County. COMMENTS: The application material was submitted with a petition signed by some of the surrounding property owners, but the petition failed to satisfy the requirement that 70% of the surrounding property owners sign the -petition. This failure was not caused by the surrounding property owner's objections to the applicant's request, but because the applicants misunderstood the signature procedure. The Department of Planning Services has received no _objections from the surrounding property owners regarding this request. The Aristocrat Ranchettes Water Project, -Inc. , has stated the applicant's water tap located on Lot 2 is presently serving Lot 3, Block 21. Lot 3 does not have a water tap, but does have a stick-built home constructed on it and is owned by the applicant. The applicant will need to provide an alternative water source prior to locating the mobile home on Lot 2. 880705 Board of County Commissioners ZPMH-1423 Page 2 The Department of _Planning Services' staff conditions for approval are as follows: 1.
