RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1120 - PASQUALE G. LaCONTE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1120 , does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 1120 was submitted by Pasquale G. LaConte for property which is located in part of the NW* , Section 3 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 9 . 4 acres and 2 .5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is , exempt from the definition of the terms , "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is subject to the following conditions : 1 . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners . 2 . LaConte. The legal description for this parcel is described as part of the NWT of Section 3, T3N, R68W of the 6th P.M., Weld County, Colorado. The parcel is located approximately 1 .5 miles north of the Town of Mead and east of Weld County Road 7. The request is to divide an 11.9 acre tract of land, which is the total contiguous land holdings of the applicant, into two lots of 9.4 acres and 2.5 acres, more or less. It is the opinion of the Department of Planning Services' staff that this request should be denied. The applicant has failed to show in the submitted application materials how this request is consistent with the Weld County Comprehensive Plbn and efficient and orderly development. The guidelines used to allow a division of an agricultural lot into two separate lots is outlined in Agricultural Policy Number 7 of the Weld County Comprehensive Plan. The intent of this policy is; A. To enable a property owner who is retiring the ability to sell the existing farm improvements; P. To sell nonproductive farm land; and C. To provide a residence for direct members of the farm family or workers employed on the farm. Tt is the opinion of the Department of Planning Services' staff that the recorded exemption process should not be used to simplify real estate transactions, nor to comply with the guidelines of the Federal National Mortgage Associations as outlined by the applicant as reasons for approval of this request. 08139" Board of County Commissioners RE-112O Page 2 Approval of this request will add one additional parcel to the existing 30 parcels within this quarter section. Twenty-six of these parcels constitute Highland Estates Subdivision which is completely developed. The Department of Planning Services' staff has concerns regarding additional development in this area and the potential for it to continue. The policies which regulate conversion of agricultural land into residential land uses are intended to minimize the costs to the Weld County taxpayers. As density increases, so do service demands. The development of rural areas necessitates the increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. The proposed access to the eastern lot of the recorded exemption is off of Weld County Road 7 which must cross over the Highland Lateral Ditch. The Weld County Engineering Department has indicated that this will not only severely restrict access to this lot, but will also be extremely expensive. The Department of Planning Services' staff concurs with these concerns regarding the adequacy of this proposed access. The Staff requests that the Board of County Commissioners consider the application and determine if the standards of Section 9-2 E. (1) (a) through (m) have been met. The owners of the parcel are desirous of dividing the land into two • legal parcels for the purpose of selling the existing buildings together with approximately 2.5 acres and keeping the rear larger parcel as a hillbsite for the future. It is extremely difficult to find a small. acreage building site in the Mead area where agricultural activities may be pursued without covenant restrictions. It is also difficult to find a lender who is willing to loan mortgage funds on security in excess of 10 acres. Ten acres is the maximum allowable acreage for a rural 1. e loan by the guidelines of the Federal National Mortgage Association (FNMA) , to which guidelines nearly all lenders adhere in order to sell their loans. 5. It is our understanding that Weld County's purpose is to control growth and to keep the agricultural flavor of the county. These parcel's if allowed to exist shall fit the tone of the surrounding properties. There are a number of developed parcels, approximately 10 acres in size, which are used as rural residences. There is also Highland Estates subdivision just to the north of this property, which has mune sites of 1-2 acres. The intent is to keep the agricultural productivity of the land as it is currently being used. 6. The zoning of the property now is agricultural. The new parcels would be used in exactly the same fashion with the land used for hay production/pasture as it has been used for years in the past. As explained in #5 above, each of these parcels and its uses would be consistent with other properties in the area. 7. Since the land is zoned agricultural, its intended use would not vary. The land is currently producing hay and sane chickens are kept for egg production. The smaller parcels in the area are used in the same "country gentleman" fashion. 8. The proposed parcels would each be "like kind" with other properties in the area. (See maps) It is our understanding that the town of Mead is in the process of annexing additional land to the south for subdivision into small acreage hilt sites. If this is the trend for the future, each of these parcels will conform then, as now. 9. The proposed division of the property simply cuts a corner off the otherwise rectangular parcel. The adjoining properties have each been divided into smaller parcels in recent years. The proposed exemption will be very similar to these. 10. The area is served by Little Thompson Water District and a tap will be made available per the attached letter. (Exhibit A) A septic system will be installed for sewage disposal. The ground at the proposed site is obviously satisfactory for such a system, as the residence on the subject property has a septic system, as do the neighboring hones, which are known to operate acceptably.
